City Hall Council Chambers, Room 101 The Common Council of the City of Jeffersonville met in Special Session on Monday, November 17, 2008. Council President Ed Zastawny called the meeting to order at 6:30 P.M., and on call of the roll those members present were: Councilpersons Ed Zastawny, Ron Grooms, Barbara Wilson, Connie Sellers, Keith Fetz, and Nathan Samuel. Also present was Deputy Clerk Treasurer Barbara Hollis. Councilperson Grooms made the motion to approve Che agenda with the addition of pazk claims approval, and a budget reduction ordinance, second by Councilperson Samuel, passing on a vote of 6-0. Pedcor Rezoning Assistant Planning and Zoning Director Brian Fogel reviewed the history of Pedcor's request to rezone from Ml to M3 to the Plan Commission. The request has been forwarded to the City Council with a recommendation to deny. A letter has been received from the applicant to withdraw the request. The Planning and Zoning staff recommends the Council confirm [he Plan Commission recommendation. There was a lot of public interest at the Plan Commission meeting on the 28`". Assistant Fogel recommends the 100 plus letters that have been received be entered into the record. Council President Zastawny asked the opponents be allowed to speak. Mr. David Lewis, Attorney representing the opponents, asked all those present in the standing room only crowd to raise their hands if they were opposed. It appeazed all in the crown raised their hand. Attorney Lewis asked that case #PC-08-13 be entered into the record. He referred to the comprehensive plan. Attorney Lewis requests the Council take a vote and tom down the request. Councilperson Samuel asked if the reason For the withdrawal was known. Assistant Director Fogel refereed to the withdrawal letter. He does believe the number of garages that were required was a problem. Mayor Galligan said he has been to a lot of zoning heazings, with this being the best one yet. This group did a great professional job and they need to be commended. Council President Zastawny said ditto to the Mayor's comments. He encourages all to stay involved. Councilperson Grooms made the motion to reaffirm the Planning and Zoning Board decision to deny the rezoning request, second by Councilperson Wilson, passing on a vote of 6-0. A recess was called at 6:45 P.M. The meeting was called back to order at 6:55 P.M. Park Claims Following discussion of the Pazk claim list dated November 13, 2008, Councilperson Grooms made the motion to pre-approve the claims as presented, second by Councilperson Samuel, passing on a vote of 6-0. Page 2 November 17, 2008 Budget Reduction Ordinance Councilperson Grooms presented and explained Ordinance No. 2008-OR-74, An Ordinance Of Appropriation Reduction. This was distributed at the last Board of Public Works meeting. Councilperson Grooms reviewed the totals. Councilperson Samuel made the motion to pass Ordinance No. 2008-OR-74 on the first and second readings, second by Councilperson Wilson, passing on a vote of 6-0. Orchard Hills Rezoning Councilperson Fetz made the motion to add a request for a rezoning of Orehazd Hills to the agenda, second by Councilperson Sellers, passing on a vote of 6-0. Mr. Jack Vissing, attorney representing Orchazd Hills reviewed the proposal, stating no variances would be necessary. Councilperson Fetz noted the Plan Commission received the request very well. Public comment was requested. No public comment was heard. Councilperson Fe[z made the motion to pass Ordinance No. 2008-OR-75, An Ordinance Rezoning Orchazd Hills Townhouses from C2 to M2, second by Councilperson Grooms, passing on a vote of 6-0. Council Attorney Larry Wilder informed the Council the Greater Clazk County School Board approved a Jeff High girl's basketball game at Nachand Fieldhouse. Councilperson Fetz made the motion to approve a Jeff High vs. Silver Creek girls basketball game to be played at Nachand Fieldhouse, Friday, November 21, 2008, second by Councilperson Samuel, passing on a vote of 6-0. Councilperson Samuel made the motion to extend the Ciry insurance for the game, second by Councilperson Sellers, passing on a vote of 6-0. Councilperson Grooms made the motion to adjourn at 7:10 P.M., second by Councilperson Samuel passing on a vote of 7-0.
