BEFORE THE JEFFERSONVILLE COMMON COUNCIL
ORDINANCE NO. 2007-0R-12
AN ORDINANCE CHANGING THE ZONING MAP DESIGNATION, OF A
CERTAIN TRACT OF PROPERTY LOCATED AT 411 EAST SEVENTH
STREET (PARCEL NUMBER/TAX KEY: 019-34-0200) FROM R3: OLD CITY
RESIDENTIAL TO DC: DOWNTOWN/OLD CITY COMMERCIAL.
Whereas, Charles Wills, has filed a petition before the Jeffersonville Plan Commission
to change the zoning map designation of the real property described in the attached
Exhibits from R3: Old City Residential to DC: Downtown/Old City Commercial; and;
Whereas, on February 27,2007 the Jeffersonville Plan Commission has certified
to the Council a non-recommendation concerning the proposed change to the City's
zoning map; and,
Whereas, this matter is now before the Common Council at its regular meeting
after certification of the proposed change of zoning map designation pursuant to the
provisions ofLC. 36-7-4-608(1)(1); and,
Whereas, this Common Council has timely posted notice of its intent to consider
the proposed change of zoning map designation at the regular meeting scheduled for
March 5, 2007 at 7:30 o'clock p.m.; and,
Whereas, all interested persons having been given an opportunity to appear
before this Common Council and be heard regarding this matter as required by law.
NOW, THEREFORE, BE IT ORDAINED by the Common Council. of the City
of Jeffersonville, Indiana, that the zoning designation of the real property described in the
attached Exhibits is hereby changed from R3: Old City Residential to DC:
Downtown/Old City Commercial; and;
IT IS FURTHER ORDAINED that the zoning map of the City of Jeffersonville
shall be amended to include such change.
This ordinance shall be in full force and effect upon its adoption.

THIS INDENTURE WITNESSETH, that MICHAEL L. BECHER, as Sheriff of Clark

IT IS THEREFORE CERTIFIED that on February 28, 2007, the Jeffersonville
Plan Commission m.ade a non-recommendation to the Jeffersonville Common Council
regarding the r~quest to enact by ordinance the proposed zoning cl.esignation change of

Notice is hereby given that on March 5, 2007 at 7:30 o'clock p.m. in the Council
Chambers, First Floor, Jeffersonville City Hall, 500 Quartermaster Court, Jeffersonville,
Indiana, the Common Council of the City of Jeffersonville, Indiana, intends to consider
an ordinance, which, if adopted, would change the zoning map designation of the
following described property from R3: Old City Residential to DC: Downtown/Old City
Commercial.
DESCRIPTION OF PROPERTY LOCATED IN
THE CITY OF JEFFERSONVILLE
PROPERTY ADDRESS: The property is located at 411 E. yth Street.
Parcel NumberlTax Key: 019-34-0200.
The Jeffersonville Plan Commission made a Non- recpmmendation concerning
the adoption of an ordinance enacting this proposed change of zoning map designation
after notice and hearing on February 27,2007. All interested persons are invited to

feet to an iron pipe in the eastern right-of-way of the P.C.C. & St. L. Railroad

way line a distance of220.78 feet to an "X" tie fence post; thence S. 410 19'
32" east 1021.04 feet to a railroad spike in the center line of the Charlestown-
New Albany Pike; thence S. 490 30' W., along the center of said pike a
distance of 217.70 feet to a railroad spike, the true place of beginning.
Containing 5.000 acres~ situated in Survey No. 34 ofthe Illinois Grant to Clark
County, lndiana, and subject to all legal highways.
Being the same property conveyed to Grantors by Deed dated January 30, 1967
of record in Deed Record No. 283, Pages 118 and 119, in the aforesaid
Recorder's Office.

Subject to any and all easements, restrictions and/or protective covenants of public
record which may apply to the above property.
The Grantors covenant that they are lawfully seized of the estate hereby conveyed,
with full right and power to convey the same. This conveyance is subject to all existing
restrictions and easements of record, any mortgages or liens of record, any State and County
taxes that are due and payable, and all subsequent taxes which the Grantee does hereby
assume and agree to pay.

concerning the adoption of an ordinance enacting this proposed change of zoning map
designation after notice and hearing on February 27,2007. All interested persons are
invited to attend and be heard regarding this matter. This Jeffersonville Common
Council meeting may be continued from time to ~ime as found necessary. The
Jeffersonville Common Council may take official action at the conclusion of debate at
this meeting.
