HomeMy WebLinkAbout1995-R-05RESOLUTION IN SUPPORT OF HOUSE BILL 1057, DRIVING WHILE INTOXICATED LICENSE PLATES. WHEREAS, the City of Jeffersonville recognizes that it is in the best interest of the Citizens of Jeffersonville to take the steps necessary to prevent dnmk driving. WHEREAS, in an effort to curtail dnmk driving and to insure the safety of the men, women and children in the City of Jeffersonville and the State of Indiana, the Common Council of the City of Jeffersonville supports the passage of House Bill 1057 by the Indiana General Assembly in the 1995 legislative session. WHEREAS, House Bill 1057 would require a court to impound the certificate of registration and license plate under certain circumstances for a vehicle owned or registered to a person who is convicted of operating a vehicle while intoxicated at least twice. House Bill 1057 allows a person who has had a license plate impounded to receive a probationary license plate from the bureau of motor vehicles under special circumstances that contains a unique series of letters and numbers that may be identified by a law enforcement officer. Further, it provides that a law enforcement officer may stop a vehicle that displays a probationmy license plate at any time. WHEREAS, this resolution is an effort to show support of all efforts by the Indiana General Assembly to st.op dnmk driving. IC 9-30-5-18 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS !fOLLOWS [EFFECTIVE JULY 1. 1995]: Sec. 18. (a) In addition to a criminal penalty imposed for an offense under tkis chapter, if a court: (1) recommends the suspension of a person's driving prix'lieges under section 10 of this chapter; and (2) t-rods that the person has at least two (2) pre~fous conx'ictions for operating a vehicle while into.~¢ated that have occurred less than ten (10) 3'ears before the conxfction under consideration by the coum; the court shall issue an order in~tx, unding the certificate of registration and license plate for a vehicle owned by the person or registered to the person. (b) A certificate of registration or license plate impounded by a court under this section mu, st b~urrendered to the court not more than three (3) days after the court issues the order impounding the certificate of registration and license plate. (c) A person may not recover from a court a certificate of regLvtration or license plate impounded under this section until: (1) the person's dri~Sng privileges have been restored: or (2'~ thc person sells or transf'ers to another person tt~e vehicle for wlfich the certil~cate of regL~ration or license plate has been issued.
