BEFORE THE JEFFERSONVILLE COMMON COUNCIL
ORDINANCE NO. 2006-0R-45
AN ORDINANCE CHANGING THE ZONING MAP DESIGNATION OF A
CERT AIN TRACT OF PROPERTY DESCRIBED AS BEING PART OF
BLOCK 150 IN THE CITY OF JEFFERSONVILLE, CLARK COUNTY
INDIANA, CONTAINING 19,316 SQUARE FEET FROM IS: INSTITUTIONAL
TO R3: OLD CITY RESIDENTIAL.
Whereas, The Jeffersonville Housing Authority. has filed a petition before the
Jeffersonville Plan Commission to change the zoning map design~tion of the real
property described in the attached "Exhibits "A"- "C" from IS: Institutional to R3: Old
City Residential; and,
Whereas, on August 29,2006 the Jeffersonville Plan Commission has certified to
the Council a favorable recommendation concerning the proposed change to the City's
zoning map; and,
Whereas, this matter is now before the Common Council at its regular meeting
after certification of the proposed change of zoning map designation pursuant to the
provisions ofLC. 36-7-4-608(f)(1); and,
Whereas, this Common Council has timely posted notice of its intent to consider
the proposed change of zoning map designation at the regular meeting scheduled for
September 5,2006 at 7:30 o'clock p.m.; and,
Whereas, all interested persons having been given an opportunity to appear
before this Common Council and be heard regarding this matter as required by law.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City
of Jeffersonville, Indiana, that the zoning designation of the real property described in the
attached "Exhibits "A" - "C"is hereby changed from IS: Institutional to R3: Old City
Residential; and .
IT IS FURTHER ORDAINED that the zoning map of the City of Jeffersonville
shall be amended to include such change.
This ordinance shall be in full force and effect upon its adoption.

Being a part of Block 150 in the City of Jeffersonville, Clark County, Indiana and being further
described as follows:
Beginning at the western most comer of Lot 9 in New Claysburg Subdivision, Sector Number Four as
shown in Plat Book 9, Page 5 of said County records; Thence S.31 oll'08"E., along the southwestern line of said
Lot 9, 122.3 feet to the northwestern Right-of-Way line of Martin Circle; Thence along said Right-of-Way line,
22.15 feet along the arc of a 50 foot radius curve turning to the left (concave southeasterly) with a chord bearing
ofS.28040'10" W., 21.97 feet; Thence continuing along said Right-of-Way line, 18.69 feet along the arc of a 25
foot radius curve turning to the right (concave northwesterly)with a chord bearing of S.37023'52"W., 18.26 feet;
Thence S.58048'52"W., along said Right-of-Way line, 104.01 feet; Thence N.31 oll'08"W., 140 feet; Thence

IN RE THE APPLICA TIONOF
THE JEFFERSONVILLE HOUSING
AUTHORITY TO REZONE A CERTAIN
TRACT OF PROPERTY DESCRIBED AS
211 AND 213 MARTIN CIRCLE FROM
IS: INSTITUTIONAL TO R3: OLD CITY
RESIDENTIAL.
CERTIFICATION OF FAVORABLE RECOMMENDATION
OF PROPOSED ORDINANCE
Whereas, The Jeffersonville Housing Authority f1led a petition before
the Jeffersonville Plan Commission to change the zoning designation of the
property described in attached Exhibits "A" - "c" (the "Property"), from IS:
Institutional to R3: Old City Residential, and;
Whereas, after proper notice by publication, the Jeffersonville Plan
Commission held a public hearing on the petition on August 29,2006; and,
Whereas, at the conclusion of the hearing the Jeffersonville Plan
Commission voted by a majority vote of its entire membership to favorably
recommend the proposed change of zoning designation of the Property to the
Jeffersonville Common Council.
IT IS THEREFORE CERTIFIED that on August 29,2006, the
Jeffersonville Plan Commission favorably recommended that the Jeffersonville
Common Council enact by ordinance the proposed zoning designation change
of the property from IS: Institutional to R3: Old City Residential as requested
in the petition of The Jeffersonville Housing Authority.

NOTICE OF INTENT TO CONSIDER PROPOSED CHANGE OF ZONING MAP
Notice is hereby given that on September 5, 2006 at 7:30 o'clock p.m. in the
Council Chambers, First Floor, Jeffersonville City Hall, 500 Quartermaster Court,
Jeffersonville, Indiana, the Common Council of the City of Jeffersonville, Indiana,
intends to consider an ordinance, which, if adopted, would change the zoning map
designation of the following described property from IS: Institutional to R3: Old City
Residential.
DESCRIPTION OF PROPERTY LOCATED IN
THE CITY OF JEFFERSONVILLE
PROPERTY ADDRESS: Certain tract of property described as 19,316
square feet in Block 150 (former Ken Ellis Center) located at 211 and
213 Martin Circle.
The Jeffersonville Plan Commission made a favorable recommendation
concerning the adoption of an ordinance enacting this proposed change of zoning map
designation after notice and hearing on August 29,2006. All interested persons are
invited to attend and be heard regarding this matter. This Jeffersonville Common
Council meeting may be continued from time to time as found necessary. The
Jeffersonville Common Council may take official action at the conclusion of debate at
this meeting.
Such notice given and posted this 30th day of August 2006.
