Comes now the City of Jeffersonville, Indiana, by the Mayor Jeffersonville,
Robert L. Waiz, Jr. (hereinafter called "City") and comes now Leslie D. Merkley
(hereinafter called "Merkley"), and agree as follows:
1. That Merkley shall be appointed as City Attorney to the City of
Jeffersonville and Director of the Department of Law, effective January 1, 2004.
2. That Merkley shall be paid a salary of $45,000.00 annually.
3. That Merkley shall be appointed as attorney for the Board of Public Works
as part o~his duties as City Attorney.
4. That Merkley shall be appointed as attorney for the Sanitary Sewer Board
as part of his duties as City Attorney.
5. That Merkle~' shall pafficipate in the health insurance or major medical
plan with the City.
6. That Merkley may hire and appoint deputy city attorneys, if so needed,
upon the approval of the City.
7. That Merkley shall participate as co-counsel with any and all other
attorneys hired by the City.
8. That Merkley's duties and responsibilities shall include attendance at the
respective Board Meetings including City Council meetings, research legal issues and
render legal opinions, and draft legal documents including ordinances and resolutions as
necessary. It is anticipated that Merkley will donate on average approximately 20 hours
per week for the legal work described herein.
9. That Merkley shall be paid an hourly rate of $100.00 per hour for any
work beyond the scope of his duties and responsibilities as described herein. The hourly
rate shall apply to involvement in litigation, negotiations, planning and zoning,
redevelopment, or other legal matters agreed by the parties.
10. That Merkley may participate in certain Bond issues and will be paid
pursuant to the reasonable and customary compensatory schedule concerning the same.
11. This contract shall terminate at the will of either party upon written notice.
