HomeMy WebLinkAbout1998-R-01RESOLUTION NO. 98-R- A RESOLUTION CONDEMNING CERTAIN REAL PROPERTY PURSUANT TO INDIANA CODE 32-11-1.5 et. seq. WHEREAS, Forrest R. Harlow owns the following described real estate in the City of Jeffersonville: See Exhibit A; and WHEREAS, the Board of Public Works and Safety of the City of Jeffersonville ("the Board") has determined that the real estate described in Exhibit A, attached hereto and incorporated herein by reference, is needed for the use of the Jeffersonville Municipal Sewage Utility; and NOW THEREFORE, BE IT HEREBY RESOLVED that the Board hereby condemns and appropriates for the use of the Jeffersonville Municipal Sewage Utility ("the City") the real estate described in Exhibit A; and NOW THEREFORE, BE IT HEREBY FURTHER RESOLVED that the Clerk- Treasurer shall publish notice of this Resolution in the Evening News once each week for the next two (2) consecutive weeks; and NOW THEREFORE, BE IT HEREBY FURTHER RESOLVED that the Board shall receive and hear remonstrances from persons interest in or affected by this condemnation at its regularly-scheduled October 19, 1998 meeting. HARLOW A twenty five (25) foot wide permanent easement being described as part of Survey 4 of the Illinois Grant of Clark County, Indiana, being a part of the same 0.932 acre tract conveyed to Forrest R. Harlow at Deed Drawer 22, Instrument No. 4417 and bounded as follows: Beginning at a pipe in the northeasterly line of said Harlow Tract which marks the north corner of said tract, thence the following courses of the twenty five (25) foot wide permanent easement: South 35 deg. 50 min. 00 sec. East, 385.00 feet along said northeasterly line; South 54 deg. 10 min. 00 sec. West, 25.00 feet leaving said northeasterly line; ~ North 35 deg. 50 min. 00 sec. West, 385.00 feet running parallel with and 25 feet distant from said northeasterly line to the northwest line of said Harlow tract; North 54 deg. 10 min. 00 sec. East, 25.00 feet with said northwest line to the True Place of Beginning. AND a ten (10) foot wide Permanent Easement all along and adjacent to the t20.64 foot long north line of said Harlow tract described as follows: Beginning at the most easterly corner of said Harlow tract in the west line of Middle Road, thence the following courses of the ten (10) foot wide permanent easement: South 19 deg. 08 min. 00 sec. West, 10.01 feet with Hartow's southeasterly line which is said west line of Middle Road; North 72 deg. 50 min. 00 sec. West, 127.83 feet, more or less, parallel to and ten (10) feet distant from said 120.64 foot north line of Harlow to the southeast line of the above described twenty five (25) foot easement; North 54 deg. 10 min. 00 sec. East, 12.52 feet, more or less, with said easement line to a corner of Harlow's tract; South 72 deg. 50 min. 00 Rec. East, 120.64 feet with Harlow's north line to t.he True Place of Beginning. AND ALSO, a fifty (50) foot wide Temporary Construction Easement all along and adjacent to the southerly line of the twenty five (25) foot sewer, drainage and utility easement adjacent to the northerly line of said Harlow tract.
