HomeMy WebLinkAboutNovember 3, 2008COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA November 3, 2008 The Common Council of the Ciry of Jeffersonville, Indiana met in regular session in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 7:30 P.M. on Monday November 3, 2008. Mayor Tom Galligan, with Deputy Clerk Treasurer Bazbaza Hollis at the desk, called the meeting to order. Also present were Council A[tomey Larry Wilder, and Depnty Clerk Treasurer Tiffany Timberlake. Mayor Galligan welcomed all in attendance, asking all those present to stand as Chaplain Moorer gave the invocation. Mayor Galligan then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were Councilpersons Mike Smith, Ed Zastawny, Keith Fetz, Barbara Wilson, Nathan Samuel, and Ron Grooms. Absent: Councilperson Connie SeLLers. Following discussion, Council President Zastawny made the motion to approve the agenda with the deletion of #22, table #11 replacing it with a Resolution regarding a Hiring Freeze as #11, second by Councilperson Grooms, passing on a vote of 6-0. Mayor Galligan presented the minutes for consideration. Councilperson Wilson made the motion to approve the minutes of September 29, 2008 (6:30 P.M.) as presented, second by Councilperson Fetz, passing on a vote of 6-0. Deputy Clerk Treasurer Hollis presented the claim list for consideration by the Council explaining the breakdown of the claim payable to Councilperson Wilson. Following discussion of the continuing education fund, annexation charges, and others, Councilperson Samuel made the motion [o approve the claims as presented, second by Councilperson Fetz, passing on a vote of 6-0. PUBLIC COMMENT: Ms. Jeannie Tharp lives in downtown Jeff and has a resident parking only sign. She paid $100 to get the sign and have the curb painted. The curb has never been painted. Former Councilperson John Perkins told her the $100 was aone-time charge. November 3, 2008 2 Ms. Tharp recently received a letter requesting a $100 annual renewal Fee. Mayor Galligan said there is a $100 annual fee. The matter will be taken to the Board of Public Works and Safety. Ms. Tharp said she has applied for a job with the City and has not heard anything. Mr. Tharp was told the deadline for applications is today and she will hear something. Ms. Mary Lee Wessel stated she also has received a renewal fee letter for a resident pazking only sign she has had for five years. She has never been told of an annual fee. She suggests a "grandfather" clause be considered. Her curb has never been painted. COUNCIL COMMENT: Council President Zastawny noted if an Ordinance is in place it should be enforced. If it is unfair it should be changed. Council President Zastawny noted there is a three minute public comment time limit per person and it is not fair if there is give and take conversation. DEPARTMENT HEAD REPORTS: There were no Department Head reports. AGENDA ITEMS: Councilperson Fetz presented and explained Resolution No. 2008-R-33, A Resolution Advocating A Hiring Freeze For The City Of Jeffersonville, Indiana. Councilperson Grooms noted the Salary Ordinance contains pay ranges, suggesting no salary adjustments other than municipal owned utilities be added to the Resolution. Councilperson Smith asks, "What brought this on"? Councilperson Fetz felt there was an agreement [o stop hiring and the Fire Department has a new hire. Mayor Galligan said he did not hire any that were not in the budget. The one in question was in training and there are no others. Councilperson Fetz made the motion to pass Resolution No. 2008-R- 33 with the changes as discussed, second by Councilperson Grooms. Councilperson Samuel will not vote for this as it was just received this evening and has been amended. He would prefer a "clean copy". Councilperson Grooms will vote for this as i[ gives the executive direction. The motion tied on the following mle call vote: Ayes: Conncilpersons Zastawny, Fetz, and Grooms. Nays: Councilperson Smith, Wilson, and Samuel. November 3, 2008 3 The motion failed with Mayor Galligan voting no with others until a clean copy is presented. He will not hire. Councilperson Wilson made the motion to pass Ordinance No. 2008-ORJ2, An Ordinance Amending Ordinance 2006-OR-05 Ordinance Establishing Beautification (sic) Committee Non-Reverting Fund on [he first and second readings, second by Council President Zastawny. Councilperson Grooms suggests looking at the raising of funds. The motion to pass Ordinance No. 2008-OR-72 on the first and second readings passed on a vote of 6-0. Councilperson Samuel made the motion to pass Ordinance No. 2008-OR-61, An Ordinance Of The City Of Jeffersonville, Indiana, Authorizing The Issuance Of Its Capital Development Tourism Fund Revenue Bond, Series 2008: etc. on the third and final reading, second by Councilperson Grooms, passing on a vote of 6-0. Attorney Alan Applegate asked the Council [o table for two weeks, Ordinance No. 2008-OR-63, An Ordinance Vacating A Portion Of A Drainage Easement. Council President Zastawny made the motion [o table Ordinance No. 2008-OR-63, second by Councilperson Grooms, passing on a vote of 6-0. Councilperson Grooms made the motion to pass Ordinance No. 2008-OR-59, A Salary Ordinance Amendment, on the third reading, second by Councilperson Samuel, passing on a vote of 6-0. Councilperson Grooms explained the amendments to Ordinance No. 2008-OR-64, A Salary Ordinance Amendment, making [he motion to pass on the second and third readings subject to the Clerk Treasurer's Office making hourly changes, second by Councilperson Samuel. A discussion followed regazding pay ranges. Councilperson Grooms does not like [he range, as [he Council does not approve increases. Councilperson Smith also has concerns. Mayor Galligan said managing people is a challenge at best. There is need for flexibility. Councilperson Samuel withdrew his second and Councilperson Grooms withdrew his motion Councilperson Grooms made the motion to reconsider passage of Ordinance No. 2008-OR-59, second by Councilperson Fetz, passing on a vote of 6-0. Councilperson Grooms then made the motion to pass Ordinance No. 2008-OR-59 with changes as reviewed, second by Council President Zastawny, passing on a vote of 6-0. Councilperson Cnooms made the motion to November 3, 2008 4 pass Ordinance No. 2008-OR-64 on the second and third readings with changes. Councilperson Grooms withdrew his motion Councilperson Grooms made the motion to pass Ordinance No. 2008-OR-64 on the second reading with changes, second by Councilperson Samuel, passing on a vote of 6-0. Council President Zastawny made the motion to pass Ordinance No. 2008-OR-65, An Ordinance Of Additional Appropriation (Share of Gaming Revenue-Emergency Radios) on the third reading, second by Councilperson Fetz, passing on a vote of 6-0. Council President Zastawny made the motion to pass Ordinance No. 2008-OR-66, An Ordinance Of Additional Appropriation (Share of Gaming Revenue-Gasoline) on the third reading, second by Councilperson Fe[z, passing on a vote of 6-0. Council President Zastawny made the motion to pass Ordinance No. 2008-OR-67, An Ordinance Transferring Certain Funds Within Same Deparbnent (General Fund - Police Department) on the third reading, second by Councilperson Samuel, passing on a vote of 6-0. Councilperson Samuel made the motion to pass Ordinance No. 2008-OR-68, An Ordinance Of Additional Appropriation (EDIT Fund -Police Software/Computers) on the third reading, second by Councilperson Wilson, passing on a vote of 6-0. Councilperson Grooms made the motion to pass Ordinance No. 2008-OR-7Q, An Ordinance Transferring Certain Appropriation Postings From One Fund To Another, second by Councilperson Fe[z, passing on a vote of 6-0. Councilperson Grooms made the motion to pass Ordinance No. 2008-OR-69, An Ordinance Transferring Surplus Funds From The Cumulative Capital Improvement Fund to The General Fund, second by Councilperson Samuel, passing on a vote of 6-0. Councilperson Fetz made the motion to pass Ordinance No. 2008-OR-73, An Ordinance Transferring Funds Within The Same Deparnnent (Clerk-Treasurer), second by Council President Zastawny, passing on a vote of 6-0. CLERK TREASURER COMMENTS: There were no Clerk Treasurer Comments. COMMITTEE REPORTS, COUNCIL AND MAYOR COMMENTS: Councilperson Samuel had the experience of observing Police firearm training. Officers Joe Hubbard and Chris Grim do an excellentjob. The training and instruction is November 3, 2008 5 done twice a year. Councilperson Samne] feels it wonld be beneficial to do this quarterly. As this represents a financial investment, he suggests the Council consider using Major Moves funds collected for bridge closings. Councilperson Samuel attended a meeting regarding an indoor facility for softball and baseball. There is a push to come up with funding as a public/pmate partnership. Councilperson Samuel thanks Officer Grimes for the excellent job done for the Vice Presidential candidate visit. Councilperson Grooms announced the Budget & Finance Committee would meet Friday at 3:30 P.M. in the Council Conference Room. He suggests the Purchase Order Coordinator make sure purchases are in the right azeas. Councilperson Grooms thanks Jeff High Student Ma[ and the Police Department. He appreciates Councilperson Samuel's comments regazding the Vice Presidential Candidate visit. The Department should be proud. Councilperson Wilson reminded all of the Downtown Merchants Open House to be held this Thursday starting at 6:00 RM. The Halloween Downtown was perfect. It was reported at the Animal Shelter meeting that 50 spay/neuter vouchers were issued last month. The program is going well. Councilperson Wilson reminds all "Go Vote". Councilpersou Fetz requested a copier upgrade update asking the Council to consider. Council President Zastawny reminds all of the Main Street Sk run [his Saturday. He questions how Providence banner that has put up was paid for. Mayor Galligan feels they pay to put it up. Councilperson Grooms asked the Council to consider the Parks claims list dated October 29, 2008 in the amount of $24,916.04. Councilperson Grooms made [he motion to approve the claim list as presented, second by Councilperson FeCz, passing on a vote of 6-0. Mayor Galligan noted the 2008 and 2009 budgets have been a real chore. Councilpersons Smith, Samuel and Grooms have done an excellent job. Director Mattingly and Deputy Bazbaza Hollis have been a great help. There have been a lot of budget sessions and they have been done very well and thorough. IT Director Hardy does an excellent job. He has solved a problem with [he Sanitary Sewer flow meters. He has fixed them and done maintenance [raining. Director Hardy does an excellent job. November 3, 2008 6 Mayor Galligan has had conversations with Ms. Handly regarding the Youth Football League. She has left a note Chanking him, saying he is a man of his word. The Parks Department Football League has $4,000 to pay back the money advanced. It was run very well. When the concession stand is complete it will be a great asset. The only problem is pazking. The Park and Ride lo[ has been vastly improved. He [hen explained complaints regarding an odor were from a [ruck. Halloween downtown was great and the "thank yous" were amazing. The batting facility that is being looked a[ needs to be self- sufficient He does feel it can pay for itself. es [here was no further business to con e before the Council, the meeting was adjourned 9:15 P.M. ~ G ~, OMAS R.
