BEFORE THE JEFFERSONVILLE COMMON COUNCIL

AN ORDINANCE CHANGING THE ZONING MAP DESIGNATION OF A
CERTAIN TRACT OF PROPERTY FROM R-2 TO PLANNED UNIT
DEVELOPMENT
Whereas, BWT Development, LLC filed an application before the
Jeffersonvirle Plan Commission to approve a planned unit development ("PUD")
outline plan for the real property described in the attached "Exhibit A' (the
"Property"); and
Whereas, on October 26, 1999 the Jeffersonville Plan Commission held a
public hearing on approval of the PUD outline plan and changing the City's
zoning maps to reflect a change in the zoning classification of the Property from
R-2 to PUD; and
Whereas, the Plan Commission certified to the Common Council a
favorable recommendation concerning the proposed change to the City's zoning
map; and
Whereas, this matter is now before the Common Council for public
hearing on the PUD application within 30 days after the Council received the
Plan Commission's report and recommendations pursuant to the provisions of
Section 156.69C.4. of the Jeffersonville Zoning Ordinance; and
Whereas, the Common Council has notice of its intent to consider the
proposed change of zoning map designation as required by lC 36-7-4-608(g)(1);
and
Whereas, all interested persons having been given an opportunity to
appear before this Common Council and be heard regarding this matter as
required by law.
NOW, THEREFORE, BE IT ORDAINED by the Common Councilofthe
City of Jeffersonville, Indiana, that the zoning designation of the real property
described in the attached "Exhibit A" is hereby changed from R-2 to PUD;
IT IS FURTHER ORDAINED that the zoning map of the City of
Jeffersonville shall be amended to include such change.
IT IS FURTHER ORDAINED that the BWT Development, LLC outline plan
and written statement for the Property is hereby approved.
This ordinance shall be in full force and effect upon its adoption.

CERTIFICATION OF FAVORABLE RECOMMENDATION
OF pROPOSED ORDINANCE.
Whereas. Bw'r Development, LLC filed, a petition before [he Jeffersonville Plan
Commission to change the zoning designation of the property described in attached
Exhibit A (the ,'Property"), from R-2 to PUD; and,
Whereas, after proper notice by publication, the Jeffers'onville Plan Commission
held a public hearing on the petition on October 26, 1999; and,
Whereas, at the conclusion of the headng the jeffersonville Plan Commission
voted by a majority vote of its membership to favorably recommend the proposed
change of the zoning designation of the Property to the Jeffersonville Common Council.
IT IS THEREFORE CERTIFIED that on October 25, 1999, the Jeffersonville Plan
CommissiOn favorably recommended that the Jeffersonville Common Council enact by
ordinance the proposed zoning designation change of the property from R-2 to PUD as
requested in the petition of BWT Development, LLC.
