HomeMy WebLinkAbout2008-OR-46ORDINANCE N0.2008-OR- `-1 AN ORDINANCE REGULATING THE PURCHASE OF CITY-OWNED MOTOR VEHICLES ACKNOWLEDGING THE NECESSITY OF FUEL CONSERVATION AND FISCAL RESPONSIBILITY WHEREAS, Indiana Code 36-4-4-4 provides that the City Council shall be responsible for managing the finances and property oFthe City; WHEREAS, in order to conduct the business of governing the City of Jeffersonville it is necessary that the City purchase, maintain and operate vehicles. These vehicles include, but are not limited to: police cars, fire trucks, gazbage trucks, dump trucks, pick-up trucks, passenger vehicles, and other motorized vehicles as defined by Indiana law; WHEREAS, the City Council acknowledges and understands that the needs of each department of government, as it relates to the vehicles necessary to carry out their duties, may differ significantly; WHEREAS, the City Council acknowledges and understands that line-officers on the police department may require vehicles that perform in a different manner and at a different level and degree than those vehicles required by the Parks Department, Code Enforcement Officer and/or other non-public safety entities; WHEREAS, the City Council acknowledges and understands that their distinctions and differences in the needs of tmeks for gazbage pick-ug constmetion projects and day-today parks operations; WHEREAS, as a result of the significant increase in the cost of fuel, maintenance and upkeep of the City's vehicles the necessity has arisen that requires the Ciry Council to adopt certain rules and regulations in order to manage the City's finances as it relates to City owned vehicles as well as the purchase of vehicles in the near and distant future: THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF JEFFERSONVILLE, INllIANA ADOPTS THE FOLLOWING ORDINANCE: SECTION ONE: 11 This Ordinance shall apply to all vehicles purchased by the Ciry of Jeffersonville, Indiana. 1.2 Fuel Efficiency Requirements: Page 1 of 2 A. Except as provided in subsection (B), no passenger vehicle shall be purchased by the City of Jeffersonville unless said vehicle has a minimum fuel efficiency rating of 24 miles per gallon when operated within the City as defined by the Federal Govemment and affixed to said Federally required disclosure statement; B. Except as provided in subsection (C), no track, pick-up truck, SUV or other vehicle that is not a passenger vehicle shall be purchased by the City of Jeffersonville unless said vehicle has a minimum fuel efficiency rating of 16 miles per gallon when operated within the City as defned by the Federal Government and affixed to said Federally required disclosure statement; C. 'T'hese requirements shall not apply to the purchase of vehicles that shall be equipped for and/or utilized for the purpose of providing emergency response and/or public safety. However, those exempt emergency response and/or public safety vehicles shall be affixed with al] appropriate emergency lights and emergency decals. If an emergency and/or public safety vehicle does not have [he appropriate lights and decals it shall not be exempt from these requirements; 1.3 Exceptions to Fuel Efficiency Requirements: A. The City Council shall have the authority to grant an exemption to these fuel efficiency requirements upon request of the mayor and/or his designee and upon showing of good cause as [o why [he necessity exists to purchase vehicles that do not meet those fuel efficiency requirements as set forth herein; SECTION TWO: Effective Date That this ordinance shall take effect immediately upon its passage.
