BEFORE THE JEFFERSONVILLE COMMON COUNCIL
ORDINANCE NO. 99-OR-~
AN ORDINANCE CHANGING THE ZONING MAP DESIGNATION OF A
CERTAIN TRACT OF PROPERTY LOCATED AT 1203 EAST COURT AVENUE
Whereas, Marshall Witten filed a petition before the Jeffersonville Plan
Commission to change the zoning map designation of the real property described in the
attached "Exhibit A" from R-1 (Single Family Residence) to R-2 (Single, Two and Multi-'
family Residence); and,
Whereas, on July 27, 1999 the Jeffersonville Plan Commission has certified its
favorable recommendation of the enactment of this proposed zoning map designation
change by ordinance of this Common Council; and,
Whereas, this matter is now before the Common Council at its first regular
meeting after certification of the proposed change of zoning map designation pursuant
to the provisions of I.C. 36-7-4-608(0(1 ); and,
Whereas, this Common Council has timely posted notice of its intent to consider
the proposed change of zoning map designation at the regular meeting scheduled for
August 2, 1999 at 7:00 o'clock p.m.; and,
Whereas, all interested persons having been given an opportunity to appear
before this Common Council and be heard regarding this matter as required by law.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Jeffersonville, Indiana, that the zoning designation of the real property described in the
attached "Exhibit A" is hereby changed from R-1 to R-2 (Single, Two and Multi-family
residence).
IT IS FURTHER ORDAINED that the zoning map of the City of Jeffersonville
shall be amended to include such change.
This ordinance shall be in full force and effect upon its adoption.

CERTIFICATION OF FAVORABLE/UNFAVORABLE/NO RECOMMENDATION
OF PROPOSED ORDINANCE
Whereas, Marshall Witten filed a petition before the Jeffersonville Plan
Commission to change the zoning designation of the property described in attached
Exhibit A (the "Property"), from R-1 to R-2 Single, Two and Multi-family Residence; and,
Whereas, after proper notice by publication, the Jeffersonville Plan Commission
held a public hearing on the petition on July 27, 1999; and,
Whereas, at the conclusion of the hearing the Jeffersonville Plan Commission
voted by a majority vote of its entire membership to favorably recommend the proposed
change of zoning designation of the Property to the Jeffersonville Common Council.
IT IS THEREFORE CERTIFIED that on JulY 27, 1999, the Jeffersonville Plan
Commission favorably recommended that the Jeffersonville Common Council enact by
ordinance the proposed zoning designation change of the property from R-1 to R-2
Single, Two and Multi-family Residence as requested in the petition of Marshall Witten.

set out on the District Zone Naps of the City of Jeffersonville, Indiana with
to the followinE described real estate, situated in the City of Jeffersot
County of Clark, State of Indiana, to-wit:
Lots Nu~nber Tbirty-Four (34) and Tbirty-Five (35) of
the plat of Sallie E. Pritchard and Clarence Pritchard's
Jeffersonville), as tbe same appears on the plat of such
Clark County, Indiana, in Plat Oook ~o. 6, at page 25.
ALSO, Ten (~0) feet off the nortbeast side of Lot Number
Tblrty-Six (36) of the Plat of Sallie E. Pritchards and
(1} and Three {3) of the Town of Port Fulton (~ow a
par~ of the City of deffersonville), as the same appears
of r~eord on tbe plat of such subdivision on file in the
Oook No. 5, at page 25.
The above described real estate is now in a district classified as ~ ~
and it is requested that it be reclassified es ~_~ for the fol
1. That it will not materially affect the value of real estate surrounding
property.
2. The proposed amendment would not be detrimental to public health,
morals or general welfare.
The proposed amendment will not be contrary to tbe public interest.
