ORDINANCE 2007-0R-50
AN ORDINANCE TO REGULATE THE USE OF
LEGAL FIREWORKS WITHIN THE CITY OF JEFFERSONVILLE
WHEREAS, IC 36-1-2-9(3) designates the Common Council of the City of Jeffersonville as the Legislative Body of said city, and

WHE1mAS, Ie 36-1-3-3 states that if there is any doubt as to the existence of a power of a unit, the resolution shall be that this
power exists, and
WHE;REAS, IC 36-1-3-4 states that a unit has all other powers necessary or desirable in the conduct of its affairs, even though not
granted by statute, and
WHE;REAS, IC 36-4-6-18 grants the legislative body of a city, through the passage of ordinances, orders, resolutions, and motions
the authority to control the city's property and finances, and
WHEREAS, The Conunon ColUlci1 of the City ofJeffeoonville now wishes to regulate the use oflegal fireworks within the City of

N~W, mEREFORE, LET IT BE ORDAINED BY THE COMMON COUNCn.,OF mECITY OF JEFFERSONVILLE
SECtION 1 Legal fireworks may only be discharged within the City of Jeffersonville between the hours of 5:00 p.m. and two hours
after sunset on JlUle 29, June 30, July 1, July 2, July 3, July 5, July 6, July 7; July 8, July 9, between the hours oflO:OO
am and 12:00 midnight on July 4, and between the hours of 10:00 a.m on December 31 and 1:00 a.m on January 1.
The event "ThlUlder Over Louisville" is exempt from this ordinance. The Jeffersonville Board of Works and Safety
may also grant permission to use legal fireworks at special events.
SEC'fION 2 Violators of the time provisions of this ordinance shall be issued a citation and cited into Jeffersonville City Court and
be fined no less than fifty dollars ($50.00) and no more than two hundred fifty dollars ($250.00).
This ordinance shall be deemed adopted and in effect after passage by the Common Council of the City of Jeffersonville,
approval by the Mayor of the City of Jeffersonvil / r the timely override of his veto, and has been legally advertised..
