HomeMy WebLinkAbout2006-OR-32ORDINANCE NO. 2006-OR- 32 AN ORDINANCE ESTABLISHING PARKS DEPARTMENT NON-REVERTING FUNDS WHEREAS, the City of Jeffersonville Parks and Recreation Board (the "Board") is organized under the provisions of Indiana Code 36-10-3; and; WHEREAS, I.C. 36-1-10-22 permits the creation of a special, non-reverting operating fund for reasonable recreational activity fees, and; WHEREAS, from time to time the Jeffersonvilie Parks and Recreation Board through efforts of the Parks Department earns or comes into possession of moneys that are obtained from sources other than taxes upon the property of the citizens of the City of Jeffersonville, Indiana; and WHEREAS, it is eConomically desirable to create such fund for the management of certain monies charged by the Board as reasonable recreational activity fees and to provide for the disbursement thereof. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Jeffersonville, Indiana, as follows: .¸ Two (2) special non-reverting operating funds are hereby established for the purpose of receiving and holding activity fees charged by the Jeffersonville Parks and Recreation Board. 2. One fund shall be entitled "Department of Parks and Recreation Board Non-Reverting Fund for the Aquatic Center" where all activity fees collected from the operation of the Jeffersonville Aquatic Center shall be deposited. 3~ Another fund shall be entitled "Department of Parks and Recreation Board Non-Reverting Fund" where all other activity fees collected by the Jeffersonville Parks and Recreation Board shall be deposited. The monies may be expended from either fund only upon the filing of a proper claim in issuance of a warrant for payment by the Clerk-Treasure~r after appropriation by the Board except the monies in the "Department of Parks and Recreation Board Non-Reverting Fund for Aquatic Center' shall be solely expended for the Operation and maintenance of the Aquatic - Center. 5. Hereafter, the Clerk-Treasurer shall not deposit monies the Jeffersonville Department of Parks and ReCreation, receives as activity fees into the City's General Fund, but shall deposit those fees into the appropriate non.- reverting fund. 6. That the Board is hereby required to use these Non-Reverting Funds to the extent and in the manner allowed by law. 7. That Ordinance No. 99-OR- is hereby repealed and replaced herein. This Ordinance shall be in full force and effect from and after its passage and approval. Passed and adopted this Clerk and Treasurer ,2006.
