HomeMy WebLinkAbout2001-R-02 RESOLUTION NO. 2001-R- ~. A RESOLUTION CONDEMNING CERTAIN REAL PROPERTY PURSUANT TO INDIANA CODE 32-11-1.5 et. seq. WHEREAS, the Board of Public Works and Safety of the City of Jeffersonv~lle (the "Board") desires to appropriate and condemn, for the use of the municipality', a Sewer, Drainage and Utility Easement over the real estate described in Exhibit A, attached hereto and incorporated herein by reference; and WHEREAS, the Board has determined that the real estate described in Exhibit A, ma3, be injuriously and/or beneficially affected by the condemnation; and NOW THEREFORE, BE IT HEREBY RESOLVED that the Board hereby appropriates and condemns for the use of the City of Jeffersonville (the "City") a Sewer, Drainage and Utility Easement over the real estate described in Exhibit A; and NOW THEREFORE, BE IT HEREBY FURTHER RESOLVED that the Clerk- Treasurer shall publish notice of this Resointion in the Evenineg Nems once each week for the next two (2) consecutive weeks; and NOW THEREFORE, BE IT HEREBY FURTHER RESOLVED that the Board shall receive and hear remonstrances from persons interested in, or affected by, this condemnation at its regularly-scheduled June 18, 2001 meeting, and then take final action, confirming, modifying, or rescinding its original resolution. Galligan, ayo~/ / (/ ATTEST: Clerk - Treasurer ob Miller - Denny Fra~7 2 EXHIBIT 'A' DESCRIPTION OF A SEWER, DRAINAGE AND UTILITY EASEMENT ACROSS THE LAND OF MATTHEW WELSH AND CAROL JEAN WELSH A part of Lot 129 in the Meadows Subdivision Unit 1 recorded at Plat Book 8, Page 40, being in Survey No. 34 of the Illinois Grant in Jeffersonville Township of Clark County, Indiana being a part of the same tract conveyed to Matthew Welsh and Carol Jean Welsh at Deed Drawer 20, Instrument No. 10803 and bounded as follows: Commencing at a point in the southeasterly line of said Lot 129 which marks the southe.asterly corner of said lot, thence the following courses: South 54 deg. 57 min. 02 sec. West, 20.00 feet, more or less, along said southeasterly line; North 35 deg. 02 min. 58 sec. West, 6.00 feet, more or less, leaving said southeasterly line, running across a six (6) foot wide drainage easement, the True Place of Beginning. Thence the following courses of the boundary: South 54 dg. 57 min. 02 sec. West, 25.69 feet, more or less, running parallel to and six [6) feet distant from said southeasterly property line; North 22 deg. 13 min. 16 sec. East, 30.54 feet, more or less; South 35 deg. 02 min. 58 sec. East, 16.51 feet, more or less, runmng parallel to and twenty (20) feet distant from the northeasterly Iine of said Lot 29 to the True Place of Beginning and containing 212 square feet, more or less, of land. The Horizontal Datum/Basis of Bearings for this easement plat and description were comprised from public record and a limited field SUrvey performed by Jacobi, Toombs and Lanz, Inc. Also subject to a ten (10) foot wide temporary construction easement all along and adjacent to the westerly lines of the above described easement.
