HomeMy WebLinkAbout04-08-2002MINUTES OF THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF JEFFERSONVILLE, INDIANA APRIL 8, 2002 Mayor Galligan called the meeting to order at 9:30 a.m. and on call of the roll those members present were: Councilperson Waiz and City Engineer Miller. Also present were: Safety Director Rodden, Wastewater Treatment Director Crawford, Animal Shelter Director Keller, Police Chief Pavey, Administrator Rich Davis, Fire Chief Smith, Building Commissioner Gavin, City Attorney Galligan, Vehicle Maintenance Director Drury, Mayor Assistant White, Street Commissioner Grant, Planning and Zoning Director Ecker, Parks Director Elliott, Engineering Coordinator Dixon, and Deputy Clerk Lynne Mayfield. Engineer Miller made the motion to approve the payroll as presented, seconded by Councilperson Waiz and carried unanimously. RESIDENT PARKING Amanda Daugherty of 725 Fulton Street requested a resident only parking sign in front of her residence. She said people are parking in front of her house and littering her property. Police Chief Pavey said he would check out the situation. Engineer Miller made the motion to approve the resident only parking sign comingent upon Police Chief Pavey's approval, seconded by Councilperson Waiz and carried unanimously. NEIGHBORHOOD PROBLEM Mark and Roy Bishop of 305 and 308 Myrtle Street appeared before the Board in regard to two abandoned trailers at 315 Myrtle Street and between 315 ½ and 321 Myrtle Street. Building Commissioner Gavin said he is sending out a citation to the owners and hopes to have them condemned in 30 days. UNITED DYNAMICS David DeMuro spoke to the Board about the cleaning out of the ditch, at his business in Industrial Park. He said some work has been done. Mayor Galligan said the ditch would be cleaned out completely. STROBEL Attorney Dan Marra, representing Strobel appeared before the Board to say that Strobel doesn't think the 1960 Ordinance is clear enough to apply to them. He said they were cited in on an ordinance that didn't come into effect until 1973. Attorney Marra said Mr. Strobel is willing to offer to pave the entire front of the building and have a written agreement stating that they are not in violation of any ordinance. Councilperson Waiz questioned how the Ordinance Strobel had been abiding by could be changed. Planning and Zoning Director Ecker said she thinks the city should not enter into this type of agreement. Mayor Galligan brought up the fact that at a previous Board of Public Works meeting, Mr. Strobel and his previous attorney, Steve Voelker agreed to do all of the necessary paving by the end of spring 2002. Attorney Galligan said the agreement is basically a contract. Mayor Galligan said the same rules are being applied and enforced throughout Industrial Park. Engineer Miller made the motion to deny Strobel's offer and stand by the original agreement, and seconded by Mayor Galligan. Councilperson Waiz voted against the motion. GIS Planning and Zoning Director Ecker asked the Board to approve two GIS contracts with Jacobi, Toombs, and Lanz. One contract is for Support Services not to exceed $5,000.00 and the other contract is for Planimetric Conversion and Permitting Software Analysis not to exceed $9,900.00. The cost of training is not included in the contract and will come out of the department budgets. Councilperson Waiz questioned the length of the contract not being stated in the contract. Attorney Galligan said all contracts are technically for one year but that extra language can be added stating a per year amount. Engineer Miller made the motion to approve the two GIS contracts with Jacobi, Toombs, and Lanz for 12 months, seconded by Councilperson Waiz and carried unanimously. 12th CLOSING Engineer Miller said he received a request from the National Guard to close 12th Street from Dutch Lane to Mechanic Street during the summertime. Mayor Galligan said this could not be done. PARKING FOR HYDRANTS Fire Chief Smith asked the Board to approve striping the street on Riverside Drive and River Pointe Plaza for a "no parking zone". Councilperson Waiz made the motion to approve the "no parking" zone on Riverside Drive and River Pointe Plaza, seconded by Engineer Miller and carried unanimously. _31,0oo CONFIRMING CONDEMNATIONS RESOLUTIONS # 14, 15,16, AND 17 Attorney Galligan presented four Confirming Condemnation Resolutions for approval and called for any remonstrators to state their objections. Resolution #14-James and Lisa Joyce/Pleasant Run Sewer Easement Resolution #15-Gordon and Martha Gutmann/Tenth St. Sewer Easement Resolution #16-David and Patricia Haag/Tenth St. Sewer Easement Resolution # 17-David and Linda Francke/Tenth St. Widening Hearing no remonstrators, Engineer Miller made the motion to approve Condemning Resolutions 14,15, 16, and 17, seconded by Councilperson Waiz and carried unanimously. THUNDER ROAD CLOSING Police Chief Pavey presented the Thunder road-closing schedule for approval. (Copy attached) Mayor Galligan encouraged the police to use their cameras for any possible problems. Engineer Miller made the motion to approve the road closures for Thunder, seconded by Councilperson Waiz and carried unanimously. Police Chief Pavey told the Board that "No Parking" needs to be re-painted in front of Jeffboat on Market Street. He said a few more "No Parking" signs are also needed. Street Commissioner Grant said he would take care of these things. WATT AND 12TH STREETS Mayor Galligan said "No Parking" signs need to be erected on the west side of Watt Street from Meyer's Erecting all the way to the comer. Engineer Miller made the motion to approve erecting "No Parking" signs on the west side of Watt Street back to 12th Street at Meyer's Erecting, seconded by Councilperson Waiz and carried unanimously. WATER PROBLEM Councilperson Waiz said he got a call from a resident at 2312 Bishop Road about flooding problems caused because a neighbor filled up the drainage ditch. Engineer Miller said he would look into this. Ail of the above mentioned residential streets will be open to residents and their personal vehicles until 5:00 pm with the exception of Riverside Drive. Streets ~will be reopended at the discretion of the Chief of Police, depending upon traffic congestion and the safety of pedestrians in the area. All streets are projected to be opened by 12:00 midnight. (Approximate) The 1-65 exit ramp (Exit 0) for North and Southbound traffic will be closed by the Indiana State Police at 7:00 am on Saturday, April 20, 2002. As in the past events such as this, we are requesting that no alcoholic beverages be allowed on city property. This would include city streets, city owned parking lots and the river bank area located in the "Event Area". Also, we are requesting that no animals be brought into the "Event Area" or allowed on city property with the exception being for medical reasons. In addition, we are requesting that no Recreational Vehicles be allowed to park in the event area and that there will be no open flames, tents, portable buildings, skateboards, bicycles or motorized scooters allowed. Also, we are requesting that no Golf carts other than those used by Police, EMS and the Derby Festival Committee be allowed in the "Event Area". SUPPORT SERVICES This agreement entered into this __ day of ,2002, by and between the City of Jeffersonville, Indiana, acting through the Board of Public Works and Safety and, hereinafter called the OWNER, and Jacobi, Toombs and Lanz, Inc., a firm of Professional Engineers, hereinafter called the CONSULTANT, WITNESSETH WHEREAS, the OWNER desires to further supplement the ongoing G.I.S. efforts with G.I.S. support services for the City of Jeffersonville, and NOW, therefore, in consideration of the mutual covenants herein contained, the parties hereto mutually agree as follows: BASIC SERVICES OF THE CONSULTANT 1. The CONSULTANT shall perform G.I.S. support service functions consisting of G.I.S. software and printing support for the City of Jeffersonville. a. Deliverables The CONSULTANT shall perform support services on as needed basis as directed by the Office of Planning and Zoning. COMPENSATION TO THE CONSULTANT 1. Compensation to the CONSULTANT for G.I.S. support services will be as follows: For all the work described under paragraph A.1 of this Agreement, the Consultant shall be paid on a time and materials (T & tV0 basis, ~vith a not-to- exceed amount of five thousand dollars ($5,000.00). Planimetric Conversion The CONSULTANT shall convert the existing planimetric drawing coverage into ArcView shape file format. The shape files shall then be implemented into the existing City of Jeffersonville G.I.S. project. b. Black Bear permit tracking software The CONSULTANT shall review the City of Jeffersonville's permitting process and use sample data from that review to begin integration of the City's permitting process with Black Bear Systems' Ptwin32 permit tracking software.
