WHEREAS, on June 1, 1999 the Board of Public Works and Safety of the City of Jeffersonville (the "Board") adopted a Resolution Condemning Certain Real Property Pursuant to Indiana Code 32-11-1.5 et seq. (the "Resolution") which real estate is more particularly described in Exhibit A, attached hereto and incorporated herein by reference; and WHEREAS, notice of the Resolution was published in the Evening News on June 4 and June 11, 1999 as required by Indiana Code 32-11-1.5-3(b); and WHEREAS, said notice stated that at its regular meeting on June 21, 1999 the Board would hear remonstrances from persons interested in or affected by the condemnation; and WHEREAS, Jean Kendall, Sonja Jackson and Joe Jackson, all persons interested in or affected by the condemnation, were heard to remonstrate with regard to the condemnation at the Board's regular meeting on May 24, 1999; and WHEREAS, the Board considered the remonstrances, but finds that none of the remonstrators stated a legally significant reason for their objection to the condemnation, and that the proposed condemnation is in the best interest of the residents of the Jeffersonville Municipal Sewer Utility district, and the citizens of the City of Jeffersonville, as it will provide significant improvement to wastewater treatment in the vicinity of Utica-Sellersburg Road, and will provide enhanced safety and accessibility to the travelling public using Utica-Sellersburg Road. NOW THEREFORE, BE IT HEREBY RESOLVED that the Board hereby confirms its original June 1, 1999 Resolution condemning and appropriating for the use of the City of Jeffersonville (the "City") the real estate described in Exhibit A, attached hereto and incorporated herein by reference; and NOW THEREFORE, BE IT HEREBY FURTHER RESOLVED that the Roadway, Sewer, Drainage and Utility Easement over the real estate described in Exhibit A is hereby conveyed to the City; and NOW THEREFORE, BE IT HEREBY FURTHER RESOLVED that the Clerk-Treasurer shall record a copy of this Confirm/rig Resolution in the office of the Recorder of Clark County, Indiana to memorialize the City's condemnation of the Roadway, Sewer, Drainage and Utility Easement over the real estate described in Exhibit A; and NOW THEREFORE, BE IT HEREBY FURTHER RESOLVED that the Board shall prompdy prepare a list of affected property owners, award damages sustained (or assess benefits accruing) to the property, and pay damages (or reduce excess benefits to a lien) on the affected property, all as required by Indiana Code 32- 11-1.5-1 e/seq.
