HomeMy WebLinkAbout2000-R-11 RESOLUTION NO. 2000- // A RESOLUTION ESTABLISHING LIST OF INJURIOUSLY AFFECTED INTERESTS IN CONDEMNED PROPERTY AND ESTABLISHING DAMAGES WHEREAS, on July 10, 2000 the Jeffersonville Board of Public Works and Safety ("the Board") adopted Resolution 2000-__ condemning the real property described in Exhibit A, attached hereto and incorporated by reference herein; and WHEREAS, Indiana Code 32-11-1.5-4 requires that the Board prepare a list of all the owners of the condemned property, and of interests in it; and WHEREAS, Indiana Code 32-11-1.5-5 requires that the Board award damages sustained by said owners and holders of interests and serve written notice showing the amount of the award; and WHEREAS, the written notices must name a date the Board will receive or hear remonstrances; NOW THEREFORE, BE IT HEREBY RESOLVED that the owners of the property described in Exhibit A, and of interests in it, are George W. and Kathryn L. Winchell; and NOW THEREFORE, BE IT HEREBY FURTHER RESOLVED that the total damages sustained by George W. and Kathryn L. Winchell as a result of the condemnation of a sewer and access easement over the property described in Exhibit A are Forty Six Hundred Dollars ($4,600.00); and NOW THEREFORE, BE IT HEREBY FURTHER RESOLVED that the Board shall receive and hear remonstrance's with regard to the amount of the damage award at its regular 9:30 a.m. meeting on July 24, 2000, and the Clerk-Treasurer is hereby instructed to serve personal notice upon George W. and Kathryn L. GEORGE W. WINCHELL AND KATHRYN L. WINCHELL A part of Survey No. 22 of the Illinois Grant of Clark County, Indiana being a part of the same tract conveyed to George W. Winchell and Kathryn L. Winchell at Deed Drawer 21, Instrument No. 11530 and bounded as follows: Commencing at a railroad spike in the centerline of Charlestown Pike which marks the northwesterly corner of said Winchell tracts original description, thence the following courses: South 51 deg. 17 min. 16 sec. East, 695.10 feet, more or less, leaving said Charlestown Pike, along property line, the True Place of Beginning. Thence the following courses of the boundary: South 51 deg. 17 min. 16 sec. East, 623.36 feet, more or less, along Winchell's northeast line to the line dividing said Winchell tract with a tract conveyed to Ballew at Deed Drawer 10, Instrument No. 2269; South 54 deg. 09 min. 22 sec. West, 395.14 feet, more or less, along said dividing line; North 35 deg. 50 min. 38 sec. West, 10.00 feet, more or less; South 54 deg. 09 min. 22 sec. West, 371.63 feet, more or less, running parallel to and ten (i0) feet distant from said dividing line; North 51 deg. 17 min. 16 sec. West, 607.46 feet, more or less, running parallel to and 20 feet distant from the southwesterly lot lines of the unrecorded subdivision of Evergreen Circle which is Winchell's northeast line; North 38 deg. 42 min. 44 sec. East, 20.00 feet, more or less, leaving said parallel line to the Tree Place of Beginning. Subject to a 20 foot wide Temporary Construction Easement all along and adjacent to the southwesterly and northwesterly sides of said easement. Upon completion of the project, the Temporary Easement shall revert to the owner. The intent of this description is to describe a twenty (20) foot wide easement running along and adjacent to the line between said Winchell tract and Evergreen Circle Subdivision (unrecorded). And also a ten (10) foot wide easement running along and adjacent to the line between said Winchell tract and Ballew's tract. The Horizontal Datum/Basis of Bearings for this easement plant and description were comprised from a route survey performed by Jacobi, Toombs and Lanz, Inc.
