COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE, INDIANA
March 3, 2008
The Common Council of the City of Jeffersonville, Indiana met in regular session
in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 730 P.M.
on Monday March 3, 2008.
Mayor Tom Galligan, with Deputy Clerk Treasurer Barbaro Hollis at the desk,
called the meeting to order. Also present were Ciry Attomey Darren Wilder and Council
Attomey Larry Wilder. Mayor Galligan welcomed al] in attendance, asking al] those
present to stand as Councilperson Grooms gave the invocation. Mayor Galligan then
asked all those present to join him in the pledge of allegiance to the flag.
The roll was called and those present were; Councilpersons Mike Smith, Ed
Zastawny, Kcith Fetz, Connie Sellers, Barbara Wilson, Nathan Samuel, and Ron Grooms.
Absent: None.
Following discussion, Councilperson Samuel made the motion to approve the
agenda with the addition of #18A, Drainage Board Ordinance and the deletion of #19 to
the corrected agenda, second by Councilperson Grooms, passing on a vote of 7-0.
No minutes were presented for approval.
Deputy Clerk Treasurer Hollis presented the claim list for consideration by the
Council Councilperson Fetz explained his Verizon bill included equipment. The Fire
Department Verizon bill was for six month of service. Council President Zastawny asked
the Duke claim for City Hall be checked. Also, Vehicle Maintenance Director Drury will
have additional utility needs in the new building. Following all discussion Council
President Z.astawny made the motion [o approve the claims as presented second by
Councilperson Fetz, passing on a vote of 7-0.
PUBLIC COMMENT:
Mr. Derek Spence spoke in opposition to the public comment Ordinance, saying
he fccls public comment would be stifled.

DEPARTMENT HEAD REPORTS:
There were no Department Head reports.
AGENDA ITEMS:
Councilperson Grooms reviewed the need for passage of Ordinance No. 2008-
OR-8, An Ordinance Amending Ordinance 07-OR-69, An Ordinance Fixing Basic
Salazies Of Elected Officials Of The City Of Jeffersonville, Indiana For The Year 2008.
Councilperson Grooms made the motion to pass Ordinance No. 2008-OR-8 on the sewnd
and third readings, second by Councilperson Wilson, passing on a vote of 7-0.
Councilperson Sellers asked Council Attorney Larry Wilder to explain the
changes to Ordinance No. 2008-OR-14, An Ordinance Rescinding Ordinance No. 68-
OR-10 And Resolution 00-R-010 And Ordinance 93-OR-023 And Resolution 1993-R-
004, An Ordinance Establishing Rules Of Order And Procedures For Public Comment At
Meetings Of The Jeffersonville City Council. Councilperson Smith said he cannot
support the Ordinance as is, making the motion to move N to follow F in Section Two.
Following other suggestions and comments by Mayor Galligan and the Council,
Councilperson Fetz made the second to the motion. The motion passed on the following
roll call vote:
Ayes: Councilpersons Smith, Zastawny, Fetz, and Wilson.
Nays: Councilpersons Sellers, Grooms, and Samuel.
Councilperson Zastawny then made the motion to pass Ordinance No. 2008-OR-14 as
amended on the second reading, second by Councilperson Wilson, passing on a vote of 7-
0
Councilperson Fetz made the motion to pass Ordinance No. 2008-OR-12, An
Ordinance Of Additional Appropriation (EDIT Fund - Pazks Department Mowers) on the
second and third readings, second by Councilperson Zastawny, passing on a vote of 7-0.
Councilperson Fetz asked Events Coordinator Beverly Knight to explain
Ordinance No. 2008-OR-13, An Ordinance Rescinding Ordinance Number 00-OR-026
"Ordinances Prohibiting Leasing Of City Property Beneath The Kennedy Bridge During

Thunder". Coordinator Knight explained the proposed program. Following discussion,
Councilperson Fetz made the motion to pass Ordinance No. 2008-OR-13 on the second
and third readings, second by Councilperson Sellers. Councilperson Grooms asked about
the projected eemings to [he City. Coordinator Knight explained it is hoped to sell the
permits for $1,000 and receive 35% from vendors after expenses. The motion passed on
a vote of 7-0.
Mr. Jorge Lanz, Engineer with Jacobi, Toombs and Lanz, explained Ordinance
No. 2008-OR-9, An Ordinance Of The Ciry OP Jeffersonville Authorizing The Issuance
Of Sewage Works Revenue Bonds For The Purpose Of Providing Funds To Pay The Cost
Of Certain Additions, Extensions, And Improvements To The Municipal Sewage Works
Of Said City, Providing For The Safeguarding Of The Interests Of The Owners Of Said
Bonds, Other Matters Connected Therewith, Including The Issuance Of Notes In
Anticipation Of Bonds, And Repealing Ordinances Inconsistent Herewith.
Councilperson Grooms made the motion to pass Ordinance No. 2008-OR-9 on the second
and third readings, second by Councilperson Sellers, passing on a vote of 7-0.
Councilperson Wilson made the motion to pass Resolution No. 2008-R-IQ A
Resolution Granting Authority For The Jeffersonville Fire Department To Apply For A
New Credit Card Account And Cancel Previous Administrations Credit Card Account,
second by Councilperson Sellers, passing on a vote of 7-0.
Councilperson Wilson made the motion to pass Resolution No. 2008-R-9, A
Resolution Granting Authority For The Jeffersonville City Engineer To Apply For A
Credit Card Account, second by Councilperson Fetz, passing on a vote of 7-0.
Councilperson Samuel introduced and explained Ordinance No. 2008-OR-15, An
Ordinance Creating ANon-Reverting Fund For The Jeffersonville Police Department For
The Accumulation Of Assets Recovered During Police Tnvestigations And Forfeitures
From Conviction. Councilperson Samuel thanked the Police Officers present.
Councilperson Samuel then made the motion to pass Ordinance No. 2008-OR-15 on the
first reading, second by Councilperson Sellers. Councilperson Fetz asked if City Court
Judge Pearce has been asked to provide user fees for this fund. Councilperson Samuel
said Judge Pearce felt it would be a conflict, but did coordinate a meeting with Judge
Fleece for Thursday. The motion passed on a vote of 7-0.

Couneilperson Fetz made the motion for a recess at 825 P.M., second by
Couneilperson Zastawny, passing on a vote of 7-0.
Mayor Galligan called the meeting back to order at 8:27 P.M.
Couneilperson Wilson introduced and explained Resolution No. 2008-R-11,
Resolution Requesting The Ciry Of Jeffersonville Apply For The Designation As A
Preserve America Community. Couneilperson Wilson made the motion to pass
Resolution No. 2008-R-11, second by Couneilperson Grooms. Couneilperson Grooms
asked that Executive Assistant Young or Communications Director Thomas check for
grants relative to this Resolution. The motion to pass Resolution No. 2008-R-11 passed
on a vote of 7-0.
Couneilperson Sellers explained changes to Ordinance No. 2008-OR-16, An
Ordinance Amending Ordinance 2007-OR-001 And An Ordinance Amending Ordinance
97-OR-73 And Repealing Ordinance 97-OR-74. Couneilperson Sellers then made the
motion to pass Ordinance No. 2008-OR-16 on the first reading, second by Couneilperson
%astawny, passing on a vote of 7-0.
CLERK TREASURER COMMENTS:
Deputy Clerk 'treasurer Patti Smith said the first Southern Indiana Special
Olympics Polar Plunge was a big success. Deputy Smith thanked Mayor Galligan for
attending, The Police F.O.P. for [he donation of $1,000, the Fire Department for plunging
and raising over $500, and Judge Ken Peazce for plunging. The group was told not to
expect more than 40 plungers or to raise more than $4,000. A record was broken with
128 plungers, and raising more than $33,000.
COMMITTEE REPORTS, COUNCIL AND MAYOR COMMENTS:
Councilpcrson Samuel introduced a group of Jeffersonville High School
government class students in attendance. Mayor Galligan suggested the swden[ take the
agenda to class and review.
Councilpcrson Grooms called attention to Jeff High Student Sara who he works
with and Erin Stewart. Couneilperson Grooms announced a Finance Committee meeting
Cor Friday at 1:30 P.M. Couneilperson Grooms, Smith, and Samuel will meet with
Mayor Galligan and some Department Heads regazding a potential shortfall of about
$800,000. They will be looking at serious budget restraints.

Councilperson Sellers announced a [ravel committee meeting that would be held
Friday at 10:30 A. M.
Councilperson Fetz announced the passage of the Parks Boazd restructuring
Ordinance. He feels this is a huge step forward.
Councilperson Zastawny requested Jorge Lanz to attend the next workshop
regarding Veterans Pazkway. Councilperson Zastawny noted the top 20 vendor list He
reminded Mayor Galligan about the calculation of the City street miles.
Mayor Galligan had an excellent meeting with representatives of Greater Clark
County Schools. It was a breath of fresh air, as working with the City was openly
embraced. 'they will meet monthly. He commends the school corporation for getting
involved in the community. Mayor Galligan said one of [he retreat goals was to have a
first class Park System. Funding is always a dilemma. The Remnant Trust is an asset
that needs to be showcased.
As there was no fiu-ther business to come before [he Council, the meeting was
adjourned 8:55 P.M. -
