FOP CONTRACT
WHEREAS, o~ /Z --/,.¢" ,1998 the Common Council of the City of
Jeffersonville adopted Resolution No. 98-R-.~.¢,~ recognizing the Indiana
Fraternal Order of Police Labor Council, Inc. (the "FOP") as the bargaining agent
for the City's police officers; and
WHEREAS, the City of Jeffersonville (the "City") and the FOP have
negotiated a contract for calendar year 1998 (the "Contract"); and
WHEREAS, it is in the best interest of the citizens and taxpayers of the
City of Jeffersonville that the City enter into the Contract.
NOW, THEREFORE, IT IS HEREBY RESOLVED that Common Council
of the City of Jeffersonville does hereby adopt the provisions of the Contract
attached hereto a~ Exhibit A and incorporated by reference herein.

Agreement Between
City of Jeffersonville
And
Indiana Fraternal Order of Police Labor Council, Inc.
Effective
January 1, 1998 Through December 31, 1998
Preamble
It is the general purpose of this agreement to promote the mutual interest of the Civil City of Jeffersonville,
Indiana, and the Jeffersonville Professional Police Officers and to provide for the operation of the
Jeffersonville Police Department under methods which will further, to the fullest extent possible:
1) safety of the employees,
2) economy, and efficiency of operation,
3) elimination of waste,
4) realization of maximum quantity and quality of police services,
5) police discipline,
6) protection of citizens rights and property, and
7) preservation of the peace without interruption.
This agreement entered into by the Indiana Fraternal Order of Police Labor Council, Inc./Jeffersonville
Fraternal Order of Police Lodge #100 (the "FOP") and the Civil City of Jeffersonville, Indiana (the
"Employer~ and/or the "City"), is intended to assure sound and mutually beneficial working and economic
relationships between the parties concerning rates of pay, wages, and certain conditions of employment. The
term "employee" as used herein shall refer to any sworn full-time police officer, excluding the Chief of Police
and the Assistant Chief.
The parties to this agreement will cooperate fully to secure the advancement of the objectives as stated above.
ARTICLE 1.
RECOGNITION
The Employer hereby recognizes the FOP, and the officers of the Jeffersonville local F.O.P. lodge 100, as the
exclusive representatives of the sworn police officers in the employment of the City, the police officers who
have retired from employment with the City and their beneficiaries. The FOP is not the representative of
the Chief of Police or the Assistant Chief.
ARTICLE 2.
TERM OF AGREEMENT
This agreement is effective from January 1, 1998 through December 31, 1998. Both the FOP and the City
understand that the short term of this initial agreement allows both parties the opportunity to become
accustomed to the new agreement and to resume negotiations after one year to work out any flaws.
Commencing no later than October 1, 1998, the parties will commence negotiations to modify or amend
this agreement for 1999 and subsequent years.
If negotiations extend beyond the present expiration date of this agreement, the terms and provisions of this
agreement shall nonetheless remain in full force and effect until the parties enter into a new agreement.
By mutual agreement, expressed in writing and signed by both parties, the FOP and the City may re-
negotiate any article of this agreement during its term.

ARTICLE 3.
CITY'S RIGHTS AND RESPONSIBILITIES
The FOP recognizes the prerogative of the City, by and through its Board of Public Works and Safety (the
"Board"), to operate and manage the Jeffersonville Police Department affairs, in all respects, in accordance
with its responsibilities and powers of authority.
The Board has the fight to schedule overtime and work as required in the Police Department, consistent
with the requirements of municipal employment and public safety.
The Board reserves the right to discipline and discharge for just cause. The Board reserves the right to lay off
personnel for reasons of economic emergency consistent with I.C.36-8-4-11. The Board has the right to
determine reasonable schedules of work and to establish methods and processes by which such work is
performed.
ARTICLE 4. DISCRIMINATION ~
The Board may not discriminate against any employee for his/her activity in behalf of, or membership in,
the FOP. The Board may not discriminate against any employee because of race, sex, creed, religion, or
political affiliation.
ARTICLE 5.
DEDUCTION OF DUES
The City will implement a dues-deduction system, within thirty 00) days after receiving notification from
the President of the Jeffersonville FOP lodge that the FOP has determined there is a need for such a system.
If a dues-deduction system is implemented, the City must deduct dues semi-monthly from the pay of any
employee who requests such a deduction in writing. The Secretary-Treasurer of the Jeffersonville FOP
lodge must certify to the City the amount of the dues to be deducted. The City must remit the total amount
of the deductions to the Secretary-Treasurer of the Jeffersonville FOP lodge monthly.
ARTICLE 6. HOURS OF EMPLOYMENT
The regular work week schedule of an employee shall be:
A. Uniform Division on/off schedule: Four (4) days on duty and two (2) days off duty. If a uniform
officer is called in for duty on his/her off day, he/she will be paid his/her overtime rate of pay for the
hours worked. ~
The uniform division rotates shifts monthly.
Uniform Division shift schedules:
First Shift: 6:00 a.m. to 2:30 p.m.
Second Shift: 2:00 p.m. to 10:30 p.m.
Third Shift: 9:30 p.m. to 6:00 a.m.
Detective Division shift schedules:
Monday through Friday wkh flexible hours as established by the City.
The City may create another Detective Division shift.
Detective Division hours and schedules:
Detective Division regular workweek is Monday through Friday.
Detective Division regular work hours are set by the City.
ARTICLE 7.
MEAL PERIODS
The Board must allow Employees a forty-five (45) minute meal period Per shift. Employees must take their
meal period after the first hour and before the last hour of their shift when possible. Employees must stay in
radio contact during their meal period as they are subject to call out at any time.
ARTICLE 8. VACATION TIME
Vacation time accrues to employees based upon their years of service with the City as follows:
1-4 Years of Service
5-9 Years of Service
10 Years of Service
15 Years of Service
20 and More Years

258 Hours
Employees do not accrue vacation hours until the completion of one year. Vacation hours may not be
carried over to the next year without the Board's authorization.

ARTICLE 9.
HOLIDAYS AND HOLIDAY PAY
Employees receive a holiday for each of the holidays listed in the City's Code of Ordinances. The City also
pays employees fifty dollars ($50.00) for each of the holidays. Holiday payments for the previous six (6)
months are due the first pay period in June and December.
ARTICLE 10. LONGEVITY PAY
In addition to their normal salary, employees receive one percent (1%) of a first-class patrolman's pay for
each year of service, up to a maximum of twenty percent (20%). This amount is paid pro-rata each pay
period.
ARTICLE 11. CLOTHING ALLOWANCE
The City provides all uniforms and equipment during an employee's probationary year.
After the completion of their first year of employment, employees receive seven hundred fifty dollars
($750.00) per year as a clothing allowance.
One-half of the annual clothing allowance is paid the second pay period in June and the other one-half is paid
the second pay period in December.
ARTICLE 12.
OVERTIME COMPENSATION
The City must pay all employees at the rate of one and one-half their normal hourly rate for all hours
worked over their assigned schedules. The shift commander must approve overtime. The employee must
submit an overtime slip to the shift commander and must state the reason for overtime.
All leave time shall be counted as time worked for payroll purposes, i.e. vacation, sick time and holiday time.

ARTICLE 13.
SICK LEAVE
Sick leave shall be governed by $35.10 of the Jeffersonville Indiana Code of Ordinances that is in effect at the
time of the signing of this agreement or any subsequent amended version of said Ordinances. The parties to
this agreement will jointly approach the Jeffersonville Common Council in an effort to amend the current
ordinance to allow an employee to accrue up to a balance of fifty (50) unused working days of sick leave after
ten (10) years of employment with the City.
The parties further agree to jointly request the j'effersonville Common Council amend $35.10 of the Code of
Ordinances to allow an employee who is injured in the line of duty to take up to forty (40) working days of
sick leave per year in addition to all other sick leave benefits.
ARTICLE 14. PAY PERIODS

ARTICLE 15. COURT PAY
Employees are paid twenty-five dollars ($25.00) per month for court pay. Employees do not receive any
other additional compensation for time they are in court.

ARTICLE 17.
RETIRED OFFICERS' BENEFITS
An employee with twenty (20) or more years of service receives his/her badge and service weapon from the
City upon his/her retirement from active service. The retired employee is also presented with a retirement
badge and identification card.
ARTICLE 18. EMPLOYEE INSUR_~NCE
Section A. HEALTH INSURANCE
The City will provide each employee with health insurance benefits equivalent to the plans in effect on the
date of the signing of this contract. Employees shall each contribute monthly to the total cost of health
insurance premiums in accordance with the following schedule:

Section C. VISION INSURANCE
The City will provide each employee with vision insurance benefits equivalent to the plans in effect on the
date of the signing of this contract. The City will pay the cost of all vision benefits for both the employee
and his family.
Section D. Lll~E INSURANCE
The City will provide each employee with term life insurance with a death benefit of at least $50,000.00 at
no cost to the employee. Life insurance benefits shall be reduced by 35% at age 65 and 50% at age 70. Benefits
terminate upon retirement or separation.

ARTICLE 19. RETIREE INSURANCE
Section A. HEALTH INSURANCE
The City will provide each retired employee with the opportunity to receive health insurance benefits
equivalent to the plans in effect on the date of signing of this contract. The retired employee must contribute
monthly to the total cost of health insurance premium in accordance with the following schedule:

Section B. DENTAL INSURANCE
The City will provide each retired employee with the opportunity to receive dental insurance coverage
equivalent to the dental insurance plans in effect on the date of the signing of this contract. The City shall
contribute nothing toward the cost of retiree dental insurance.

ARTICLE 20.
RETIREE BENEFITS, 1925 FUND MEMBERS
The surviving spouse of an employee who retired under the 1925 Police Pension Fund shall receive 50% of
the annual salary of a 20-year first-class patrolman each year, payable on a monthly basis, for the balance of
the spouse's life.
ARTICLE 21.
SAVINGS CLAUSE
If any article or section of this agreement or any rider thereto should be held invalid, illegal or unenforceable
by operation of law or by any tribunal of competent jurisdiction, or if compliance with, or enforcement of,
any article or section should be restrained by such tribunal pending a final determination as to its validity or
legality, the remainder of this contract or any rider thereto, or the application of such article or section to
persons or circumstances other than those to which it has been held invalid or as to which compliance with
our enforcement of has been restrained, shall not be affected thereby.
It is the further intent of the parties that should any article or section of this agreement be held invalid,
illegal or unenforceable and inoperable, that section or article shall be renegotiated in an attempt to provide
validity, legality and operability or acceptability to such section or article.
ARTICLE 22. ENTIRE AGREEMENT/WAIVER
The agreement expressed herein in writing constitutes the entire agreement between the parties and no oral
statement may add to or supersede any of its provisions.
