JEFFERSONVILLE, iNDIANA MONDAY, AUGUST 9, 1999
Mayor Tom Galligan called the meeting to order at 9:30 a.m., and on call of the roll those
members present were: City Engineer Bob Miller, and Sewage Office Manager Bob Goldman.
Also present were: Vehicle Maintenance Foreman Mike Ewton, Fire Chief Mike Smith,
Building Commissioner Lan'y Decker, Wastewater Treatment Plant Director Jim Traylor,
Personnel Director Jerralyn Ellis, Planning and Development Director Jana Ecker, Safety
Director Marvin Grant, Assistant Director of Redevelopment David Duggings, Parks
Superintendent Rick Elliott, Police Chief Mike Pavey, Grant Coordinator Kathy Hailer, City
Attorney Anne Made Galligan, and Clerk Suzy Bass.
City Engineer Miller made the motion to approve the minutes of August 2, 199 as presented,
seconded by Manager Goldman and carried unanimously.
Manager Goldman made the motion to approve the claims as presented, seconded by Engineer
Miller and carried unanimously.
STOP LIGHT ALISON AND MEADOWLARK
The motion was made by Manager Goldman to approve the installation of the stop ligh~ at
Allison Lane and Meadowlark by Metzger Electric, who had the lowest quote, seconded by
Engineer Miller and carded unanimously.
BID OPENiNG FOR UTICA-SELLERSBURG RD IMPROVEMENTS
Jorge Lanz, Jacobi, Tombs and Lanz, appeared before the Board with 4 bids received for the
Utica-Sellersburg Rd Improvement. The following bids were opened: K & I Construction with
a bid of $224,950.80, Koetter Construction bid was $181,178.60, Mac Construction bid was
$210,950.80, Dave O'Mara Contracting bid was $225,384.18. All bids were in proper form.
The motion was made by Manager Goldman to take all bids under advisement for one week
second by Engineer Miller and carried unanimously.
REQUEST TO MAKE GATEWAY PARKING LOT ONE-WAY
Director Ecker told the Board that Ken Nolan would like to make Gateway Plaza parking lot one
way around the lot. The Board informed Director Ecker that if he owns the lot, it is private
property and he does not need Board approval. She said that someone owns a portion of the lot
but he owns the majority of it. The Board said that the two owners would have to work with
each other.
TOWING SERVICE
Attorney Anne Renfro, representing Workman Towing, appeared before the Board with the
owners of Workman Towing, Richard Workman and Danny Wheeler. They would like to do
business with the City Police Department in regards to towing vehicles. They suggested a
rotation with other towing companies or a bidding process. Chief Pavey said that he is not for a
rotation because not every company has the same equipment. He would also have to let all local
towing companies in on the rotation. Cars would be towed to several different lots. For record
keeping, it is easier to go to one location. He is not against a bidding process if the that what the
Board desires but he would like to maintain one lot for the City. Chief Pavey also told the Board
that if the City ever gets it's own lot, he wouldn't care who towed it in, as long as all cars were
towed to the same place. Ms. Renfro informed the Board that if the City decided to bid this
service, her clients would definitely be interested in bidding.
CITATION TO PROPERTY OWNER
Commissioner Decker informed the Board that there are still transients using the property at 330
W. Market St. He sent a letter to the owner, John Rogers, on July 1, 1999 asking him to secure
the structure within 10 days. On 7-13-99 he still wasn't in compliance, so another letter was sent
and Mr. Rogers was cited to appear before the Board of Works. Commissioner Decker's office
also called him on this day and asked him for his cooperation. About two weeks ago, Mr. Rogers
asked Commissioner Decker what they were going to do about this problem. Commissioner
Decker told him that this was his problem. Mr. Rogers said that he has sealed the property but
transients are tearing off the boards and continuing to use the property. Attorney Galligan said
that this was Mr. Roger's problem and he needs to rectify it. After further discussion, the
motion was made by Manager Goldman to send notice to Mr. Rogers informing him that he has
15 days to secure the property or the City would secure the property, bill him accordingly and
fine him $500.00. The motion was seconded by Engineer Miller and passed unanimously.
REQUEST FOR ROAD CLOSING
St. Paul's Episcopal Church asked for approval to close Walnut St from Maple to Chestnut Street
September 12, 1999 from.12:00 noon to 3:00 P.M. for a church function. The motion was made
by Manager Goldman to approve this request seconded by Engineer Miller and carried
unanimously.
CONSTRUCTION ENGINEERING AGREEMENT
Attorney Galligan presented the Board with a Construction Engineering Agreement between the
City and Jacobi, Tombs, and Lanz. This agreement is on the Terrace Lawn Project, which is the
Jeffersonville Staging Area of the Greenway Project. This was recently approved by the Indiana
Department of Transportation. Everything in the agreement has already been approved by
INDOT according to the monies that are available through the grant in which the City matches
the funds 80-20, with the State paying 80% and the City paying 20%. The motion was made by
Manager Goldman to approve the Construction Engineering Agreement contract between the
City and Jacobi, Tombs, and Lanz for the Terrace Lawn Project seconded by Engineer Miller and
canied unanimously.
2000 HOLIDAYS
Attorney Galligan presented the Council with a list of holidays for 2000, which is attached. The
Commissioners have already approved these holidays. The motion was made by Engineer Miller
to approve the holidays, second by Manager Goldman and unanimously carded.
CONSTRUCTION PERMIT
The Mayor presented the Board with a Notice of Intent to Issue 327 IAC 3, Construction Permits
Per 327 IAC 3-2.1. By approving this notice, the City no longer needs to get IDEM permits.
This will be extremely helpful and will save much time. The above mentioned form needs to be
approved and sent back to IDEM which states that the City will be reviewing applications
locally. The motion was made by Manager Goldman to approve the Notice of Intent to Issue 327
IAC 3, Construction Permits per 327 IAC 3-2.1, seconded by Engineer Miller and carried
unanimously.
CAUTION LIGHT ON SPRING ST.
Engineer Miller asked the Board why the caution light on Spring St has been turned off.
Engineer Miller said that this is not a school light, it is a caution light and should remain on at all
times so children can cross the street more safely any time. Engineer Miller said that Mr. Metger
called him and said the police wanted the light set on a time schedule instead of being on all the
time. Attorney Galligan said that it near a school crossing and motorists think that it is broken
because it is on through the summer. Chief Pavey also feels that people think it is a school
crossing light and think it is broken. After further discussion, Mayor Galligan asked Chief
Pavey to nm radar on Spring St continually from 14th Street to the quarry.
There being no further business to come before the Board of Public Works and Safety, Manager
Goldman made the motion to adjourn at 10:50 A.M., seconded by City Engineer Miller and
carded unanimously.
