ORDINANCE TO ANNEX TERRITORY FROM
THE TOWN OF CLARKSVILLE INTO
THE CITY OF JEFFERSONIVLLE
Whereas the City of Jeffersonville is a municipal organization which is organized
under IC 36-1-2-3 et seq.
Whereas the State of Indiana has an active statutes to regulate annexation and de-
annexation of real estate within territorial confines of cities and towns.
Whereas on June 23,2006 the Board of Directors of Serenity, Inc., an Indiana
not- for-profit organization, petitioned the Town Council of Clarksville, Indiana and the
City Council of Jeffersonville, Indiana to de-annex certain property from the Town of
Clarksville to be re-annexed into the City of Jeffersonville names as following:
Beginning at a steel pin on the northwest comer of said Block 8; Thence
S.2017'02"W., along the east line of said Block, being the west Right-of-Way line of
Bowling Avenue, 87.4 feet to a steel pin on the northeast comer of said Lot 6, THE
TRUE PLACE OF BEGINNING:
Thence continuing S.2017'02"W., along said Right-of-Way line, 61.38 feet;
Thence N.43018'29"W., 85.93 feet to a steel pin on the north line of said Lot 6;
Thence S.88052'58"E., along said north line, 61.4 to THE TRUE PLACE OF
BEGINNING.
Containing 1884 square feet, and being subject to all easements of record.
Being a part of Lot 7, in Block 8 of Louis and Mary Schneck's Subdivision, (as
shown in Plat Book 4, Page 40), in Clarksville, Clark County, Indiana and being further
described as follows:

Whereas the purpose of the de-annexation and re-annexation by City of
Jeffersonvilleis to allow Serenity, Inc, a not-for-profit organization providing a half-way
house for special needs' individuals which is located partially in Clarksville and partially
in Jeffersonville, to have one unified governance for the purpose of emergency
responders and it is in the best interest of all concerned to have one geographic boundary
within one single corporate entity.
Whereas a public hearing was scheduled and notice was published in the
Jeffersonville Evening News on July 23,2006. A copy of the publisher's claim has been
provided to the Clerk-Treasurer.
Whereas the public hearing has been conducted.
Whereas all consents of all property owners have been forthcoming.
Whereas there is no issue of contention.
Whereas said property was officially de-annexed by the Town of Clarksville on
August 8, 2006.
Whereas this is in the public good that there are no disputes and this hereby
ordained to re-annex the above described real estate for the expressed purpose of being in
the City of Jeffersonville.
That this is an emergency and the re-annexation shall take place immediately with
consent of Jeffersonville to the annexation by Jeffersonville.

Notice is hereby given to all residents of Jeffersonville, Indiana and to all
interested parties within Clark County, Indiana, pursuant to IC 36-4-3-5.1, that on

In like manner, the Board petitions the City of Jeffersonville to annex this tract of
land into the City of Jeffersonville. In further support of this motion, the Petitioner says
as follows:
1. That Serenity, Inc. is a not-for-profit corporation providing a half way
house for special needs individuals which is located partially in the Town
of Clarksville and partially in the City of Jeffersonville.
2. For purposes of clarity and convenience of matters of zoning, regulations
and emergency responders, it would be in the best interest of all parties
that the entire operation and campus be located within the geographic
confines of one entity or the other.
3. Pursuant to an agreement with each Planning and Zoning Department, it
__ was determined that more of the property would be better served by being
- in the City of Jeffersonville. Therefore, the ultimate goal is to have the
entire campus of Serenity, Inc. within the geographic confines of the City
of Jeffersonville.
4. That a tract of land inclusive of the description belongs to the State of
Indiana, Department of Transportation. Sir James Ude of the Indiana
Department of Transportation has consented to the annexation.
S. That otherwise all parcels of land are owned by the same common chain
of title.
6. No fiscal plan is required since all services are readily available.
7. No tax impact will be had since this is a not-for-profit corporation and
shall remain a not-for-profit corporation.
8. That a public hearing should be held in both Clarksville and Jeffersonville,
notice of the hearings be published and the matter schedule for such
hearings.
9. That an Ordinance of De-Annexation is requested from the Town of
Clarksville and an Ordinance of Annexation is requested form the City of
Jeffersonville all in accordance with the applicable provisions of Chapter 3
of Article N, Title 36, of the Indiana Code.
10. That this Petition is filed in duplicate with original consent of the Indiana
State Department of Transportation.
