HomeMy WebLinkAbout2007-OR-43J 2007-OR- ~~ STATE OF INDIANA PLAN COMMISSION RECOMMENDATION TO JEFFERSONVILLE COMMON COUNCIL TO AMEND PORTIONS OF THE JEFFERSONVILL ZONING ORDINANCE 2000-OR-61 WHEREAS, the Jeffersonville Plan Commission has reviewed proposed changes to the Jeffersonville Zoning Ordinance as it pertains to amending the Zoning Ordinance to create an Agriculture Zoning District; and WHEREAS, the Planning Director has recommended such changes; and WHEREAS, the changes are more consistent with the City's Comprehensive Plan; and WHEREAS, the Plan Commission has held a public hearing on July 31, 2007 in accordance with LC. 36-7-4-604; and WHEREAS, notice was properly given to the public prior to the public hearing being held; and WHEREAS, the Plan Commission unanimously believes that the proposed changes should be made and that the proposed changes are in the interests of the public health, safety, comfort, convenience, morals, and general welfare; NOW, THEREFORE, BE IT RECOMMENDED by the Jeffersonville Plan Commission to the Common Council of the City of Jeffersonville, Indiana, that the following amendments and changes be made to the Jeffersonville Zoning Ordinance 2000-OR-61 to establish an Agriculture Zoning District: "A1" Zoning District 3.1 "A1"District Intent, Permitted Uses, and Special Exception Uses. 1. District Intent The "A1" (Agricultural Zone) District is intended to be used as follows: a. Use Type and Intensity -Agricultural operations b. Application of District -Existing agricultural land c. Development Standards-Recognize the need for strict development standards to maximize protection d. Jeffersonville's Plan Commission and Board of Zoning Appeals should strive to protect this District from conflicting land uses, and non-family oriented agricultural operations, as well as encroachment from single-family residential development. e. The Plan Commission and Board of Zoning Appeals should strive to promote an average net density of 1 to 2 dwelling units per acre community-wide in the "A1" District. 2. Permitted Uses Agricultural Uses- Agricultural crop production a. Farmstead b. Greenhouse c. Nursery d. Orchard e. Raising of farm animals* f. Sale of Agricultural products g. Stable, private 2 h. Storage of agricultural products i. Tree Farm j. Vineyard k. Wild animal population control Commercial Uses a. Farmer's Market b. Plant Nursery c. Stable, small commercial d. Stable, large commercial e. Winery Institutional Uses a. Church, temple, or mosque Residential Uses a. Dwelling, single family b. Bed and Breakfast 2. Special Exception Uses Agricultural Uses a. Processing of agricultural products Commercial Uses a. Kennel b. Gun clubs, skeet shoots, or target ranges 3 c. Barber/beauty shop (home occupation) Business: Recreation a. Golf course b. Paintball facility (outdoor) Institutional/Public Facilities a. Public Park/Recreation Center b. Cemetery/Mausoleum Communication/Utility a. Public Well b. Telecommunication Facility Miscellaneous a. Artificial lake or pond over one (1) acre in size * Does not include Concentrated Animal Feeding Operations (CAFO's) or Confined Feedings Operations (CFO's) 3.2 "A1" District Development Standards a. Minimum Lot Area: 5 acres b. Minimum Lot Width: 160 feet c. Minimum Lot Frontage: 100 feet d. Sewer and Water: Does not require municipal sewer and hookup e. Maximum Structure Height: Primary Structure: 40 feet; Agricultural-related accessory structures are exempt 4 f. Minimum Front Setback: 70 feet g. Minimum Side Setback: Primary Structure-30 feet; Accessory Structure-10 feet (<1000 square feet); Accessory Structure-30 feet (> 1000 square feet) h. Minimum Rear Setback: Primary Structure-30 feet; Accessory Structure-15 feet i. Maximum Impervious Surface Coverage: 25% of the Lot Area j. Minimum Dwelling Size: 1,500 square feet For Additional Development Standards that Apply: See Zoning Code Page 3-2. This recommendation is being made upon a unanimous vote of the members of the Jeffersonville Plan Commission by vote taken at its regularly scheduled meeting on the 31tit day of July 2007.
