An Ordinance Amending Ordinance 2006-OR-0075
"Ordinance Establishing Beau£ciation (sic) Committee
Non-Reverting Fund
WHEREAS, the Jeffersonville City Council adopted 2006-OR-0075 on December
18, 2006 creating anon-reverting fund allowing monies donated to the "Beautification
Committee' and to be deposited in an account for the purpose of permitting the
committee to expend those funds for the benefit of the City of Jeffersonville, Indiana;
WHEREAS, the Committee has operated in the City since its inception, received
donations and expended those funds on many, many worthwhile projects to enhance
the beauty and livability of the City. These projects have included, but not been limited
to, the purchase of park benches and other physical, tangible property;
WHEREAS, from time to time citizens, companies and others have expressed
some confusion as to what the purpose of the Committee is inasmuch as there is a
misinterpretation of the mission of the organization. Many individuals believe that the
Committees' activities are limited to projects such as clean-up, landscaping and other
ephemeral projects;
WHEREAS, in order to clarify that mission of the Committee is important to
rename the committee;
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Jeffersonville, Indiana that it hereby amends Ordinance 2006-OR-0075 inasmuch as
"The Beautification Committee' shall be known as the "The City Pride Committee';
This Ordinance shall remain in full force and effect as it relates to all other
aspects of the establishment of the Non-Reverting Fund and shall only be
changed as it relates to the naming of said fund and the entity that shall benefit
therefrom and conducts said activities herein.
THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND
AFTER ITS PASSAGE AND APPROVAL.
Severabilitv Clause•
Should any section, paragraph, sentence, clause or phrase of this ordinance, or its application
to any person or circumstance, be declared unconstitutional orotherwise invalid for any reason,
or should any portion of this ordinance be preempted by state or federal law or regulation, such
decision or preemption shall not affect the validity of the remaining portions of this ordinance or
its application to other persons or circumstances.
This Ordinance shall be in full force and effect from and after its passage and
approval.
