HomeMy WebLinkAbout07-07-2008COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA July 7, 2008 The Common Counci] of the City of Jeffersonville, Indiana met in regular session in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 7:30 P.M. on Monday July 7, 2008. Mayor Tom Galligan, wiCh Clerk Treasurer Peggy Wilder at the desk, called the meeting to order. Also present were City Attorney Darren Wilder, Council Attomey Larry Wilder, and Deputy Clerk Treasurer Bazbara Hollis. Mayor Galligan welcomed all in attendance, asking al] [hose present to stand as Chaplain Conrad Moorer gave the invocation. Mayor Galligan then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were; Councilpersons Mike Smith, Ed Zastawny, Keith Fetz, Connie Sellers, Bazbaza Wilson, Nathan Samuel, and Ron Grooms. Absent: None. Following discussion, Councilperson Grooms made the motion to approve the agenda with the removal of agenda item #12, adding approval of Parks claims, second Councilperson Samuel, passing on a vote of 7-0. Clerk Treasurer Wilder presented the claim list for consideration by the Council, asking that the claims for litigation and credit card as discussed in the special session be added. Following discussion Councilperson Grooms made the motion to approve the claims as presented along with the additional, second by Councilperson Sellers, passing on a vote of 6-1. Councilperson Samuel voted against passage. PUBLIC COMMENT: There was no public comment. COUNCIL COMMENT: Councilperson Smith thanked Redevelopment Director Robinson for the provided tax abatement printout. DEPARTMENT HEAD REPORTS: There were no Department Head reports. July 7, 2008 2 AGENDA ITEMS: Redevelopment Director Gayle Robinson and Engineer Jorge Lanz appeared before the Council requesting approval of expenditwes from TIF Funds to proceed with upgrades to Veterans Parkway. The bonds have been slow in being sold. It would be good to get the project started. The plan is to reimbwse TIF when the bonds aze sold. Council President Zastawny reported the Redevelopment Authority is in support of this. Engineer Lanz explained the Towne Center intersection project and the Thompson Lane 10`" Street projects. Following all discussion, Council President Zastawny made the motion to approve TIF Funds expenditures for Veterans Parkway projects as explained, second by Councilperson Samuel, passing on a vote of 7-0. Councilperson Grooms presented and explained the Parks Deparhnent claim list in the amount of $27,450.37. Following discussion Councilperson Grooms made the motion to approve the list as presented, second by Councilperson Fetz, passing on a vote of 7-0. Councilperson Grooms presented Ordinance No. 2008-OR-31, An Ordinance Amending Basic Salaries Of Appointed Officials And Employees Of The City Of Jeffersonville, noting an Annexation Assistant Planning Director has been added. He feels this violates the rules on three readings. Also, Councilperson Grooms has communicated with Sanitary Sewer Board Members regazding this Ordinance and feels there is some confusion. Councilperson Grooms then made the motion to table Ordinance No. 2008-OR-31 as he feels all should get in harmony. He would like a recormnendation from the Sewer Board. Councilperson Sellers asked Council Attorney Wilder his opinion of the first reading. Council Attomey Wilder said an Ordinance could be changed on the third reading. Councilperson Sellers talked with Sewer Boazd Member Saegesser and he is OK with this. Council Attorney Wilder said the Sewer Boazd controls hiring and firing. Councilperson Samuel agrees with the need for an Assistant Planning Director, he does not agree with adding it for the third reading. Council President Zastawny seconds the motion to table. Mayor Galligan said the Sewer Board is well aware of this request. He is trying to comply with the EPA. He would like to hire a superintendent to work with to hire others. This is all about the EPA and the enhancement of the operation of the system and the lowering of any penalties. A good July 7, 2008 3 faith effort needs to be puC forth. Councilperson Sellers read an email message from Sewer Boazd Member Saegesser. Councilperson Grooms will not support the Sewer amendment at this time. The vote to table Ordinance No. 2008-OR-31 failed on the following roll call vote: Ayes: Councilpersons Wilson and Grooms. Nays: Councilpersons Smith, Zastawny, Fetz, Sellers, and Samuel. Councilperson Samuel made the motion to pass Ordinance No. 2008-OR-31 on the third reading with the removal of the Assistant Planning Director, second by Councilperson Sellers, passing on a vote of 6-1. Councilperson Grooms voted against passage. Councilperson Samuel next made the motion to pass Ordinance No. 2008-OR- 36, An Ordinance Amending Basic Salazies Of Appointed Officials And Employees Of The City Of Jeffersonville on the first reading, second by Council President Zastawny. Planning and Zoning Director Jim Urban appreciated the support for the Planning and Zoning Assistant. Brian Fogel has been hired and there is concern for his pay. Councilperson Grooms supports the position. This was discussed in a Febmary workshop. His problem is the process. The motion to pass Ordinance No. 2008-OR-36 on the first reading passed on a vote of 7-0. Councilperson Fetz made the motion to pass Ordinance No. 2008-OR-33, An Ordinance Authorizing The Purchase Of A Blanket Bond on the second and third readings, second by Councilperson Sellers, passing on a vote of 7-0. Councilperson Samuel made the motion to pass Ordinance No. 2008-OR-34, An Ordinance Establishing Fees And Costs Associated With The Closure Of The Clazk Memorial Bridge on the second and third readings adding Major Moves Fund on page 2, Section 4, second by Councilperson Grooms, passing on a vote of 7-0. Councilperson Samuel made the motion to pass Ordinance No. 2008-OR-35, An Ordinance Establishing Fees For Copies Of Photographs Taken By The Jeff Police Department At Accident Scenes on the second and third readings, adding Section 8, Depositing collections in [he Police Training Fund, second by Councilperson Grooms, passing on a vote of 7-0. Clerk Treasurer Wilder explained the need for passage of Ordinance No. 2008- OR-37, An Ordinance Transfening Certain Funds Within The Same Department -Police July 7, 2008 4 Clothing Allowance. Councilperson Fetz made the motion [o pass Ordinance No. 2008- OR-37 on the first reading, second by Councilperson Fetz, passing on a vote of 7-0. Councilperson Grooms introduced and explained Ordinance No. 2008-OR-38, An Ordinance Transferring Certain Funds Within Same Department -Annexation Fund, making the motion to pass on the first reading, second by Councilperson Samuel, passing on a vote of 7-0. Council President Zastawny would like to pull these expenditures out for the excess levy appeal. Councilperson Smith introduced and explained Ordinance No. 2008-OR39, An Ordinance Transferring Funds With Same DepartmenC (Common Council -cell phones), making the motion to pass on the first reading second by Councilperson Wilson, passing on a vote of 7-0. Councilperson Sellers introduced Ordinance No. 2008-OR-4Q, An Ordinance To Prohibit The Interference Or Impediment Of Public Streets And Right-Of--Way asking Council Attorney Wilder to explain. Councilperson Fetz is concerned this is overkill, saying there is a need for play areas. Councilperson Sellers has concerns for an enforcement policy. Mayor Galligan feels [his is a safety issue explaining a few hurt feelings aze better than one dead child. Following al] discussion, Councilperson Sellers made the motion to pass Ordinance No. 2008-OR-40 on the first reading, second by Councilperson Grooms, passing on a vote of 7-0. Councilperson Samuel introduced Ordinance No. 2008-OR-41, An Ordinance Rescinding 2006-OR-38, An Ordinance Establishing The City Hall Building AuChoritg explained the need to rescind. Councilperson Samuel then made Che motion to pass Ordinance No. 2008-OR-41 on the first and second readings, second by Councilperson Grooms. Councilperson Grooms asked if any funds would be put in jeopardy. He was assured they would not. The motion passed on a vote of 7-0. Councilperson Samuel introduced and explained Ordinance No. 2008-OR-42, An Ordinance CreaCing Jeffersonville City Hal] Building Advisory Board, making a motion to pass on [he firs[ reading, second by Council President Zastawny, passing on a vote of 7-0. Councilperson Grooms explained the need fox passage of Resolution No. 2008-R- 15, A Resolution To Advertise For Additional Appropriation - EDIT Fund. July 7, 2008 6 Councilperson Grooms made [he motion [o pass Resolution No. 2008-R-15, excluding [he Police portion. Councilperson Wilson would like to see downtown restrooms pursued. The need for downtown restrooms was discussed. The motion to pass Resolution No. 2008-R-15 passed on a vote of 6-1. Councilperson Samuel voted in opposition. CLERK TREASURER COMMENTS: There were no Clerk Treasurer Comments. COMMITTEE REPORTS, COUNCIL AND MAYOR COMMENTS: Councilperson Grooms announced a finance committee meeting for July 10 at 3:00 Y.M. He asks for budget suggestions Councilperson Grooms asked Mayor Galligan for permission to reconsider the vote on Ordinance No. 2008-OR-36. Mayor Galligan granted permission. Councilperson Grooms then made the motion to suspend the rules for Ordinance No. 2008-OR 36, second by Councilperson Fetz, passing on a vote of 7-0. Councilperson Grooms then made the motion to pass Ordinance No. 2008-OR-36 on all three readings, second by Councilperson Zastawny, passing on a vote of 5-2. Councilpersons Samuel and Smith voted against passage. Councilperson Wilson gave a report on the Animal Shelter meeting. She encourages all to support the golf tournament. The July 4`h pazade was lovely and bigger. Councilperson Sellers agrees with Councilperson Fetz there is a need for more areas to play, suggesting development regulations. Councilperson Smith asks that a letter of request for land of 18 to 20 feet by 8 feet be send to Chase Bank, Life Springs and Bales for restrooms. Mayor Galligan agrees. Councilperson Zastawny voiced his concern for hand carried claims. Clerk Treasurer Wilder explained the two requested tonight have been ongoing and discussed. Councilperson Zastawny requested an update on Dnffy's Landing. Mayor Galligan gave an update on the progress, explaining [he docks aze high because they are lake docks and need be able to be taken out. There is a need for reaction time. Mayor Galligan said thank you to all who attended the July 4`" parade saying it was absolutely fabulous. He handed out tattoos and did not realize how popular [hey are. Pat Elder and her group did a fabulous job. The Tuskegee Airman received a warm reception. Mayor Galligan noted there are restrooms at Warder Pazk for concerts.
