MINUTES OF THE BOARD OF PUBLIC WORKS AND SAFETY
OF THE CITY OF JEFFERSONVILLE, INDIANA
OCTOBER 24, 2007
,In Mayor Waiz's absence, Engineer Miller called the meeting to order at 9:30 a.m. and on call of the roll
',those members present were: Fire Chief Miles and Councilperson Perkins.
',Also present were: Asst. Police Chief Lovan, Animal Shelter .Director Wilder, Vehicle Maintenance
',Director Drury, Building Commissioner Segraves, Personnel Director Calabro, IT Director Hardy,
Street Commissioner Ellis, City Attorney Merkley, Planning and Zoning Director Hicks, and Deputy
Clerk Mayfield.
..'Councilperson Perkins made the motion to approve the payroll as presented, seconded by Fire
',Chief Miles and carried unanimously.

'Councilperson Perkins made the motion to approve the minutes of 10-17-07, seconded by
Fire Chief Miles and carried unanimously.
OLD BUSINESS
;REQUEST TO MAKE ALLEY ONE WAY
''Councilperson Perkins made the motion to deny making the alley between Market and
Chestnut Streets one way, seconded by Fire .Chief Miles and carried unanimously. The board
agreed to put up "children at play" and "5 mph" signs.
NEW BUSINESS
FIRE STATION UPDATE
Heather Graninger gave an update on progress made at the Fire Stations and City Services
Complex. She-also gave a summary of pricing for additional work for review. After some
~! discussion, Fire Chief Miles made the motion to table for further review, seconded by
!, Councilperson Perkins and carried unanimously.
COLGATE SK RACE
Rachel Carlock asked the Board's approval to hold. the Colgate SK Race on June 7, 2008.
Councilperson Perkins made the motion to approve the request, seconded by Fire Chief Miles
and carried unanimously.
VETERANS DAY CELEBRATION
Don Herrold asked approval to have a celebration in the parking lot of the Quadrangle in
honor of veterans on Saturday, November 10, 2007. Engineer Miller said we would need to
talk to Sun Properties for approval also. Councilperson Perkins made the motion to table this
for one week, seconded by Fire Chief Miles and carried unanimously.
UNSAFE BUILDING AT 129-131 E. CHESTNUT ST.
Building Commissioner Segraves told the Board a letter was sent to Howard M. Nelson of
732 Southwestern Parkway on September 14,.2007 regarding his property at 129-131 E.
Chestnut Street. The deficiencies include: faulty wiring, blocked exits, improper storage of
flammable liquids, exterior maintenance issues, no hardwired smoke detectors, and
unacceptable housekeeping conditions. Segraves said he met with Mr. Nelson on October 12,
2007 in regard to the violation and Mr. Nelson .said he would get started on the repairs. As of
today there have been no corrections or repairs that Building Commissioner Segraves is
aware of. Mr. Nelson appeared before the Board. He said he just recently found out about
this and that he also has a violation from the Board of Health. He said he went to the
property to take care of the repairs and he was threatened and ejected from the building. He
said he has had no access to the building.. He has a partial estimate for repair work but can't
get into the building. He has filed eviction notices on both tenants for non-payment of rent.
Bldg. Commissioner Segraves said the electrical inspector said most of the problems are
electrical and is dangerous to the tenants as well as a fire hazard. Councilperson Perkins said
he has. observed many of the violations and believes the building is unsafe for human
habitation at this time. Fire Chief Miles said the building needs to be vacated soon. Mr.
Nelson said if he could get in the building he could fix it. Tenant Christopher Copeland said
he had hopes of fixing up the property but realized after moving in that it was uninhabitable
and is searching for another place to live. Mr. Copeland said Mr. Nelson had come into the
building at unreasonable times of the day or night and that is when he was threatened and
ejected from the building. He said he made Mr. Nelson aware that the Fire Marshall was
contacted and Mr. Nelson attempted to fix some of the wiring but not to their satisfaction.
Mr. Copeland said he is having trouble finding other living arrangements. Fire Chief Miles
recommended that the tenants contact the Red Cross or the Township Trustee for other
housing. Mike McCutcheon with the Jeff Fire Department said he met Mr. Nelson and was
told several things would be taken care of as well as debris removed but has seen no intent to
take care of these problems. After more discussion, Councilperson Perkins made the motion
to give 48 hours for the tenants to vacate the premises and remain vacated until the Building

Commissioner deems the building habitable, seconded by Fire Chief Miles and carried
unanimously. Perkins said if things aren't resolved quickly he will move to have the building
condemned.
CLARIFICATION OF SENIORITY FOR FIRE DEPARTMENT
Fire Chief Miles told the Board that there needs to be resolution to a 19 year old seniority
clarification regarding David Deark and Sanders Cooper. Mr. Deark presented a letter from
the Pension Board stating that he was accepted by them first giving him seniority over Mr.
Cooper. Mr. Deark finished his testing and was ready to begin work but had to wait three
weeks for Sanders Cooper to take..his test. They began work on the same day. Councilperson
Perkins made the motion to approve the seniority of David Deark, seconded by Fire Chief
Miles and carried unanimously.
There being no further discussion to come before the Board, Councilperson Perkins made the
motion to adjourn the meeting at 10:30 a.m., seconded by Fire Chief Miles and carried
unanimously.
