RESOLUTION NO. 2000- 7
A RESOLUTION CONFIRMING DAMAGES FOR
CONDEMNATION
OF CERTAIN REAL PROPERTY PURSUANT TO
INDIANA CODE 32-11-1.5 et. seq.
WHEREAS, on March 27, 2000 the Board of Public Works and Safety
of the City of Jeffersonville ("the Board') adopted a Resolution Condemning
Certain Real Property Pursuant to Indiana Code 32-11-1.5 et seq. which real
estate is more particularly described in Exhibit A, attached hereto and
incorporated herein by reference; and
WHEREAS, notice of the resolution was published in the Evening
News on March 30 and April 6, 2000 as required by Indiana Code 32-11-1.5-
3Co); and
WHEREAS, said notice stated that at its regular meeting on April 17,
2000 the Board would hear remonstrances from persons interested in or
affected by the condemnation; and
WHEREAS, after hearing remonstrances, on April 17, 2000 the Board
adopted Resolution 2000-6 confirming condemnation of the real property
described in Exhibit A, attached hereto and incorporated herein by reference;
and
WHEREAS, on April 10, 2000 the Board adopted Resolution 2000-5, A
Resolution Establishing List of Injuriously and/or Beneficially Affected
Interests in Condemned Property and Establishing Damages; and
WHEREAS, on April 12, 2000 the Board had a xvritten notice personally
served upon the owners of the property described in Exhibit A, showing the
amount of the damage award and stating that the Board would hear
remonstrances from persons with regard to the amount of the damage award at
its regular meeting on April 24, 2000; and
WHEREAS, on April 24, 2000 the Board held a remonstrance hearing at
which Sharon KJeinert appeared, in person and by counsel for Harold I~deinert
and Sharon I~deinert, Daniel E. Moore; and
WHEREAS, the Kleinerts, by their counsel, remonstrated and provided
a written statement from an appraiser opining that the K3einerts will suffer
damages to their property as a result of this condemnation in the amount of
$41,i00.00; and
WHEREAS, after hearing the I~einerts' remonstrance, the Board finds
that the original damage award of $16,225.00 should be confirmed.
NOW THEREFORE, BE IT HEREBY RESOLVED that the Board
hereby confirms its damage award to Harold I~einert and Sharon Kdeinert in
the amount of $16,225.00 as set out in its Resolution 2000-5; and
NOW THEREFORE, BE IT HEREBY FURTHER RESOLVED that
the Board shall submit a claim for payment of the damages awarded to the
Clerk/Treasurer who shall pay said claim to the above claimant as required by
law.
