HomeMy WebLinkAbout2001-OR-14 Ordinance No. 2001-OR- \~ ORDINANCE AMENDING ORDINANCE NO. 90-OR-60, KNOWN AS THE JEFFERSONVILLE SEWER RATE ORDINANCE WHEREAS, periodic stLmmer droughts create an extraordinary situation in which many citizens of Jeffersonville must engage in heavy sprinkling of their lawns and residential yard vegetation; and WHEREAS, the City of Jeffersonville [sewer rates] are based solely upon total water usage by each residential address; and WHEREAS, the City of Jeffersonville believes that some relief to homeowners should be available from extraordinarily high sewer charges attributable to la~vn and yard vegetatiOn sprinkling during such periods of time. NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Jeffersonville that Ordinances No. 90-OR-69 and 98-OR-26 are hereby amended to include the following provision: SECTION 4 In order that domestic and residential users of Sewage services are not penalized for the sprinkling of lawns during the months of June, July, and AUgust, the billing for [sewage] treatment service for residents and/or domestic users for the months of June, July, and August of each year will be based upon the average water usage for the immediately preceding months of January, February, and March. In the event that the water usage for the preceding months of January, February, and March, is greater than the water use for the months of June, July, and August, then the billing for sewage service will be computed on the actual water used in the month for which the sewage service bill is rendered. Domestic and/or residential sewage service, as applicable to the sprinkling rate, applies to each lot, parcel or real estate or building that is occupied and used as a residence. The sprinkling rate does not apply to any premises that are partially or wholly used for industrial or commercial purposes. The Common Council further recognizes that adoption of this sprinkling credit will reduce Sewer Department revenues. If the reduction results in net revenues below either the level required to fund the amount necessary to cover the City's obligation for repayment of bond indebtedness, the Common Council must adjust the sewer user rates in a manner that will meet all such outstanding obligations of the utility. All other Ordinances, Resolutions, or parts thereof in conflict with the provisions and intent of this Ordinance are hereby repealed. This Ordinance shall be in full force and effect upon its timely passage, promulgation and approval by the Mayor. M:\Legal\Ordinance~Xanending Ordinance 90-OR-60 Sewer Rate Ordinance.doc ORDINANCE NO. 91-OR- ORDINANCE AMENDING ORDINANCE NO. 90-OR-60, COMMONLY KNOWN AS THE JEFFERSONVILLE SEWER RATE ORDINANCE WHEREAS, the 1991 sununer drought has created an extraordinary situation in which many citizens of jeffersonville have had to engage in heavy sprinkling of their lawns and residential yard vegetation; and, WHEREAS, the sewer rates of the city of jeffersonville in order to conform with the user charge system requirements of the Indiana DeP~rtment of Environmental Management and the United States Environmental Protection Agency are based solely upon total water usage by each residential address; and, WHEREAS, the City of jeffersonville believes that some relief to homeowners should be available from extraordinarily high sewer charges attributable to lawn and yard vegetation sprinkling during such periods of time. OREM ORDINANCE NO. 98-OR-,~ AN ORDINANCE AMENDING PORTIONS OF ORDINANCE NO. 90-OR-60 ESTABLISHING SEWER RATES FOR THE CITY OF JEFFERSONVILLE WHEREAS, the City of Jeffersonville (hereinafter "the City") has heretofore constructed and has in operation a sewage works for the purpose of collecting and disposing of sewage in a sanitary manner; and WHEREAS, the City has not increased its sewer rates in the past eight (8) years; and WHEREAS, the City's cost of operating the sewage works has increased significantly in the past eight (8) years; and WHEREAS, the existing sewer rates are inadequate to provide the necessary capital for future repair and replacement of the sewage works; and WHEREAS, the Common Council of the City of Jeffersonville (herinafter "the Council") believes that it is in the best interest of the City's residents to fairly spread the cost of capital repairs and replacement of the sewage works among those who use the sewage works' capacity; and WHEREAS, the City intends to borrow funds from the State Revolving Fund to finance repairs to the sewage works; and WHEREAS, an examination of the existing schedule of rates and charges heretofore fixed by ordinances of the City fails to meet the requirements of the State Revolving Fund for retirement of the City's proposed debt. NOW THEREFORE, BE IT HEREBY ORDAINED that the existing provisions of ORDINANCE No. 90-OR-60 Section 3 (a) and (b) are hereby repealed and replaced by the following provisions: (a) Metered Water Users: The sewage rates and charges shall be based on the quantity of water used on or in the property or premises subject to such rates and charges, as the same is measured by the water meter there in use, subject to a minimum charge, except as herein otherwise provided. For the purpose of billing and collecting the charges for sewage service, the water meteors shall be read periodically, either monthly or such other period as is established by the Board of Public Works. The water usage schedule on which the amount of said rates and charges shall be determined is as follows: (1) Inside the City limits of the City of Jeffersonville: (i) Metered Rates: Average Quantity of Water Used Per Month First 1000 cubic feet 1001 to 11,000 cubic feet Over 11,000 cubic feet Monthly Rate Per 100 Cubic Feet User Debt Charge .Service Total $1.41 $ 1.08 $ 2.49 1.41 .91 2.32 1.41 .73 2.14 (ii) Minimum Charge Rate Per Month User Debt Charge Service Total Per month $ 2.40 $6.24 $ 8.64 (2) Outside the City limits of the City of Jeffersonville (i) Metered Rates: Average Quantity of Water Used Per Month (ii) First 1000 cubic feet 1001 to 11,000 cubic feet Over 11,000 cubic feet Minimum Charge Per month Monthly Rate Per 100 Cubic Feet User Debt Charge Service Total $ 1.41 $ 2.32 $ 3.73 1.41 2.08 3.49 1.41 1.98 3.39 Rate Per Month User Charge $ 2.40 Debt .Service Total $ 10.55 $12.95 (b) Unmetered Water Users: 2 For single family residential users of the sewage works that are unmetered water users or for whom accurate meter readings are not available, the monthly charge shall be determined as an average of single family dwelling units, except as herein provided. Sewage service bills shall be rendered once each month. The rate shall be as follows: (1) Inside the City limits of the City of Jeffersonville: User Debt Char.qe Service Total Per month $10.30 $ 7.74 $18.04 (2) Outside the City limits of the City of Jeffersonville: User Debt CharRe Service Total Per month $ 10.30 $16.72 $27.02 NOW THEREFORE, BE IT HEREBY FURTHER ORDAINED that the existing provisions of ORDINANCE No. 90-OR-60 Section 5(a) are hereby repealed and replaced by the following provisions: (a) Normal domestic waste strength sewage should not exceed a biochemical oxygen demand of 300 milligrams per liter of fluid, suspended solids in excess of 300 milligrams per liter of fluid or ammonia nitrogen in excess of 15 milligrams per liter of fluid. Additional charges for treating stronger-than-normal domestic waste shall be made on the following basis: (1) Rate Surcharqe Based Upon Suspended Solids There shall be an additional charge of 22 cents per pound of suspended solids for suspended solids received in excess of 233 milligrams per liter of fluid. (2) Rate Surchar.qe Based Upon BOD There shall be an additional charge of 22 cents per pound of biochemical oxygen demand for BOD received in excess of 244 milligrams per liter of fluid. (3) Rate Surcharqe Based Upon NH3N There shall be an additional charge of 75 cents per pound of ammonia for NH3N received in excess of 20 milligrams per liter of fluid. NOW THEREFORE, BE IT HEREBY FURTHER ORDAINED that the rates and charges as herein set forth shall become effective on the first full billing period occurring after the adoption of this ordinance. passed this.
