HomeMy WebLinkAbout1998-R-11ARESOLUTION RATIFYING INAAP INTERLOCAL AGREEMENT WHEREAS, the U.S. Department of the Army has formally announced its intention to declare the Indiana Army Ammunition Plant ("INAAP") excess property; and WHEREAS, INAAP is an approximately eight thousand acre tract of land with its southern boundary within one mile of the northern corporate boundary of the City of Jeffersonville ("the City"); and WHEREAS, proper development of INAAP is essential to the growth and prosperity of the City; and WHEREAS, the Clark County Board of Commissioners have spent extensive amount of time and money in their efforts to encourage the Army to declare INAAP excess property; and WHEREAS, the corporate boundaries of the City of Charlestown are contiguous with the northern boundaries of INAAP; and WHEREAS, the eastern boundary of INAAP is within one mile of the corporate boundaries of the Town of Utica; and WHEREAS, the City believes that it is in the best interest of its citizens as well as the other citizens of Clark County, Indiana that INAAP be developed cooperatively by all of the incorporated areas of the county as well as the County Commissioners and the County Council; and WHEREAS, Mayor Thomas R. Galligan, along with the Mayors and Town Council Presidents of the other incorporated areas of the County as well as the County Commissioners and the County Council have negotiated an agreement through which INAAP can be developed by the INAAP Re-Use Authority, a five (5) member Board appointed by all of the Clark County municipalities in conjunction with the Clark County Commissioners and the Clark County Council; and WHEREAS, this agreement was reduced to writing on March 19, 1998 a copy of which is attached hereto as Exhibit A; and WHEREAS, the City Council believes that this Agreement is in the best interest of the citizens and taxpayers of the City of Jeffersonville, NOW, THEREFORE, IT IS HEREBY RESOLVED that Agreement dated March 19, 1998 by and between the Board of County Commissioners, the City of Jeffersonville, the City of Charlestown, the Town of Clarksville, the Town of Sellersburg, the Town of Borden, the Town of Utica, and the Clark County Council concerning transfer and administration of the Indiana Army Ammunition Plant is hereby ratified and approved in its entirety. Governor, State of Indiana 333 State Capitol Indianapolis, IN 46204 We are writing to confirm that this document is our Interlocal Agreement, signifying local unity and joint support for a transfer of property at the Indiana Army Ammunition Plant CINAAP"). We jointly ask your support for conveyance of the real estate and personal property that is not already a part of existing contracts, and in such amounts as you determine, to the INAAP Re-Use Authority ("the Authority"), a five-member board created under Indiana law by the county commissioners. The re-use statutes are the mechanisms we agree to use to develop INAAP. Normally the commissioners would appoint all five members of the Authority. We agree, instead, that Charlestown and Utica shall name one member to this body. Jeffersonville and Sellersburg shall name one member. The county commissioners shall name one member and a second member in conjunction with Borden. The County Council and Clarksville shall name the fifth member to the Authority. These appointments shall be effective April 15, 1998. This agreement shall be in effect for thirty (30) years from April I5, 1998, during which time the Commissioners will share these appointments, as above, and no municipality shall claim, or attempt, annexation ofanypartoflNAAP. The commissioners agree to rescind Resolution 4-1998. Weagreetojointlysupport 1999Indiana legislation that would (a) provide for special tax stares and rate authority for the INAAP development area, which includes the entire current base and shall not include any real estate beyond the boundaries of the base ("the area") and (b) address any amendments to the re-use statutes that may be needed for Clark 'County. If special taxing authority is granted, the elected leaders from the entities named above will negotiate the tax rate to be applicable in the area. We agree to jointly support the usage of tax increment financing ("TIF") for the area, inclusive of the entire conveyance made, even if in phases, through the Authority. We agree that, hereafter, no entity named above will individually attempt any contacts or negotiations with the current contractor, unless such contacts are authorized through the Authority. We confirm that this agreement shall be ratified at the next regular public meeting of each signer hereon. The Re-Use Authority shall develop procedures for development at INAAP, payment of expenses and sharing of possible additional revenues between the namedgoverrLments and other related agencies. It shall also address procedures concerning competition, incentives, pirating and other issues of interlocal concern. The county will primarily bear expenses through 1998, to the extent of available funding.
