COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA May 7, 2007 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 7:30 P.M. on Monday May 7, 2007. Mayor Rob Waiz, with Deputy Clerk Treasurer Barbara Hollis at the desk, called the meeting to order. Also present was City Attorney Les Merkley. Mayor Waiz welcomed all in attendance, asking all those present to stand as Councilperson Ron Grooms gave the invocation. Mayor Waiz then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were; Councilpersons John Perkins, Ed Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, Phil McCauley, and Ron Grooms. Absent: None. Following discussion, Council President Fetz made the motion to approve the agenda with the removal of agenda item #11, second by Councilperson Zastawny, passing on a vote of7-0. Mayor Waiz presented the minutes for consideration by the Council. Councilperson Wilson made the motion to approve the minutes of April 16, 2007 (5:30 P.M.) as presented, second by Councilperson Grooms, passing on a vote of 7-0. Councilperson Wilson made the motion to approve the minutes of April 16, 2007 (7 :30 P.M.) as presented, second by Councilperson McCauley, passing on a vote of7-0. Deputy Clerk Treasurer Hollis presented the claim list for consideration by the Council, explaining four additional claims (Clark County Red Cross, Motorolla and two for U. S. Postal Service), a change of a claim from Clerk's Perpetuation to Clerk Treasurer, and move the spay/neuter claims out of Council to spay/neuter. Councilperson McCauley made the motion to approve the claims, the additional, and the changes as discussed, second by Councilperson Grooms, passing on a vote of7-0. May 7, 2007 2 PUBLIC COMMENT: Mr. Don Herrold, V.F.W. Chaplain, first thanked the Council for honoring the Honor Guard. He then invited all to a special Memorial Day Service to be held, Monday May 28, 1007 at 2:00 P.M. at the River Stage. Mr. Tom Head, a resident of201 East Riverside Drive, explained the problems he and his family experienced during Thunder with regard to parking passes. He felt that Officer Cleveland and one other officer. could have used better judgment and given more respect. He lives here and pays taxes here and felt he was not respected. COUNCIL COMMENTS: Councilperson Perkins noted the Play Square Park nets are not up as promised. Park Superintendent Rob Poff explained all the poles are up and half the nets are up. Players will sign waivers. The nets should be in by the end of the week or the middle of next week. AGENDA ITEMS: Mr. Sujyot Patel, Attorney representing MKM Machine Tool Co., Inc. appeared before the Council to request passage of Ordinance No. 2007-0R-24, An Ordinance Authorizing The Entry Into A Master Lease-Purchase And Sublease-Purchase Agreement In An Aggregate Principal Amount Not To Exceed $7,500,000 With National City Equipment Finance And MKM Machine Tool Co., Inc.: To Finance The Equipping Of An Economic Development Facility Located Within The City Of Jeffersonville, Indiana; Authorizing A Master Lease-Purchase And Sublease-Purchase Agreement And Tax Exemption Certificate And Agreement; And Authorizing Other Actions In Connection With The Transaction. Mr. Patel explained there is no financial obligation to the City. Councilperson McCauley asked if there have been any changes since the inducement Resolution was passed. Mr. Patel said there have been no changes. Councilperson McCauley made the motion to suspend the rules for Ordinance No. 2007-0R-24, second by Councilperson Sellers, failing on a vote of 6-1. Councilperson Perkins voted in opposition. Councilperson Perkins would like Council Attorney Fifer to review the Ordinance. Time restraints were discussed. Mr. Patel does not know when the volume cap expIres. Following all discussion, Councilperson Perkins made the motion to suspend the rules for Ordinance No. 2007-0R-24, second by Councilperson McCauley, May 7, 2007 3 passmg on a vote of 7-0. Councilperson McCauley then made the motion to pass Ordinance No. 2007-0R-24 on all three readings, second by Councilperson Wilson, passing on a vote of7-0. Council President Fetz presented and explained the need for passage of Ordinance No. 2007-0R-25, An Ordinance Of Request For Amendment To Ordinance No. 2006- OR-20. Councilperson Perkins made the motion to suspend the rules for Ordinance No. 2007-0R-25, second by Council President Fetz, passing on a vote of 7-0. Councilperson Perkins then made the motion to pass Ordinance No. 2007-0R-25 on all three readings, second by Councilperson Wilson, passing on a vote of7-0. Councilperson Grooms presented and explained Ordinance No. 2007-0R-26, An Ordinance Of Additional Appropriation - Gaming Revenue Fund. Park Superintendent Poff summarized proposals for restrooms at Shirley Hall Park and Warder Park, explaining the differences. Council President Fetz asked if other estimates would be obtained. Superintendent Poff explained there would be others. Councilperson Zastawny asked if Superintendent Pof~ had worked with the gentlemen from the league. Superintendent Poff said he did. Regarding the Warder Park restrooms, Superintendent Poff explained the Park Board's option is to not have the restroom in the Park. They are working with Life Springs for a location at Court and Wall. Concern was voiced for the need to cross the street. There is talk of closing the street for concerts. Councilperson Perkins asked if the property would be deeded to the City. Attorney Merkley said there would have to be a deed or a long-term lease. Councilperson Zastawny asked about having vendors if the street was closed. Councilperson Wilson explained two Scout Troops sell food and Harry Wilder has ice cream. Councilperson Perkins said it might be possible to expand vendors. Councilperson Perkins said it would be his personal preference to deed the property. Councilperson Grooms noted the restrooms could be open for other festivals. Councilperson Grooms made the motion to pass Ordinance No. 2007-0R-26 on the first reading, second by Councilperson Wilson, passing on a vote of 7 -0. Councilperson McCauley said he is thrilled to see these kinds of projects coming to the City. He thanked Councilpersons Grooms and Wilson for their work on this. Councilperson Perkins explained the need for passage of Resolution No. 2007-R- 18, A Resolution To Advertise For An Additional Appropriation (General Fund - May 7, 2007 4 Common Council). Councilperson Perkins made the motion to pass Resolution No. 2007-R-18, second by Councilperson McCauley, passing on a vote of7-0. Deputy Hollis explained Ordinance No. 2007-0R-27, An Ordinance Amending Ordinance 2007-0R-20, Which Amends 2006-0R-52, An Ordinance Fixing Basic Salaries Of Appointed Officers And Employees Of The City Of Jeffersonville, Indiana For The Year 2007. This Ordinance amends titles only. Council President Fetz made the motion to suspend the rules for Ordinance No. 2007-0R-27, second by Councilperson Zastawny, passing on a vote of 7-0. Council President Fetz then made the motion to pass Ordinance No. 2007-0R-27 on all three readings, second by Councilperson Sellers, passing on a vote of7-0. CLERK TREASURER COMMENTS: There were no Clerk Treasurer Comments. COMMITTEE, COUNCIL, AND MAYOR COMMENTS: Council President Fetz has copied information from Clark County Red Cross, SIEBC, and a copy of a Duke Energy email to Engineer Bob Miller for the Council. Councilperson McCauley informed the Council the Police Department is looking at software options. Fire trucks are being bid. Councilperson McCauley also noted the long lines at the Post Office are due to the annexation mailings. He also feels there may be a lack of Police training with regard to the Thunder complaint. Councilperson Grooms thanked the Council for the support of the Ordinance for Park improvements. He also thanked Officer Grimes and Jeff High student Sperzel. Councilperson Grooms also noted how vulnerable cities can be as in the recent tornado in Kansas. Councilperson Grooms urges all to vote and wishes all the best of luck. Councilperson Wilson noted the Parks Department has spent a lot of time working on properties. Councilperson Sellers is working on an Ordinance to allow the building of fences on easements. Councilperson Sellers has distributed a letter from Foxboro Homeowners Association. They would like to be on the next workshop agenda. Councilperson Zastawny has distributed a letter from Golfview Estates Property Owners Association. They would also like to be on the next workshop agenda. Councilperson Zastawny has been attending meetings regarding auto sales zoning * May 7, 2007 5 changes. This should be ready two or three meetings out. Councilperson Zastawny informed the Council of cooling issues with Information Technology. An estimate to correct is over $100,000. A letter has been sent to Clark County requesting zoning authority in the proposed annexation areas. Councilperson Perkins noted the action taken by the State Legislature regarding methadone clinics. He congratulates Councilpersons Zastawny, Sellers, Fetz, and Grooms, as they are unopposed in the election. Council President Fetz asks Attorney Merkley to check on the lapse of the Canine insurance policy. Mayor Waiz says thank you to ACL for their donation of $100,000. The donations will go to River Stage $50,000, Beautification $10,000, Murals $30,000 and Ken Ellis Center $10,000. He also says thank you to Bales Motors for the $5,000 donation to River Stage. Mayor Waiz says don't forget to vote, and have a good evening. Councilperson Wilson asked if the Ke roblems have been corrected. Mayor Waiz said it is not open yet; t problems e bing worked on.
