HomeMy WebLinkAbout2005-R-2 2005-R- ~-~ RESOLUTION APPROVING A RESOLUTION APPROVING THE CONVEYANCE OF A PARCEL OF REAL ESTATE BY DEED (NACHAND FIELDHOUSE/BRIDGEPOINT ELEMENTARY) WHEREAS, on September 12, 2005, the Board of Parks and Recreation of the City of Jeffersonville approved the conveyance of the agreed upon property adjacent to the Nachand Fieldhouse on Court Avenue in Jeffersonville by deed subject to the completion of all legal steps necessary to effectuate said transfer; and WHEREAS, the Board of Public Works and Safety ("BPW") believes it is in the best interest of the citizens and taxpayers of Jeffersonville that the City exchange a parcel of property at Bridgepoint Elementary School to the Greater Clark School Corporation for a small amount of land located adjacent to the Nachand Fieldhouse on Court Avenue. NOW, THEREFORE, IT IS HEREBY RESOLVED that the Board of Public Works and Safety approves and adopts Resolution No. 2005- R-09-12-2 Approving the Conveyance of a Parcel of Real Estate by Deed (Nachand Fieldhouse/Bridgepoint Elementary). Robert~r City of Jeffersonville ]~9¢ dayof 2 BEFORE THE BOARD OF PARKS AND RECREATION CITY OF JEFFERSONVILLE STATE OF INDIANA Resolution No. 2005-R-~L%12-~2~ RESOLUTION APPROVING THE CONVEYANCE OF A PARCEL OF REAL ESTATE BY DEED (NACHAND FIELDHOUSE/BRIDGEPOINT ELEMENTARY) WHEREAS, it has been determined that the City of Jeffersonville has the need to acquire additional property located with the City of Jeffersonville for recreational purposes and that said property is currently owned by the Greater Clark County School Corporation; and WHEREAS, it has been determined that the Greater Clark County School Corporation has the need to acquire a parcel of land in or around Bridgepoint Elementary School to be used for school-related purposes and that said property is currently owned by the City of Jeffersonville by and through its Board of Parks and Recreation; and WHEREAS, it has been determined that it is in the best interest of the Grealer Clark County School Corporation to exchange a small amount of land located adjacent to the Nachand Fieldhouse on Court Avenue in the City of Jeffersonville that it is currently owned by the Greater Clark County School Corporation for the parcel of property at Bridgepoint Elementary'School that is owed by the City of Jeffersonville by and through its Parks and Recreation Department; and WHEREAS, in accordance with I.C. 36-I-11-8 the City of Jeffersonville throughs its Board of Parks and Recreation has the authority to transfer or exchange property with a governmental entity UPon terms and conditions agreed by the entities; and WHEREAS, Greater Clark has evidenced its agreement to transfer its property located at Nachand Fieldhouse by written notice to the Parks and Recreation Department; and WHEREAS, upon passage of this Resolution by the Board of Parks and Recreation, Greater Clark will affirm its intent to comply with this transfer of real estate by passage of a similar resolution by its Board of School Trustees at its meetings on the day of ,2005. NOW, THEREFORE, BE IT RESOLVED, that the Board of Parks and Recreation of the City of Jeffersonville, Indiana approves the conveyance of the agreed upon property adjacent to the Nachand Fieldhouse on Court Avenue in Jeffersonville by deed subject to the completion of ail legal steps necessary to effectuate said transfer. BE IT F-URTHER RESOLVED, that all expenses for the transfer of the land located adjacent to the Nachahd Fieldhosue to the City of Jeffersonville by and through its Parks and Recreation Department will be the responsibility of the City of Jeffersonville and that all expenses for the transfer of the land located adjacent to the Bridgepoint Elementary School to the Greater Clark School Corporation will be the responsibility of the Greater Clark School Corporation. BE IT FUTHER RESOLVED, the President and Secretary of the Board of Parks and Recreation are authorized to complete all documents necessary for the transfer as set out herein.
