HomeMy WebLinkAbout1995-R-20RESOLUTION NO. 95-R~~.~ A RESOLUTION ADOPTING A WRITTEN FISCAL PLAN ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN ANNEXED AREA (Annexation Area 4) WHEREAS, the City of Jeffersonville desires to annex an area contiguous and adjacent to the corporate limits of the City of Jeffersonville, more particularly described in Ordinance 95-OR-~7; and WHEREAS, state law requires adoption of a fiscal plan and a definite policy for the provision of service is to annexed areas; and WHEREAS, such plan has been developed and presented to the Common Council, entitled "Fiscal Plan for Annexation Area 4"; NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, CLARK COUNTY, INDIANA, THAT: 1. The Common Council of the City of Jeffersonville, Clark County, Indiana, hereby approves and adopts the "Fiscal Plan for Annexation Area 4", which Plan is attached hereto and made a part hereof, and hereby approves and adopts the specific policies for implementation of the Plan as set out therein; 2. Any monies necessary for the provision of services as described and itemized in the attached Plan shall be budgeted and appropriated from the applicable fund, pursuant to state law and the City's budget procedure; 3. It is anticipated that this annexation will not result in the elimination of jobs for employees of other governmental entities, but in the event it does, the City of Jeffersonville shall assist such employees in obtaining new employment. However, nothing herein shall require the City to hire any such employees. It does not recommend for or against annexation, but provides an objective analys~s of the financial and other impacts of annexing Area 4. The incorporation of Annexation Area 4 into the City of Jeffersonville will require the provision of services in a manner equivalent in standard and scope to services wow provided in comparable parts of the City. This report analyzes the impact that Area 4's annexation will have on various city services and outlines a plan for providing pertinent services. To this end, the study serves as the City's written fiscal plan ano annexation policy requirements to be included in any resolution of the Common Council related to the annexation of Area 4. Such a plan and policy are necessary to meet State statutory requirements. LOCATION Annexation Area 4 is located adjacent to the northwest corner of Jeffersonville between Hamburg Pike and U.S. Highway 31 north of New Albany-Charlestown Road. Map 1, which follows this page, shows the boundaries of this 284 + acre area. Area 4 is within portions of Grants 33 and 34 of Jeffersonville Township. it should be noted that the City's ordinance pertaining to the annexation of Area 4 should contain a legal description of the area. METHOD OF ANNEXATION The City of Jeffersonville may, by ordinance, annex territory that is contiguous to its corporate limits, provided the annexation meets one of the following conditions: At least 118 of the aggregate external boundaries of the territory sougt~t to be annexed must coincide with the existing boundaries of the City of Jeffersonville; and that either: Sixty percent (60%) of the territory is subdivided; The resident population density of the territory sought to be annexed is equal to at least three (3) persons per acre; or Map 1 LOCATION MAP ANNEXATION AREA 4 COMPARABLE AREA CITY of I,EFFERSONVILLE INDIANA DEPARTMENT OF REDEVELOPMENt C. The territory is zoned for commercial business or industrial use. or 2. At least 1/4 of the aggregate external boundaries of the territory sought to be annexed coincides with the boundaries of the City of Jeffersonville; and; A. The territory sought to be annexed is needed and can be used by the City of Jeffersonville for its development in the reasonable near future. The proposed annexation of Area 6 will meet condition 2 which relates to the statutory requirements of 1C36~4-3-13(b). Therefore, the City of Jeffersonville retains the authority to annex the proposed area pursuant to the provisions that it has a 1/8 contiguity boundary and that it is needed and can be used in the future development of the City. Contiquity of Area Annexation Area 4 meets the contiguity requirements of state law as 50.8% of its boundary coincides with the present corporate limits of the City of Jeffersonville. The following statistics are presented regarding contiguity. Itwas not used to meet the legal requirements for contiguity. 2 Annexation Need The City of Jeffersonville needs to annex Area 4 to provide for a more manageable corporate limits and to assure the orderly growth of the Area in a manner that will meet the development needs of the City. Land in Area 4 can only be accessed via city streets as almost 100 percent of the street frontage is adjacent to a city street. The City of Jeffersonville needs to annex and use Area 4 for its development in the reasonably near future for reasons stated as follows: the existing pattern of urban development indicates such development will increase in Area 4, because of rail and major road access; the proposed Inner City Road to be financed by Jeffersonville will greatly enhance development potential in Area 4; favorable topography for industrial development with possible sites with rail access and 1-65 accessibility; the need for urban services is evident from the need to assist the County in responding to police calls; it is physically and economically, but not legally, a part of the City; over 50 percent (50.8%) of the Area now borders the City; there is a need to assure that sufficient good land is available for industrial and commercial development; and future development should be planned in an orderly manner that is consistent with adjacent City developments and can be coordinated with the need for urban services. 3 COMPARABLE AREA The Jeffersonville Industrial Park area was selecte(~ as a corn parable area. It is located }mmediately south of Annexation Area 4 and like Area 4 is bound on the east and west by Hamburg Pike and the Conrail Railroad respectively. This comparable area is developed industrially which is similar to the anticipated future development of Area 4 based on existing zoning and recent and projected growth trends. Also, like Area 4 the comparable area's bordered by and contains development that is oriented to Hamburg Pike. TOPOGRAPHY Topography within Annexation Area 4 ranges from 460 to 480 feet above sea level. In the comparable area, topography ranges from 470 to 490 feet above sea level. Slopes are gentle in both areas. EXISTING LAND USE Approximately 59 percent of the land in Annexation Area 4 is undeveloped. Industrial/Commercial uses dominant the developed land with all but one developed parcel in such use. The only exception is a farm with residence that occupies about 37 acres. Industrial/Commercial use consist of a manufacturing plant~ a truck maintenance operation, a m ~ni warehouse a landscape nursery and a small lot that is occupied by an office and mobile home. Development trends indicate that the undeveloped land is most likely to be developed for industrial use. Land ownership in Area 4 is in 13 separate parcels, six of which exceed 25 acres in size. Map 2, which is incorporated herein and attached as Exhibit A, shows the existing use of land 4 Following is a statistical analysis of approximate land area by use: Type of Use Agriculture/Residence Industrial/Commercial Mixed Use: Office/Mobile Home Right-of-Way Vacant Acres 37.5 84.7 2.4 .9 147.5 TOTAL: 273.0 In addition to the Area's large amount of vacant acreage, the land in agriculture use could be usea for future development. This would offer the possibility for almost 68 percent of the Area to be available for future commercial/industrial growth. ZONING The City of Jeffersonville has, under State enabling legislation, adopted extraterritorial zoning jurisdiction beyond its corporate limits; therefore, zoning within Annexation Area 4 is now being administered by the City. There is a question as to whether the land in Area 4 is entirely within I-1 Light Industrial zoning or whether part of the land is zoned R- 1, Single-family Residential. This question stems from a variance for inustrial use that was G ranted prior to the City's adoption of extraterritorial zoning. This is a matter that should be clarified; however, it does not effect this annexation study as Area 4 is not proposed for annexation under the condition that it is zoned industrial. Zonin,q Plan Because of the City's extraterritorial zoning jurisdiction, the administration of zoning will only involve the transfer of zoning district classificetions from the Fringe Area Zoning Map to the City of Jeffersonville Zoning Map. This will be aone immediately following the effective date of annexation. 5 STREETS The only improved street in Annexation Area 4 is 379 feet of Hamburg Pike, one side of which is bordered by the City. Hamburg Pike is a major artedal which provides access from the west and Downtown parts of Jeffersonville. It is in good condition and is well maintained, The City of Jeffersonville's street maintenance staff consists of a Street Commissioner and fourteen full time employees. This staff is ~ow responsible for maintaining some 145 miles of improved streets. The incorporation of Annexation Area 4 will add less than one tenth of a mile to the City's maintenance responsibilities. This would be a less than 0.1% increase in the City's street maintenance responsibilities. Routine annual maintenance operations are all that is needed for Hamburg Pike as it meets standards in the comparable area. Its improvements are exactly similar to improvements along portions of Hamburg Pike that are within the City. The Annexation of Area 4 will eventually increase the City's annual cost of street maintenance by an estimated $179. This figure was derived by dividing the City's current street miles into the expense of street maintenance. This results in a maintenance cost of $1,789 per mile of street. The application of this figure to the 0.1 miles of street in Area 4 results in the estimated annual maintenance cost of $179. Although the City will assume the responsibility for street maintenance in the first year after annexation, it is not anticipated that any increased maintenance funds will be needed until the second year. This is because of the excellent condition of the one existing street in Area 4. The only street improvement in Annexation Area 4 is the proposed Inner City Road which will connect to the heavily populated east part of Jeffersonville. This proposed route will run through the central part of Annexation Area 4. The current plan is to use Tax Increment Financing (TIF) to pay for this proposed improvement. The Inner City Road project is financially independent of the proposed annexation and will have no effect on the financial plan for Annexation Area 4. 6 Street Plan COST ESTIMATE: $179 --Annual Budget for Street Maintenance ....................................... $179 METHOD OF FINANCING: Source of funds for the above costs will be the Local Roads and Street Fund, the Motor Vehicle Fund and the General Fund, City Budget. PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Street maintenance will be assumed by the City of Jeffersonville within twelve (12) months after the effective date of annexation. The City's street maintenance budget will be increased by $179 annually starting in the second year after annexation to meet anticipated needs. The annexation of Area 4 will involve no capital improvements for streets. SIDEWALKS No sidewalks exist in Annexation Area 4. This is similar to the comparable area which has no sidewalks. Sidewalk Plan COST ESTIMATE: $0 METHOD OF FINANCING: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Because sidewalks are provided for the Annexation Area in the same manner as in comparable parts of Jeffersonville, no new sidewalk construction is planned in Area 4. 7 STREET LIGHTS There are no existing street Eights in Annexation Area 4. Three street lights are located along Hamburg Pike in the comparable area of the city. These lights resulted from the City's policy of responding to a request for lights with a study by the City Engineer which is submitted to the Board of Public Works for approval or denial. If approved the street light is installed by Public Service Indiana at a charge to the City of $7.53 per month for 150w sodium vapor lights using standard wooden poles and $6.55 for 100w sodium vapor lights sodium vapor lights. Street Liqht Plan COST ESTIMATE: $ 271 Annually METHOD OF FINANCING: General Fund PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: The street light policy in effect throughout the City of Jeffersonville will be available to Area 4 immediately upon annexation. This policy will be comparable to the situation that exist in all parts of Jeffersonville. For financial planning purposes it is assumed that the same number of street lights will be requested and approved for Area 4 as now exist in the comparable area. GARBAGE COLLECTION Garbage collection is now provided to the residents and other uses in Annexation Area 4 by two pdvate companies. Once per week residential pick-up is offered by Rumke of Indiana, inc. for $11.00 per month, and by BFI Waste Systems for $12.00 per month. Each offers varying rates based on container size for commercial customers. The City of Jeffersonville now provides one garbage pick-up per week for residences at no charge. Service is not provided for commercial or institutional uses. To avoid any additional personnel or equipment costs and landfill expenses, the City plans to contract sanitation services in Annexation Area 4 to a private company. An estimated cost, based on current City sanitation service contracts, to serve the Area's two existing residential pick-ups would be approximately $106 per year. 8 Garbaqe Collection Plan COST ESTIMATE: $106 annually METHOD OF FINANCING: Sanitation Fund and/or other funds of the City. PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: The City of Jeffersonville will let bids on a contract to provide garbage collection to Area 4 at the City's present level of serwce. Bidding documents will be prepared and a bid awarded to provide service to Area 4's two residential dwellings no later than the third month of the first year after annexation. WATER Annexation will have ~o effect on water services as it is provided in Area 4 by private companies, the Indiana-American Water Company, Inc. and the Watson Rural Water Company. Water Service Plan COST ESTIMATE: $0 METHOD OF FINANCING: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Continued provision of services by private companies. FIRE HYDRANTS Three fire hydrants are located in and six fire hydrants are located immediately adjacent to Annexation Area 4. All of the hydrants within Area 4 are on the Indiana-American Water Company, nc. system as are four of the immediately adjacent hydrants. The other two immediately adjacent hydrants ara on the Watson Rural Water Company System. An additional 2 hydrants are needed to serve Area 4 with hydrant availability comparable to the minimum standards of the Jeffersonville Fire Department. Map 4 which is incorporated herein and attached as Exhibit C, shows the location of existing fire hydrants. 9 Fire Hydrant Plan COST ESTIMATE: $1,077 annually --Annual Rental of Existing Fire Hydrants (3 @ $215.40 each) ............................. $646 --Annual Rental of New Fire Hydrants (2 @ $215.40 each) .................................... $431 METHOD OF FINANCING: General Fund,City Budget PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Rental on the existing fire hydrants will be assumed by the City the sixth month of the first year after annexation. The City will nave two new fire hydrants installed no later than the sixth month of the first year after annexation. This will provide every structure in the Area with adequate accessibility to a fire hydrant comparable to the standards of the Jeffersc nville Fire Department. SANITARY SEWER The City of Jeffersonville's sanitary sewer service does not presently serve Annexation Area 4. One use, the manufacturing plant (former "Louisville Slugger" factory) located along New Albany-Chadestown Pike, is on the City of Clarksville sewer system. All other development in Area 4 is not served by sewer. Cost estimates prepared by professional engineers indicate a capital expenditure of $507,500 would be needed to design and construct sufficient sewer lines to serve the existing uses that are not on sewer as well as provide sewer facilities that would permit the expansion of sewer to meet the needs of future growth. This would provide sewer service in a manner consistent with the prows~ons of such service in the comparable area of the City of Jeffersonville. This capital cost will be reduced by an estimated $4,350 in tap fees. However, it should be realized that these tap fees will not be collected until after the sewer is constructed and that a percentage of the fees may be paid on an nstallm ent basis. It should be emphasized that the $507,500 sewer cost is an engineers' estimate made without the benefit of detailed analysis. The estimate could.very easily be increased or decreased by: 1) detailed engineering, 2) actual construction bid, and/or 3) future economic conditions. Also, it might be possible to realize a cost savings by using city forces for part of the 10 construction and anticipated development projects in Area 4 might provide lines that could serve some of the unsewered area. Map 5, which is attached and incorporated herein as Exhibit D, shows existing sanitary sewer lines and identifies structures to be served by proposed sewer. Sanitary Sewer Plan COST ESTIMATE: $507,500 capital expense METHOD OF FINANCING: General Fund and other City funds PLAN FOR ORGANIZATION AND EXTENSION OF SERVICE: As part of the Annexation Area 4 plan, the City will design and construct adequate sanitary sewer lines to serve the developed, but unsewered parts of the Area. Engineering design will be completed in the first quarter of year three and all construction will be completed prior to the end of year three. Sewer construction will involve an estimated 2,900 linear feet of gravity sewer, 9 new manholes, one new pump station and 1,200 feet of force main. These improvements will, not serve existing uses but will permit sewer expansion to meet the needs of future growth. Also, it will improve service to a trucking terminal located within the City. STORM DRAINAGE Storm drainage facilities in the form of either ditches and culverts is available in Area 4. Routine maintenance of drainage facilities is provided by the City's street anti sanitary sewer maintenance personnel in the corn parable area. Some drainage improvements should be undertaken in Annexation Area 4 to improve the drainage handling capabilities of the existing system in the City. They would correct drainage problems in the incorporated area immediately south of Area 4. The cost of this improvement is not included as part of this study as it does not directly affect the proposed annexation area. COST ESTIMATE: $0 METHOD OF FINANCING: Inapplicable PLAN FOR ORGANIZATION AND EX'gENSION OF SERVICE: 11 The City of Jeffersonville's personnel engaged in street and sanitary sewer maintenance will provide routine storm drainage maintenance by the twelth month of the first year after annexation. This service will be corn parable to the storm drainage maintenance provided throughout the corn parable area. The expense for this servIce is included in the cost figure for street maintenance, FLOOD PLAIN A portion of the northern part of Annexation Area 4 is in the 100-year flood plain according to the Federal Emergency Management Agency (FEMA). Map 7, which is incorporated herein and attached as Exhibit E, is a copy of the official FEMA map which covers Annexation Area 4. Through its exercise of extraterritorial zoning jurisdiction, the City of Jeffersonville's flood plain regulations are now effective in Area 4. These regulations make property owners eligible for flood insurance under the FEMA program. Flood Plain Plan COST ESTIMATE: $0 METHOD OF FINANCING: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Jeffersonville's flood plain regulations are already being administered in Area 4. FIRE PROTECTION Fire protection is presently provided to Annexation Area 4 by the McCulloh Volunteer Fire Department from its stations on Allison Lane and Hale Road. In Area 4 the McCulloh system has a Class 7 rating. Jeffersonville Township now pays the Volunteer Fire Department for protection through a .1899 tax rate for properties in the unincorporated parts of the Township. Property owners in Area 4 would cease to pay this tax one year after annexation. Annexation Will transfer the responsibility for fire protection to the City of Jeffersonville Fire Department Which has a Class 5 rating. A major advantage of the Jeffersonviile Fire Department is 24-hour response With sufficient people on duty at all times. The 12 Jeffersonville Fire Department now has 49 fire fighter personnel and six trucks which serve the City from tl~ree stations. The distribution of fire fighting personnel and equipment is as follows: Central (Wall Street) East (Crestview) North (Fabricon) 4 Trucks 1 Truck 1 Truck 21 Firefighters 12 Firefighters 12 Firefighters Fire Protection Plan COST ESTIMATE: $0 METHOD OF FINANCING: PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: The City of Jeffersonviile wi] provide fire protection to Area 4 from its North Station (Fabricon Road) six months after the effective date of annexation. This will give Annexation Area 4 an exceptionally high standard of fire protection. Most of the Area's development will be less than one mile from the station and almost every structure will be within one and one-half miles. This will improve the Area's fire protection service from a Class 7 to Class 5 rating. Service to Area 4 will not require any additional personnel or equipment. The City is currently studying two potential annexation areas in addition to Area 4. If all three areas are annexed, it would not effect or change the plan outlined herein for Area 4. POLICE PROTECTION Police protection is now provided to Annexation Area 4 by the Clark County Sheriff's Department. The Sheriff's Department has 31 officers to serve the entire County. The annexation of Area 4 will transfer the responsibility for police protection to the Jeffersonville Police Department. This Department will able to respond much quicker to the Area's police calls. In fact, the Jeffersonville Police Department makes a ~out 33 runs per year to unincorporated areas because the Sheriff's Department personnel is stretched over too much land area. The annexation of Area 4 will help reduce the County's police work load. 13 Existing personnel of the Jeffersonville Police Department consists of the Chief, Assistant Chief, 35 officers and 8 civilians. The City is now divided into three areas for patrol purposes and identification. Response time for the Police Department to all parts of the City averages 2.5 minutes. The patrol area delineations are as follows: East West North All streets east of Main Street All streets west of Main Street Everything north of E. 10th Street and Spring Street Police runs in the comparable Jeffersonville Industrial Park Area average 192 runs per year. It is estimated that Annexation Area 4 will average approximately the same number of runs annually when it is fully developed. Police patrols now servicing the Meadows subdivision and New Albany-Charlestown Pike will be able to serve Annexation Area 4 with no increase in patrol time. This is because no streets are located in the interior of Annexation Area 4 and the 379 feet of roadway to be annexed is now patrolled as it fronts Jeffersonville on one side. All existing development is located along roads now patrolled 13y the Jeffersonsville Police Department. Police Protection Plan COST ESTIMATE: $0 METHOD OF FINANCING: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Police patrols now traveling Hamburg Pike and New Albany - Chadestown Pike will be instructed to provide police protection to Annexation Area 4 starting the first day after the effective date of annexation. This plan to assume police protection responsibility can be implementec~ at no additional expense to the City as it will not require the hiring of any new personnel, will not require the purchase of any new equipment and will not even increase current patrol time. The City is now studying two annexation areas in addition to Area 4. These three areas, when combined, will not change the financing, personnel or equipment needs plan outlined in the study of each individual area. It should be stressed, however, that annexations beyond the three areas currently under study could result in the need for additional budget. 14 RECREATION No public recreational facilities are located in Annexation Area 4. However, the Clifford Graves City Park is located immediately adjacent to Annexation Area 4 on Hamburg Pike. If contains a soccer field running track, basketball court, shelter house and an assortment of playground equipment. Aisc the Thomas Jefferson School. located from 1/2 to one mile from Area 4, offers playground facilities that would be available for residents of the proposed annexation area. Some 154 acres of neighborhood, community and city parks are located througi~out the City and will be available for the use of Area 4's residents. No increase in recreation personnel or facilities will be needed because of the annexation of Area 4. Recreation Plan COST ESTIMATE: $0 METHOD OF FINANCING: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: The present recreational facilities of the City of Jeffersonville will be available to the residents of Area 4 immediately upon annexation. This will be comparable to the facilities available to the residents of comparable areas in the City. CITY ENGINEERING, PLANNING & ZONING, INSPECTION & BUILDING CODE ENFORCEMENT Al of the services of the City's engineering, planning and zoning, inspection and code enforcement personnel that are currently provided to residents of the City and the comparable areas will be made available to Annexation Area 4. No additional personnel will be needed to provide these services. These services can be provided within the bounds of existing resources. Administrative Services Plan COST ESTIMATE: $0 METHOD OF FINANCING: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Immediately upon annexation, all of the City's administrative services will be provided to Annexation Area 4's residents and businesses in the same manner and scope they are now provided to comparable areas of the City. These services will be extended without hardship to the City's administrative offices and at no increased cost. OTHER CITY FUNCTIONS This plan attempts to Outline services that may be impacted by the inclusion of Annexation Area 4 within the City of Jeffersonville's corporate boundaries. Any services not specifically addressed in this report have not been omitted for lack of consideration. Rather, their absence indicates that provision of these services to the Annexation Area and/or its residents and businesses will be Provided in the same manner that such services are provided to comparable areas without the expenditure of additional funds. HIRING PLAN It is anticipated that this annexation will not result in the elimination of jobs for employees of other governmental entities, but in the event if does, then the City of Jeffersonville will assist these employees in the obtaining of new em ployment. However, the City will not be required to hire any of these employees. n the event of unforeseen elimination of jobs, the City will take the application of any such employee and maintain a special file of these applications.
