Home My WebLink About2005-R-19RESOLUTION NO. 2005-R- A RESOLUTION APPROVING AND~TIFYING INTERLOCAL AGREEMENT BETWEEN THE CITY OF JEFFERSONVILLE, INDIANA AND THE BOARD OF COMMISSIONERS OF CLARK COUNTY, INDIANA WHEREAS, the Common Council of the City of Jeffersonville, Indiana (hereinafter "the City") by and through its BOard of Public Works and Safety and the Board of Commissioners of Clark County, Indiana (hereinafter referred to as "the Commissioners"), entered into an Interlocal Agreement for Road-Related Services, (Installation of signal and mm lanes on Allison Lane at Seminole Drive and Jeffersonville High School); and WHEREAS, this Agreement shall remain in effect from the time of the execution and approval of this Agreement by the appropriate entities until' the project is completed, which shall be no later than four (4) years from the execution and approval of the Agreement. . WHEREAS, this Agreement is made between the County and the Municipality for purposes concerning highway construction and maintenance and related matters; WHEREAS, this Agreement shall be administered jointly by the Clark County Engineer (representing the interests of the executive and fiscal bodies of the County) and the City of JeffersonVille Engineer (representing the interests of the executive and the fiscal body of the Municipality); WHEREAS, the Common Council believes that it is in the best interest of the City to enter into this Interlocal Agreement; NOW THEREFORE, IT IS HEREBY RESOLVED that the Common Council of the City of Jeffersonville does hereby approve and ratify the Interlocal Agreement for Road-Related Services (Installation of signal and turn lanes on Allison Lane at Seminole Lane and Jeffersonville High School). I.C. 36-1-7-3(2) Pursuant to I.C. 36-1-7-9 (a), this Agreement is made between the' County and the Municipality for purposes concerning highway construction and. maintenance and related matter. I1. Pursuant to I.C. 36-1-7-9(b) 2, the specific functions and services to be performed under this Agreement are as follows: install signal and turn lanes on Allison Lane at Seminole Drive and Jeffersonviile High School entrance. ING/,COMP E._NSAT!ON/REI..M B U RSEM E NT: The construction and construction inspection phases of this project will be funded through the Kentuckiana Regional Planning and Development Agency (KIPDA) using Federal Aid Funds. The total estimated construction and inspection costs for project are estimated in the sum of $110,000.00 ($88,000.00 from federal- funds with the $2.2,000.00 balance to be funded by local matches provided by the County and the Municipality). Both the County and · the Municipality shall be responsible for one-half of the local match ~5/19/20E15 12'45 2856468 JEFF" PAGE estimated in the sum of $11,000.00 each, plus one-half of the following costs' $2,314.08 payable to Jacobi, Toomb$ & Lanz, and $4,500.00 payable to Kloeker Engineering Co. The construction bids will be received by the Indiana Department of Transportation (INDOT)..Once the Iow bidder is determined INDOT will request the 20% Local Match from the municipality, who will in turn, submiit a claim to the County for one-half of said deposit, plus $1,500.00 to cover the County's portion of the Local Ma~ch for construction inspection, which will be paid to the consultant directly by the City. 83/8G B. STAFFING' The County and the Municipality shall not be expected to provide any staffing except for their respective engineering departments. V~ VI. C, SUPPLIES' The County and the Municipality shall net be expected provide any supplies. D. MAINTENANCE: The Municipality shall be-responsible for the operation and maintenance related to the signal once construction is completed. TERMINATION ,O.,F THE AGR..EEMENT,I;,C. 36- ,~ -7-3 (4) This Agreement shall be terminated upon the full completion of the services.and functions as set forth in Section I above and upon full compensation and reimbursement as set forth in Section I11 (A) above. in addition, this Agreement may be terminated upon the written agreement of ali the parties to this Agreement.
