Monday, August 18, 2008 - 6:30 P.M.
City Hall Council Chambers
The Common Counci] of the City of Jeffersonville met in Special Session on Monday,
August 18, 2008. Council President Ed Zastawny called the meeting to order at 6:40
P.M., and on call of the roll those members present were: Councilpersons Ed Zastawny,
Ron Grooms, Bazbaza Wilson, Connie Sellers, Mike Smith, Keith Fetz, and Nathan
Samuel. Also present was Deputy Clerk Treasurer Barbara Hollis.
Following discussion, Councilperson Samuel made the motion to approve the agenda
with the addition of item #7a, Ordinance No. 2008-OR-48, and #76 claim for SIMI,
second by Councilperson Sellers, passing on a vote of 7-0.
Additional Appropriation Ordinance
Councilperson Wilson explained the need for passage of Ordinance No. 2008-OR-48, An
Ordinance Of Additional Appropriation (EDIT), making the motion to pass Ordinance
No. 2008-OR-48 on the first reading, second by Councilperson Grooms. Following
discussion, Councilperson Grooms withdrew his second and Councilperson Wilson
withdrew her motion. This has been advertised for a public hearing at 7:30 P.M.
SIMI Claim
Councilperson Grooms presented a claim Pox Southern Indiana Minority Initiative in the
amount of $2,5000 making the motion to pay the claim from the appropriation for the
Social Status For Black Males, second by Councilperson Fetz. Councilperson Smith
noted most donations of [his type have been cu[ in half. It is his understanding this will
not be in the budget next year. Councilperson Samuel has made the statement this
funding should not be considered for next yeaz. Following all discussion, the motion
passed on a vote of 7-0.
Emergency Radios
Bmergency Management Coordinator Mindy Christian and Officer Josh Lynch requested
funding to purchase 20 to 30 hand-held emergency radios. The radios are to be
distributed at the time of an emergency. At the conclusion of all discussion,
Councilperson Grooms made the motion to pass Resolution No. 2008-R-19, A Resolution
To Advertise For An Additional Appropriation, from the Gaming Revenue Fund, second
by Councilperson Sellers, passing on a vote of 6-1. Councilperson Smith voted against
passage.

Drive Off Ordinance
Councilperson Samuel presented Ordinance No. 2008-OR-49, An Ordinance Requiring
All Establishments Tha[ Sell Gasoline In A Retail Environment Requirement Pre-
Payment Prior To Sale. Police Chief Derringer explained the need due to the number of
drive-offs, safety concerns, and the number of man-hours. Council Attorney Larry
Wilder explained interstate commerce cannot be impeded. This is a safety issue. This
has been done all over the Country and he found nothing has been challenged.
Councilperson Samuel is personally fmstrated, voicing concem over dozens a day. It is
not possible to chazge to investigate a crime. Chief Derringer noted there have been
pursuits. The main concem is safety. He feels runs would go down drastically.
Councilperson Smith asked how far the City should go to protect a vendor that can
protect himself. At [he conclusion of al] discussion, Councilperson Samuel made the
motion to pass Ordinance No. 2008-OR-49 on the first reading, second by Councilperson
Sellers, passing on a vote of 7-0.
Accident Fee Ordinance
Police Chief Derringer would like to create revenue to recoup fuel costs by chazging a
towing impound lot fee for working an accident. A company has offered services.
Assistant Chief Morlan explained the types of fees that aze currently chazged.
Councilperson Sellers would like to review the offer from the company. Councilperson
Samuel voiced concem for fees. Council Attorney Wilder explained the legality of
chazging fox extra services. Councilperson Fetz and Sellers will meet with Chief
Derringer. Council Attorney Wilder noted the need for a contract.
Take Home Vehicle Ordinance
Ordinance No. 2008-OR-47, An Ordinance Regulating The Use Of City-Owned Motor
Vehicles was brought up for discussion. Council President Zastawny noted the Police
Department has imposed a take home vehicle policy, suggesting this be tried for now.
Councilperson Samuel feels all departments should be reviewed. Chief Derringer feels
the Police Department policy is strict, asking that it be given a chance. Councilperson
Sellers made the motion to table Ordinance No. 2008-OR-47, second by Councilperson
Smith, passing on a vote of 7-0.
Councilperson Samuel made the motion to adjourn at 7:30 P.M., second by
Councilperson Grooms passing on a vote of 7-0.
