BEFORE THE COMMON COUNCIL
OF THE CITY OF JEFFERSONVILLE, INDIANA
ORDINANCE GRANTING PETITION TO VACATE
A PUBLIC WAY
IN TltrE CITY OF JEFFERSONVILLE
Comes now Nancy Flyrm, (Flyrm), having heretofore filed her Petition to Vacate a Portion
of a Public Way in the City of Jeffersonville, which Petition is attached hereto as Exhibit A, and
incorporated herein by reference.
In support of this Petition, Flynn states as follows:
1. The best use of the alley would be to allow it to be vacated;
The vacation of the alley as described herein would not injure the public health,
safety or morals of the community, and
It would be in the best interest of the adjoining property owners and Flynn to grant
the Petition set forth above.
WItEREFORE, the Council having examined and heard evidence on said Petition mad
being duly advised in the premises, now finds that said Petition should be GRANTED.
NOW THEREFORE, IT IS HEREBY ORDAINED by the Common Council of the
City of Jeffersonville, pursuant to the provisions of I.C~ 36-7-3-12, that the public right of way
located in the City of Jeffersonville, Clark County, Indiana, as legally described on Extfibit "A"
attached hereto and incorporated herein by reference is hereby vacated; and
IT IS HEREBY FURTHER ORDAINED that the Clerk-Treasurer is hereby instructed
to record a copy of this Ordinance in the Office of the Clark County Recorder and deliver a copy
of this Ordinance to the Clark County Auditor.
This Ordinance shall be in full force and effect from and after its adoption and approval.

PETITION TO VACATE A PUBLIC WAY
IN THE CITY OF JEFFERSONVILLE
Petitioner, Nancy M. Flynn, petitions the City Council to vacate a piece of property more
specffically described as Forty-Eight Feet ( 8 ) of Twenty Feet (20') North-South Alley,
connecting EE 6 and EE 5 in Benson Addition Block No. 7 being situated in Jeffersonville, Clark
County, Indiana.
In support of this petition, the City states as follows:
1. The names and addresses of all owners of land abutting the property are:
John and Mary Pardon, 940 E. Court Avenue
2. That this piece of property is a public alley;
That this piece of property is an unimproved alley and is being used by the general public
as an ingress and egress to an apartment complex located on the Northwest comer of
Maple and Graham Streets. This use by the public has caused the alley to incur deep
muddy ruts. This apartment complex has street parking facilities on both Maple and
Graham Streets, and also a driveway to the rear of the complex available for use;
4. That for the past 25 years Petitioner has maintained the property proposed to be vacated;
5. The vacation of the property as described herein would not injure the public health,
safety, or morals of the community.
6. It would be in the best interest of the City of Jeffersonville to grant the petition set forth
above.
WHEREFORE, it is requested, pursuant to the provisions of I.C. 36-7-3-12, that the City
of Jeffersonville vacate the above described property.

NOTICE OF HEARING ON PETITION TO VACATE
A PUBLIC WAY
Notice is hereby given that Petitioner, Nancy M. Flyrm, has filed a Petition with
the Jeffersonville City Council, Jeffersonville, Indiana asking for the vacation of a piece
of property, more specifically described as follows: 48 ft. ora 20 ft. North-South Alley,
connecting EE 6 and EE 5 in Benson Addition Block No. 7 in the City of Jeffersonville.
A public hearing will be held on November 7, 2005 at 7:30 p.m. in the multi-
purpose hearing room on the third floor of the City-County Building at 501 E. Court
Avenue, Jeffersonville, Indiana at which time and place all interested persons will be
heard in reference to the matters set out in said petition.
