AN ORDINANCE REGULATING USE OF PUBLIC PARKS
WHEREAS, the City of Jeffersonville, Indiana (the "City") operates
numerous public parks for the benefit of its citizens; and
WHEREAS, none of the City's parks are equipped with facilities
necessary for safe and sanitary overnight camping; and
WHEREAS, some of the City's parks, notably Vissing Park, are
equipped with facilities for outdoor cooking, but most are not so equipped;
and
WHEREAS, overnight camping in a park that is not equipped with
suitable shower and restroom facilities poses potential safety and health
hazards to both those camping overnight and to other citizens who use the
City parks during daytime hours; and
WHEREAS, the City police department is without sufficient manpower
to provide the heightened security necessary to protect outdoor campers from
becoming the victims of thefts and other crimes against their person and
property while they are sleeping; and
WHEREAS, outdoor cooking without suitable facilities poses potential
safety and health hazards to persons cooking as well as to persons in the
general vacinity of the person(s) cooking, including the danger of burns and
injuries from explosions; and
WHEREAS, the City wants to afford all its citizens the ability to enjoy
its public parks without being subject to the fear of suffering injury from such
safety and health hazards;
NOW, THEIlF. FORE, IT IS HEREBY ORDAINED as follows:
All City parks are closed to the public from 12 o'clock A.M. until 5
o'clock A.M., except to travelers passing over and along the public
rights-of-way contained within the boundaries of the parks.
Only cooking facilities the City provides may be utilized for outdoor
cooking in City parks.
Anyone wishing to 1) utilize a City park between the hours of 12
o'clock A.M. and 5 o'clock A.M., or 2) cook in a City park with
cooking facilities other than those provided by the City, must first apply
for a permit for the requested activity from the Jeff~rsonville Board of
Public Works and Safety (the "Board"). The Board may not issue such
a permit for any period longer that three (3) consecutive days.
A permit to allow cooking in a City park with cooking facilities other
than those provided by the City may only be issued after certification by
the Jeffersonville Fire Marshall that (s)he has inspected the cooking
facilities the applicant proposes to use aud that the facilities do not pose
an unreasonable safety or health hazard.
An applicant for a permit allowed under paragraph 3, above, must pay
to the Jeffersonville Clerk-Treasurer a permit fee of $25.00 prior to
receiving the permit.
This Ordinance shall be in full force and effect ti'om and after its
passage and approval.
