A RESOLUTION RECOMMENDING PROPOSAL BY THE
CITY PLAN COMMISSION FOR AMENDMENT OF
THE CITY ZONING ORDINANCE WITH REGARD TO PENALTIES
WHEREAS, the City of Ieffersonville zoning code provides for injunctive relief upon violation
of the general provisions contained therein; and
WHEREAS, injunctive relief through the court system is an expensive and time consuming
process for all parties involved, and
WHEREAS, the current general penalty provisions of said ordinance do not provide for any
monetary fines, the imposition of which could be an additional incentive for adherence to the provisions
therein and a disincentive for violators of the ordinance to unnecessarily delay actions for an injunction
so that violations of the ordinance could continue unpunished; therefore
BE IT RESOLVED by the Common Council of the City of leffersonville that pursuant to Indiana
Code 36-7-4-602, the Common Council requests that the Jeffersonville Plan Commission prepare a
proposal to amend the text of the City's previously adopted Zoning ordinance to include monetary fines
in such amounts as are deemed appropriate for each violation of the performance standards and other
restrictions set forth in said ordinance, in addition to the injunctive relief already provided for in the
ordinance.
