HomeMy WebLinkAbout01-28-2008COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA January 28, 2008 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 7:30 P.M. on Monday January 28, 2008. Council President Fd Zastawny, with Clerk Treasurer Peggy Wilder at the desk, called the meeting to order. Also present were City Attomey Darren Wilder, City Council Attomey Larry Wilder, and Deputy Clerk Treasurer Barbara Hollis. Council President Zastawny welcomed all in attendance, asking al] those present to stand as Councilperson Samuel gave the invocation. Council President Zastawny [hen asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were; Cwncilpersons Mike Smith, Ed Zastawny, Keith Fetz, Connie Sellers, Barbara Wilsoq Nathan Samuel, and Ron Grooms. Absent: Mayor Galligan. Following discussion, Councilperson Grooms made the motion to approve the agenda with the addition of #LOA, Eric Hedrick, second by Councilperson Samuel, passing on a vote of 7-0. Council President Zastawny presented the minutes for approval. Councilperson Wilson made the motion to approve the minutes of December 10, 2007 (5:30 P.M.) meeting as presented, second by Councilperson Sellers, passing on a vote of 7-0. Councilperson Wilson made the motion to approve [he minutes of December 21, 2007 (4:30 P.M.), second by Councilperson Grooms, passing on a vote of 7-0. Councilperson Wilson made the motion to approve the minutes of December 26, 2007 (4:30 P.M.), second by Councilperson Samuel, passing on a vote of 7-0. Councilperson Wilson made the motion to approve the minutes of January 7, 2008 (7:30 P.M J, following clarification of the first complete sentence on page 2, second by Councilperson Samuel, passing on a vote of 7-0. Clerk Treasurer Wilder presented the claim list for consideration by the Council, explaining one additional claim to Mathis Solutions for the Laserfiehe eonhaet. Service January 28, 2008 2 will be discontinued February 1, 2008 unless payment is received. Council Attorney Wilder has recommended the Council not approve additional claims without declaring an emergency. Following discussion Councilperson Samuel made the motion to consider the Mathis Solutions claim an emergency, second by Councilperson Smith, passing on a vote of 6-0-1. Councilperson Fetz abstained. Councilperson Smith then made the motion to approve the claims on the list as presented, along with the additional claim, second by Councilperson Grooms, passing on a vote of 6-0-1. Councilperson Fetz abstained. PUBLIC COMMENT: Mr. Gregory Clark, Attorney with the firm of Smith, Carpenter, Fondresi, anTbompson, presented the Council with a contract [o serve as Drainage Board AC[omey. Discussion followed regarding the firm representation of Clark Memorial Hospital. Following discussion, Councilperson Fetz made the motion to approve the contract with the waiver of potential conflict of interest, second by Councilperson Wilson, passing on a vote oC 7-0. Mr. Mike Moore has met with Park Director Bob Manor and Assistant Park Director Ricky Romans regarding the contract with Meijer Inc. for the naming of the field that expired in 2006. Meijer Inc. has offered to pay $3,000 for the field naming rights. Mr. Moore would like to have the blessing of the Council to seek sponsorship for the field. He believes this is a quality of life issue. Following discussion, Councilperson Smith made the motion to give Mike Moore the Council support [o solicit sponsorship for the field, second by Councilperson Wilson. Councilperson Grooms would like to have Director Manor go with Mr. Moore. Councilperson Samuel noted there are other fields. The motion passed on a vote of 7-0. Mr. Charlie Milburn, 22 Linden Road, suggested the City look at cutting the 23% to 24% raises given as a way to wt spending. He would like the Counei] [o reconsider annexation. Mr. Derek Spence, representing the Franklin Commons Neighborhood Association, asked about the plans for Colston Park. There is a fear of losing the Park. 'The green space is needed. Mc Spence thanked the Council for the donation to the Association displaying one of the banners that was purchased. COUNCIL COMMENT: January 28, 2008 3 There was no Council comment. DEPARTMENT HEAD REPORTS: There were no Department Head reports. AGENDA ITEMS: Mr. Eric Hedrick, Jeffersonville Fire Department Union President, explained a program the Union is sponsoring called "Red Shirt Fridays". The red shirts will be wotn in support of the troops. Red shirts were presented to the Council. A photo will be taken at the new firehouse on Friday to kick off the program. Firefighter Hedrick explained the Department would have a team for the "Polar Plunge", asking for the Council to participate. Councilperson Smith made the motion to appoint Carol Moon and Rick Madden to the Drainage Boazd, second by Councilperson Samuel, passing on a vote of 7-0. Clerk Treasurer Wilder presented Resolution No. 2005-R-6, A Resolution Encouraging And Supporting The Acquisition And Development Of Vacant, Abandoned, Unsafe, And/Or Underutilized Properties, for ratification. Councilperson Grooms made the motion that Resolution No. 2005-R-6 be ratified, second by Councilperson Fetz, passing on a vote of 7-0. Councilperson Grooms explained the need for passage of Ordinance No. 2008- OR-S, An Ordinance Of Additional Appropriation (EDIT Fund -Portable Restrooms). Councilperson Grooms made the motion [o pass Ordinance No. 2008-OR-5 on the first and second readings, second by Councilperson Sellers, passing on a vote of 7-0. Councilperson Fetz made the motion to delete the Resolution To Advertise For Additional Appropriation - Probation User Fund from the agenda, second by Councilperson Wilson, passing on a vote of 7-0. Clerk Treasurer Wilder explained the need for passage of Ordinance No. 2008- OR-6, An Ordinance Transferring Certain Funds Within Same Department (Department of Law). Councilperson Grooms made the motion to pass Ordinance No. 2008-OR-6 on the first reading, second by Councilperson Petz, passing on a vote of 7-0. CLERK TREASURER COMMENTS: Clerk Treasurer Wilder presented the list of the top 20 wages for 2007, asking for clarification of vendors to include on the list of the top 20 vendors. January 28, 2008 4 COMMITTEE REPORTS, COUNCIL AND MAYOR COMMENTS: Councilperson Samuel thanked the Council for providing funding for training. He attended ]ACT Boot Camp and recommends it to all newly elected. Councilperson Samuel noted the new firehouse is very impressive and has an awesome training room. There will be a recycling program at City Hall. There may be grant money available for a study of the Inner City Road expansion at Jeff Charlestown Pike. Councilperson Grooms would like to use the proceeds from the Sheriffs sale to offset the budget shortages. A Counci] photo will be taken Saturday, February 9, at 8:30 A.M. Councilperson Grooms would like to see a consolidated report of income and expenses. Clerk Treasurer Wilder noted reports are provided. She will take a look at developing an excel sheet. Councilperson Grooms reported the Charlestown Pike sidewalks should start this week. The February meetings will be February 4 and 25, 2008. Councilperson Grooms wishes Councilperson Wilson a Happy Birthday. He is happy to see Jeff High student Sperzel back. Thank you to Officer Grimes for attending the meeting. Councilperson Wilson thanked all for the kind remazks. Councilperson Petz asked Firefighter Hedrick to comment regazding a Clarksville fire that occurred over the weekend. Firefighter Hedrick said four dogs were in the house. One survived and the Jeffersonville Firefighter's Union is paying the veterinary bills. Councilperson Smith thanked the Council for their support in moving the historic home. He has heard the same comments about Colston Park. He hopes the City will obtain Rose Hill School.
