A RESOLUTION CREATING THE CITY OF JEFFERSONVII.LE INSURANCE COMNIITTEE
WHEREAS, IC 36-1-2.6(3) designates the Common Council of the City of Jeffersonville as the Fiscal Body of said city, and
WHEREAS, IC 36-1-2-9(3) designates the Common Council of the City of Jeffersonville as the Legislative Body of said city, and
WHEREAS, IC 36-1-3-3 states that if there is any doubt as to the existence of a power of a unit, the resolution shall be that this
power exists, and
WHEREAS, IC 36-1-3-4 states that a unit has all other powers necessary or desirable in the conduct of its affairs, even though not
granted by statute, and
WHEREAS, IC 36-4-6-18 grants the legislative body of a city, through the passage of ordinanoes, orders, resolutions, and motions
the authority to control the city's property and finances, and
WHEREAS, insurance costs are the greatest fixed costs for the City of Jeffersonville after salaries of employees, and
WHEREAS, The Common Council of the City of Jeffersonville now wishes to create the CITY OF JEFFERSONVILLE
INSURANCE COMIVIITTEE
NOW, THEREFORE, LET IT BE RESOLVED BY THE COMMON COUNCII, OF THE CITY OF JEFFERSONVILLE
SECTION 1 The City of Jeffersonville Insurance Committee is hereby created for the purpose of gathering
information about all insurance coverage for the City of Jeffersonville and advising the Purchasing
Agent for the City of Jeffersonville as to the best insurance product for said city.
SECTION 2 The City of Jeffersonville Insurance Committee shall have five (5) members. The Common Council of the City of
Jeffersomrille shall appoint three members. Said three Common Council appoinctees maybe Council members. The
Mayor shall appoint one member, and the Clerk Treasurer shall appoint one member. The members shall serve until
they are replaced by the appointing entity. The appointing authority may replace their appointment(s) at arty time.
SECTION 3 Any existing prdinance, resolution, or section(s) of existing ordinances or resolutions that are in conflict with this
resolution are hereby repealed.
This resolution shall be deemed adopted after passage by the Common Council of the City of Jeffersonville and approval by
the Mayor of the City of Jeffersonville, or the timely override of his veto. This resolution shall be in full force and effect as of
January 1, 2008.

The Jeffersonville Common Council of the City of Jeffersonville, Indiana,
meeting in Special Session on December 31, 2007 at 10:00 a.m.
moves to override the veto by the Mayor of the City of Jeffersonville, Indiana of
Resolution 2007-R-43
"A Resolution Creating the Jeffersonville Insurance committee".

A RESOLUTION CREATING THE JEFFERSONVILLE
INSURANCE COMMITTEE
STATEMENT OF REASONS
Comes now Robert L. Waiz, Jr., Mayor for the City of Jeffersonville, Indiana, and hereby
vetoes Resolution No. 2007-R-43 ("A Resolution Creating the Jeffersonville Insurance
Committee"), and in support states the following:
1. The Clerk-Treasurer does not have the legal authority to act as the city purchasing
agent for the city; and
2. The purchasing agent does not have authority to enter into personal services contracts
such as health insurance.
