HomeMy WebLinkAbout2000-R-06RESOLUTION NO. 2000- 6 A RESOLUTION CONFIRMING CONDEMNATION OF CERTAIN REAL PROPERTY PURSUANT TO INDIANA CODE 32-11-1.5 et. seq. WHEREAS, on March 27, 2000 the Board of Public Works and Safety of the City of Jeffersonville (the "Board") adopted a Resolution Condemning Certain Real Property Pursuant to Indiana Code 32-11-1.5 etseq. (the "Resolution") which real estate is more particularly described in Exhibit A, attached hereto and incorporated herein by reference; and WHEREAS, notice of the Resolution was published in the Evening News on March 30, 2000 and April 6, 2000 as required by Indiana Code 32-11-1.5-3(b); and WHEREAS, said notice stated that at its regular meeting on April 17, 2000 the Board would hear remonstrances from persons interested in or affected by the condemnation; and WHEREAS, at the Board's regular meeting on April 17, 2000, no one appeared to remonstrate with regard to the condemnation; and WHEREAS, the Board finds that the proposed condemnation is in the best interest of the residents of the Jeffersonville Municipal Sewer Utility district, and the citizens of the City of Jeffersonville, as it will improve the health, safety and welfare of those residents by providing significant improvement to wastewater treatment in the vicinity of Salem-Noble Road, Jeffersonville-Charlestown Pike and King Road, and redudng the infiltration of sewage into the groundwater in those areas. NOW THEREFORE, BE IT HEREBY RESOLVED that the Board hereby con£Lrms its original March 27, 2000 Resolution condemning and appropriating for the use of the City of Jeffersonville (the "City") the real estate described in Exhibit A, attached hereto and incorporated herein by reference; and 1 NOW THEREFORE, BE IT HEREBY FURTHER RESOLVED that the Utility Easement over the real estate described in Exhibit A is hereby conveyed to the City; and NOW THEREFORE, BE IT HEREBY FURTHER RESOLVED that the Clerk-Treasurer shall record a copy of this Confirming Resolution in the office of the Recorder of Clark County, Indiana to memorialize the City's condemnation of the Utility Easement over the real estate described in Exhibit A; and NOW THEREFORE, BE IT HEREBY FURTHER RESOLVED that the Board shall promptly prepare a list of affected property owners, a~vard damages sustained to the property, and pay damages on the affected property, all as required by Indiana Code 32-11-1.5-1 et seq.
