A RESOLUTION APPROVING STATEMENT OF BENEFITS FOR PURPOSES OF
PROPERTY TAX ABATEMENT
WHEREAS, DIAMOND BILLIARDS, INC. has petitioned the Common Council of the
City of Jeffersonvilte, Indiana, for a d6duction in personal property taxes to be assessed
on proposed new manufacturing equipment in the Bridgeport Business Center, located in
the City of Jeffersonville, Clark County, Indiana; and
WHERAS, DIAMOND BILLIARDS, liNC. has submitted a Statement of Benefits on the
form prescribed by the Indiana State Board of Tax Commissioners for such purpose,
which statement includes a description of redevelopment, an estimate of the number of
individuals who will be employed as a result of the redevelopment, an estimate of the
annual salaries of these individuals, and an estimate of the value of the project; and
WHERAS, the Common Council of the City of Jeffersonville has previously determined
that the area in which the proposed project is located in the City of Jeffersonville
qualifies as an economic revitalization area pursuant to Indiana Code 6-1.1-12.1 et seq.,
and Resolution 97-R-10 and Confirmii~g Resolution 97-R-14; and
WHEREAS, The common Council has reviewed the Statement of Benefits submitted
herein, and attaches and incorporates the Statement to this Resolution;
NOW THEREFORE, BE IT HEREBY RESOLVED by the Common Council o~itl-ie cit5/
of Jeffersonville. Indiana, that it specifically and affirmatively finds as follows:
That the estimate of the value of the redevelopment is reasonable for projects
of the nature described in the Statement of Benefits submitted by the
petitioner.
That the estimate of the number of individuals who will be employed or
whose employment will be retained can reasonably be expected to result from
the proposed described manufacturing machinery project.
That the estimate of the annual salaries of those individuals who will be
employed or whose employment will be retained can reasonably expected to
result from the proposed described manufacturing machinery project.
That all other information requested from the Applicant has been submitted,
and the benefits described ih such information can reasonably expected to
result from the proposed described project.
That the totality of benefits for said redevelopment is sufficient to justify the
deduction.
BE IT FURTHER RESOLVED, that the Common Council of the City of
Jeffersonville, Indiana. hereby approves the application and Statement of Benefits as
presented filed by the applicant, and that said applicant shall be entitled to deductions
for a period of five (5) years for equipment and machinery pursuant m I.C.6-1.1-12.1-
4.5, with timely filing and perfection thereof with the Clark County Auditor's Office.

2. Approva of the designating body ( C ty Council, Town Board, County Council, etc.) must be obtained prior to initiation of the redevelopment or rehabilitation,
or pdor to installation of the new manufacturing equipment and or research and development equipment, B£FORB a deduc ion may be appreved.
3. To obtain a deduction, Form 322 ERA, Real Estate Improvements and / or Form 322 ERA I PPME and / or 322 ERA I PPR & DE, must be filed with the
county audito~ With respect to real properS4, Form 322 ERA must be filed by the later o~' (!) May 10; or (2) thidy (30) days after a notice of increase in real
property assessment is received from the township assesse~ Form 322 ERA I PPME and I or 322 ERA PPR & DE must be filed between March '/ and May
f5 of the assessment year in which new manufacturing equipment and I or research and development equipment becomes assessable, unless a filing
extension has been obtained. A person who obtains a filing extension must file the form between March I and the extended due date of that year:
4. Proper~y owners whose Statement of Benefits was approved after June 30, 1991 must submit Form CF - f annually to show compliance with the Statement
of Benefits, (lC 6- f . f -12.1- 5,6)
5. The schedules established under lC 6- '/. '/-12. f -4(d) and lC B-~'.'/-12. %4.5 (e) effective July f, 2000 apply to any statement of benefits filed on or after
July 1, 2000.
The schedules effective prior fo July 1, 2000 shall continue to apply to those statement of benefits filed before July '/, 2000.

1. Within forty-five (45) days after receipt of this form, the designating body may determine whether or not the property owner has substantially complied with
the Statement of Benefits.
2. If the pr~perty ~wner is f~und N~T to be in substanfia~ compfiance~ the designafing b~dy shafi send the property ~wner written n~tice~ The n~t~ce must incIude
the reasons for the determination and the date, time and place of a headng to be conducted by the designating body. If a notice is mailed to a property owner
for new manufacturing equipment end I er research and development equipment, a copy of the written notice shall be sent to the State Board of

3. Baaed on the information presented at the hearing, the designating body shall determine whether or not the property owner has made reasonable effort to
substantially comply with the Statement of Benefits.

A property owner whose deduct on s den ed by the designatlng body may appeal the designating body's decision by filing a complaint
in the office of the Circuit or Superior Court together with a b!ond conditioned to pay the costs of the appeal if the appeal is determined
against the property owner.

WHEREAS, GREAT DANE POWER EQUIPMENT, INC. has petitioned the
Common Council of the City of Jeffersonville Indiana, for a deduction in real
property and personal property taxes to be assessed on proposed mproveme nts to
be made and equipment in the BRIDGEPORT BUSINESS CENTRE, located in the
City of Jeffersonville, Clark County, Indiana; and
WHEREAS, GREAT DANE POWER EQUIPMENT, INC, has submitted a
Statement of Benefits on the form prescribed by the Indiana State Board of Tax
Commissioners for such purpose, which statement includes a description of the
proposed redevelc pment, an estimate of the number of individuals who will be
employed as a result of the redevelopment, an estimate of the annual salaries of
these individuals, and an estimate of the value of the redevelopment; and
WHEREAS, the Common Council of the City of Jeffersonville has previously

result from the proposed described redevelopment.
That the totality of benefits for said redevelopment is sufficient to justify the
deduction.
BE IT FURTHER RESOLVED, that the Common Council of the City of
JeffersonviIle. Indiana, hereby approves the application ano Statement of Benefits as
presented and flied by the Applicant. and that said Applicant shall be entitled to
deductions for a period of ten (10) years for improvements to real property, pursuant
to the provisions of I.C. 6-1.1-12.1-3(d) and I.C. 6-1.1-12.1-4(d)(3), and five (5) years
for equipment and machinery pursuant to I.C. 6-1.1-12.1-4.5, with the timely filing
and perfection thereof with the Clark County Auditor's office.
