A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA, URGING PROMPT LEGISLATIVE ACTION TO PROHIBIT THE SALE OF EPHEDR..!NE-BASED PRODUCTS WITHOUT A PRESCRIPTION AND THE VOLUNTARY REMOVAL OF THESE PRODUCTS FROM STORE SHELVES WHEREAS, ephedrine is an adrenalin-like chemical that stimulates the heart and central nervous system; and WHEREAS, ephedrine was once used to treat asthma, but has been replaced by more effective medicines; and WHEREAS, ephedrine is used in the manufacture of diet pills, such as Mini Thin, and other products such as Herbal Ecstasy and Ultimate Xphoria, which are advertised as providing a "natural High" or increased energy and endurance; and WHEREAS, use of these ephedrine-based products can result in insomnia, anxiety, respiratory difficulty, irregular heartbeat, and seizures; and WHEREAS, there have been reports of more than 600 injuries and 17 deaths associated with ephedrine-based products; and WHEREAS, these ephedrine-based products can be bought by children over the counter in convenience stores, mini marts, and service stations; and WHEREAS, there is increasing evidence that our middle-school children are purchasing these products, abusing them, and in many cases selling them to schoolmates for a profit; and WHEREAS, there is increasing evidence that these ephedrine-based products are becoming "a gateway drug" for our middle school children; and WHEREAS, the United States Food and Drug Administration (FDA) is considering whether to tighten regulation of these ephedrine-based products; and WHEREAS, the FDA has, according to recent news reports, stated that products with high doses of ephedrine are "street drug alternatives"; and .. WHEREAS, many states have taken action to ban the sale of, or require a prescription for these ephedrine-based products. NOW, THEREFORE, IT IS HEREBY RESOLVED that the Common Council of the City of Jeffersonville, Indiana, as follows: .SECTION I: The Common Council of the City of Jeffersonville, Indiana, urges the Indiana General Assembly to promptly take action to prohibit the sale of these ephedrine-based products without a prescription. SECTION I1: The Common Council requests retail outlets in the City of Jeffersonville to voluntarily remove these ephedrine-based products from public sale pending action by the Indiana General Assembly. SECTION II1: The Common Council requests that the City Clerk forward a copy of this resolution to .the Indiana General Assembly and to_all who hold a R~ etait. Merchants Lk:er~se in_the :_ ........ City of Jeffersonville. SECTION IV: This Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor. Section III request that I, as City Clerk and Treasurer, forward a copy to the Indiana General Assembly. Representative Jim Bottorff has offered to see that the members of the House are aware of the Resolution.
