HomeMy WebLinkAbout04-17-2006COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CiTY OF JEFFERSONVILLE, INDIANA April 17, 2006 The Common Council of the City of Jeffersonville, Indiana met in regular session in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana, at 7:30 P.M. on Monday April 17, 2006. Mayor Rob Waiz, with Clerk Treasurer Peggy Wilder at the desk, called the meeting to order. Also present were City Attorney Les Merkley and Deputy Clerk Barbara Hollis. Mayor Waiz welcomed all in attendance, asking all those present to stand as Street Commissioner Pon Ellis gave the invocation. Mayor Waiz then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were; Councilpersons John Perkins, Keith Fetz, Connie Sellers, Barbara Wilson, Phil McCauley, and Ron Grooms. Absent: Ed Zastawny. Following discussion, Councilperson Fetz made the motion to approve the agenda with the following changes: add as agenda item #gA Team Jeff Wrestling, add as agenda item #9B Jeffersonville Fire Department, remove agenda item #10, remove agenda item #15, replacing it with a zoning request, table agenda item #19 until May 1, 2006, remove agenda item #21 replacing it with an additional appropriation ordinance, second by Councilperson Sellers, passing on a vote of 6-0. Mayor Waiz presented the minutes for consideration by the Council. Council President Wilson made the motion to approve the minutes of April 3, 2006 as presented, second by Councilperson McCauley, passing on a vote of 6-0. Clerk Treasurer Wilder presented the claim list for consideration by the Council explaining one additional claim to Golden Twist. Councilperson Fetz made the motion to approve the claims as presented, second by Councilperson Grooms, passing on a vote of 5-0-1. Councilperson Perkins abstained from the vote. PUBLIC COMMENT: April 17, 2006 2 Mr. Derek Spence appeared before the Council expressing his concern for the changes that will be made in the County recycling program. He hopes the City will continue as some grants could be in jeopardy. AGENDA ITEMS: Councilperson Fetz introduced JeffTeam Wrestling Coach Danny Struck. Coach Struck thanked the Council for their donation last year to the wrestler's cultural exchange program. This year 6 team members have qualified to travel to Turkey and each need to raise $2,600. Team members present Robby Ferguson, Richard Hayes, Mark Fridley, and Dominique Smith introduced themselves, telling the Council what it meant to them to be a part of this program. Tyler Tatgenhorst and A. J. Castro will also travel w/th the team. Councilperson Fetz made the motion to donate $250 per student from the special projects line in the Council budget, challenging Mayor Waiz to match the amount. Councilperson Perkins made the second suggesting the students be given City of Jeffersonville gifts. Councilperson Grooms is concerned with the amount. The motion passed on a vote of 5-1 with Councilperson Grooms voting against passage. Fire Chief Clark Miles appeared before the Council to explain the need for a vehicle replacement program for his department. There is a current need to replace two vehicles. Assistant Chief Tony Decker explained the vehicle status. Jeff Boat made a $10,000 contribution to the Fire Department, which they would like to use to pay the lease for two cars this year. They are requesting financial support from the Council for 2007. Councilperson Fetz asked if they would check the State bid list. Councilperson Perkins asked if the original plan was for the Fire Department to get one of the cars ordered by the Police Department. Councilperson Sellers said she hates leasing but realizes the department has to have cars. Discussion followed regarding leasing or purchase. Following all discussion the Council gave their support to the Fire Department for two cars, asking they research purchase and financing options. Street Commissioner Ron Ellis appeared before the Council to request passage of a Resolution To Advertise For An Additional Appropriation. Commissioner Ellis explained the need to purchase two street sweepers. Following discussion, Councilperson Grooms made the motion to pass Resolution No. 2006-R-24 in the amount of $165,000, second by Councilperson President Wilson, passing on a vote of 6-0. Apfil17,2006 3 Park Superintendent Rob Poff appeared before the Council explained the need for passage of Ordinance No. 2006-OR-26, An Ordinance To Utilize Debit Credit Card At Parks Office And Aquatic Center. At the conclusion of all discussion, Councilperson Perkins made the motion to suspend the rules for Ordinance No. 2006-OR-26, second by Councilperson Sellers, passing on a vote of 6-0. motion to pass Ordinance No. 2006-OR-26 Councilperson Sellers, passing on a vote of 6-0. Councilperson Perkins then made the on all three readings, second by Councilperson Perkins said he is still working on the animal control ordinance. He asked Mr. Mike Hutt to relay in incident to the Council. Mr. Hutt explained his daughter was walking her dog when a bulldog came off a porch and attacked her dog. Councilperson Sellers stressed the importance of calling the Animal Control Officer. Ordinance No. 2006-OR-23, An Ordinance Changing The Zoning Map Designation Of A Certain Tract Of Property Described As Being Part Of Survey No. 10 Of The Illinois Grant In The City Of Jeffersonville Containing A 21.62 Acre Tract More Or Less Located At 1224 Reeds Lane From M2: Multifamily Residential To PD-M2: Planned Development-Multifamily Residential, was presented for a public heating. Planning and Zoning Director Hicks explained the area and the plans saying there is a concern for commemial use. Councilperson Grooms expressed his concern for the location of the project to the quarry. Following discussion, Councilperson Perkins made the motion to table Ordinance No. 2006-OR-23 and continue the public heating, second by Councilperson Sellers. City Attorney Merkley asked for public comment. As no public comment was heard, the motion passed on a vote of 6-0. City Attorney Merkley explained the need for passage of Ordinance No. 2006- OR-19, An Ordinance Amending 2005-OR-80, Which Amended 2005-0-53, Which Amended 2006-OR-2, An Ordinance Fixing Basic Salaries Of Appointed Officers And Employees Of The City Of Jeffersonville, Indiana For The Year 2006. Councilperson Grooms made the motion to pass Ordinance No. 2006-OR-19 on the second reading, second by Councilperson McCauley. Ordinance 2006-OR-19 passed on the second reading on the following roll call vote: Ayes: Councilpersons McCauley, Grooms, Wilson, and Sellers. Nays: Councilpersons Fetz and Perkins. April 17, 2006 4 Clerk Treasurer Wilder explained the 2006 DLGF Fund Report, suggesting the Council pass an additional appropriation in the amount of $250,000 in the General Fund to cover the Aquatic Center bond payment. Councilperson Perkins asked if the overhead for the pool is paid from the Park General Fund. The pool revenue is deposited into the Park Special Non Reverting Fund. The bond payment and the overhead for the pool are paid from the Park General Fund. Councilperson McCauley explained the ordinance. Councilperson McCauley does not believe it was the intent of the Council at the time the bond was issued to have the revenue go the non-reverting fund. It was not the intent to put the revenue in one area and the expenses in another. Councilperson Perkins remembers the intent was to have pool revenue offset pool expenses. Parks Superintendent Poff said some supplies and salaries are paid from pool revenue. Clerk Treasurer Wilder stressed the need to have the Park Special Non-Reverting Fund budget approved by the Council. Following all discussion, Councilperson Perkins made the motion to pass Resolution No. 2006-R~27, A Resolution To Advertise For An Additional Appropriation (General Fund - $250,000), second by Council President Wilson, passing on a vote of 6-0. Councilperson Grooms introduced Mr. Ken Janes and Ms. Faye Allen representing Jeffersonville Boys And Girls Club. Mr. Janes explained the mission and the programs, requesting a $5,000 donation. Councilperson Grooms explained the history of a promised donation. Councilperson Grooms then made the motion to approve a $5,000 donation to the Jeffersonvil!e Boys And Girls Club for 2006, second by Councilperson Sellers, passing on a vote of 6-0. Clerk Treasurer Wilder presented and explained a record retention schedule. Following discussion, Councilpersun Perkins made the motion to approve the guidelines as presented by Clerk Treasurer Wilder, second by Councilperson Fetz, passing on a vote of 6-0. City Attorney Merkley presented and explained the need for passage of Ordinance No. 2006-OR-24, An Ordinance Of Additional Appropriation (General Fund - Department of Law). Councilperson Grooms made the motion to pass Ordinance No. 2006-OR-24 on the first reading. Discussion followed regarding a draft of a contract for legal services. Councilperson Perkins feels the contract should be in place prior to Aprill7,2006 5 approving the additional appropriation and salary Ordinance. Councilperson Fetz agrees. Mayor Waiz was asked to get an additional legal opinion. Councilperson Perkins has concerns regarding the bond work portion. The motion passed on the following roll call vote: Ayes: Councilpersons Sellers, Wilson, Grooms, and McCanley. Nays: Councilpersons Perkins and Fetz. CLERK TREASURER COMMENTS:, There were no Clerk Treasurer Comments. COMMITTEE REPORTS: Councilperson Perkins said the annexation meeting had to be put off. He hopes to be back on track soon. Councilperson Fetz gave an Ethics Committee update, inviting Mayor Waiz to the next meeting. Councilperson Grooms noted Councilperson McCauley has done a fantastic job chairing the TIF Committee. COUNCIL AND MAYOR COMMENTS: Councilperson McCauley feels the 2007 budget will be difficult and challenging. Councilperson Grooms commented on Solid Waste and the garbage Ordinance he is working on. Councilperson Grooms feels that the presence if a Police Officer is needed. Council President Wilson feels the merger of the Chamber and Southern Indiana 2020 will be good and will benefit all of Southern Indiana. Councilperson Sellers reminded all about the upcoming golf scramble. She also gave an update on the work of Ms. Comett. Councilperson Fetz thanked all for the donation for the wrestling team noting it is important to get involved with the youth. Councilperson Perkins noted in the last 16 months Redevelopment has had one project. He asks that the Council rethink the pay system for Kathy Haller. Councilperson Perkins noted some of the drywall at City Hall has been hung incorrectly. Mayor Waiz will talk with Corky Scales.
