HomeMy WebLinkAbout2000-R-13RESOLUTION NO. 2000- A RESOLUTION CONFIRMING DAMAGES FOR CONDEMNATION OF CERTAIN REAL PROPERTY PURSUANT TO INDIANA CODE 32-11-1.5 et. seq. WHEREAS, on July 3, 2000 the Board of Public Works and Safety of the City of Jeffersonville ("the Board") adopted a Resolution Condemning Certain Real Property Pursuant to Indiana Code 32-11-1.5 et seq. which real estate is more particularly described in Exhibit A, attached hereto and incorporated herein by reference; and WHEREAS, notice of the resolution was published in the Evening News on July 6 and July 13, 2000 as required by Indiana Code 32-11-1.5-3(b); and WHEREAS, said notice stated that at its regular meeting on July 24, 2000 the Board would hear remonstrance's from persons interested in or affected by the condemnation; and WHEREAS, on July 10, 2000 the Board adopted Resolution 99-R-11, Resolution Establishing List of Injuriously and/or Beneficially Affected Interests in Condemned Property and Establishing Damages; and A WHEREAS, on July 13, 2000 the Board had a written notice personally served upon George W. and Kathryn L. Winchell the o~vners of the property described in Exhibit "A", showing the amount of the damage a~vard and stating that the Board ~vould hear remonstrance's from persons with regard to the amount of their damage award at its regular meeting on July 24, 2000; and WHEREAS, on July 24, 2000, the Board continued the remonstrance hearing for the property described in Exhibit A until its owners, George W. and Kathryn L.Winchell, could speak to the City's appraiser and/or hire their own appraiser; and WHEREAS, George W. Winchell and the City's appraiser, Richard Baird appeared before the Board on August 14, 2000; and NOW THEREFORE, BE IT HEREBY RESOLVED that the Board hereby confirms its damage award to George W. and Kathryn L. Winchell in the amount of $4,600.00 as set out in its Resolution 2000-R-11; NOW THEREFORE, BE IT HEREBY FURTHER RESOLVED that the Board shall submit a claim for payment of the damages awarded [to the Clerk/Treasurer] and that the Clerk-Treasurer shall pay said claim to the above claimant as required by law. W1NCI-~LL AND KATHR~N L. WINCKELL A part of Survey No. 22 of the Illinois Grant of Clark County, Ifidiana being a part of the same tract conveyed to George W. Winchell and Kathryn L. Winchell at Deed Drawer 21, Instrument No. 11550 and bounded as follows: Commencing at a railroad spike in the centerline of Charlestown Pike which marks the northwesterly coruer of said Winchell tracts original description, thence the following courses: South 51 deg. 17 min. 16 sec. East, 695.10 feet, more or less, leaving said Charlestown Pike, algng property line, the True Place of Beginning. Thence the following courses of the boundary: South 51 deg. 17 min. 16 sec. East, 623.36 feet, mom or less, along Winchell's northeast line to the line dividing said Winchell tract with a tract conveyed to BaIlew at Deed Drawer 10, Instrument No. 2269; South 54 deg. 09 min. 22 sec. West, 395.14 feet, more or less, along said dividing line; North 35 deg. 50 min. 38. sec. West, 10.00 feet, more or less; South 54 deg. 09 min. 22 sec. West, 371.63 feet, more or less, running parallel to and ten (I0) feet distant from said dividing line; North 51 deg. 17 min. 16 sec. West, 607.46 feet, more or less, running parallel to and 20 feet distant from the southwesterly, lot lines of the unrecorded subdivision of Evergreen Circle which is Winchell's northeast line; North 38 deg. 42 min. 44 sec. East, 20.00 feet, more or less, leaving said parallel line to the Tree Place of Beginning. Subject to a 20 foot wide Temporary Construction Easement all along and adjacent to the southwesterly and northwesterly sides of said easement. Upon completion of the project, the Temporary Easement shall revert to the owner. The intent of this description is to describe a twenty (20) foot wide easement running along and adjacent to the line between said Winchell tract and Evergreen Circle Subdivision (unrecorded). And also a ten (10) foot wide easement running along and adjacent to the line between said Winchell tract and Ballew's tract. The Horizontal Datum/Basis of Bearings for this easement plant and description were comprised from a route survey performed by Jacobi, Toombs and Lanz, Inc.
