WHERAS, the Housing Authority has received funding f~om the U.S. Department of Housing and Urban Development (hereinafter "HUD"), for use in securing police investigative services in the Housing Authority's family housing developments Lnown as Greenwood, Northt0wn Terrace, and Fulton Terrace; and i:' WHEREAS, the Police Dept. has numerous employees, who, through their education and experience, possess the requisite skills to effectively Provide investigative services at all of the Housing Authority's family housing developments; and WHEREAS, the Housing ,Authority wants to engage the services of Police Dept. smployees pursuant to the authority vested in the Housing Authority by HUD. NOW, THEREFORE, for the reasons set forth above, and in consideration of the mutual covenants and promises of the parties hereto, the Housing Authority and the Police Dept. agree as follows: 1. The Housing Authority may employ a police officer employed by the Pokc Dept. as an independent agent for the purposes stated herein. The Ho~sing Authority is solely responsible for choosing the particular police officer it wishes to hire for the purposes stated herein. is subject, 2. This agreement and the employment of a police officer hereunder ' ' generally, to: 1) all applicable City of Jeffersonville ordinances, 2) all applicable Indiar~a statutes, 3) the rules, regulations and policies of the Jeffcrsonville Board of Public Works and Satkty and the Police Dept., 4) applicable Federal statutes, 5) the rules and regulations of HUD and the Housing Authority. 2 Serv;,ces provided by the Police Dept: The Pol-'ce Dept. agrees that the services rendered by its police officer :,mder this contract is in addkion to baseline police services and o'ther : ervices provided under prior co~tracts between the Police Dept, and the ;qousing Authority. The Police Dept. agrees k will not reduce its currer~,t level of baseline police services to the public housing dev~lopmcnts, particularly in the areas cf community policing, patrol, criminal investigations, records, dispatch and special operations. The duties required of the police officer employed hereunder will be rendered at the Greenwood, Northtown Terrace, and/ur Fulton Terrace Housing Developments in Jeffersonville, Indiana, and at such other place or places as the Housing Aut~,orky in good faith requkes as the interest and needs of the Housing Authority require. The Police Dept. will provide supervision, control and dkection of work activities and assignments of police personnel, including disciplinary actions. It is expressly understood that the Police Dept. will be responsible for any injury to the officer, his/her property, or the Police Dept.' s property while on the Housing Authority's property. 4. Services provided by the Housing Authority: The Housing Authority will provide the police officer orientation and a. familiarization with the public housing cormmnnities and with Housing Authority rules and regutatio~s. b. The Housing Authority will provide the Police Dept. with public housing police activity forms for the Police officer to use in the provision ofdaity workload data. These forms ar~: rtot intended to replace the Police Dept.'s standard police report forms. 5. The Police Dept. and the Housing Authority agree to regularly evaluate the services performed unde~ this contract and thek short-term and long-term effects. 6. This Agreement shall terminate thirty (30) days after either party's receipt of written notice of termination from the other party. 7. The Housing Authority will pay to the police officer whose services are provided pursuant to this contract, in full payment for said officer's services hereunder, compensa;:ion equal to that officer's overtime rate as a minimum Ln accordance with the Fak Labor Standards Act, which compensation may not exceed Thirty-two Dollars ($32.00) per hour. This compensation is payable upon submission of a written claim and approval of said claim by the Housing Authority. Tl~e police officer whose services are provided through the Police Dept. pursuant to this contract will not be considered as having an employee status with the Housip. g Authorky, and his/her relationship to the Housing Authority is and wilt remain, during the periods of his/her employment services hereunder, that of independ, ent contractor- Nothing in this agreement may be construed to interfere with or otherwi.se affect the rendering of services by the police officer whose services are pro¥ided hereunder through the Police Dept. in accordance with l~is/her independent trod professional jadgement. The Police Dept. will require ~d:~at the police officer perform his/her services in a good and workmanlike maturer and in accordance with generally accepted law enforcement practices. No modification or waiver of this Agreement or of any covenant, condition or provision herein contained is valid ~nless in writing and duly executed by'the parties. 10. All Agreements and covenants herein are severable, and in the event a competent court holds any of them invalid, t.his contract will be interpreted as if such invalid Agreements or covenants were not contained hereba. 11. This written Agreement embodies the whole agreement between the parties and there are no inducements, promises, terms, conditions, or obligations made or entered into by either the Housing Authority, or the Police Dept. other than those contained herein.
