An Ordinance concerning parking meters and regulating
the use of public streets and alleys of the City of
Jeffersonville, Indiana; providing for the enforcement
thereof; and repealing Ordinances 1249, 1261, 1295,
134~ and 1~33.
BE IT ORDAINED by the Common Council of the City of
Jeffersonville, Indiana:
SECTION I
The word "vehicle" as used herein shall mean any self-
propelled device by which any person or property is or may be
transported upon a public highway, except those operated on
rails and tracks.
Wherever the phrase "parking meter zones" is used it
shall refer to both sides of the respective streets, unless
otherwise expressly specified.
Wherever the phrase "Board" is used in this Ordinance,
it shall mean The Board of Public Works and Safety of the City
of Jeffersonville, Indiana.
SECTION 2
The following described parts of Streets in the City of
Jeffersonville, Indiana, are hereby established as parking meter
zones: P~arl Street between Chestnut Street and Court Avenue;
the East side of Kentucky between Sixth and Seventh Stree%~$
SprinE Street between Riverside Drive and Eighth Street; Wall
Street between Chestnut Street and Court Avenue; West side of
Wall Street between Court Avenue and Federal; West side of Meigs
Avenue between Court Avenue and Seventh Street; East side of
Meigs Avenue between Seventh Street and Franklin; Riverside
Drive between Mulberry Street and Watt Street; Market Street
between Pearl Street and Wall Street; Chestnut Street between
Pearl Street and Wall Street; Maple Street between Pearl Street
and Wall Street; South side of Court Avenue between Mulberry
Street and Mechanic Street; North side of Court Avenue between
Mechanic Street and Sixth Street; North side of Court Avenue
between Kentucky and Michiga~ North side of Sixth Street be-
tween Court Avenue and Michigan Street.
SECTION
The Board is hereby authorized to designate the size
of each parking meter zone, to determine in which zones park-
ing meters shall be installed, to determine the type of meters
to be installed, and the respective charges to be made by the
meter for each zone.
SECTION
The Board is hereby authorized to install or place
parking meters in such parking meter zones hereby created
or to be hereafter created by Ordinance of the City of
Jeffersonville, Indiana, and such meters shall be placed
upon the curb alongside or next to individual parking
spaces to be designated as heretofore provided. The Board
is authorized to provide for the rental, purchase, acquis-
ition, installation~ regulating, operation, maintenance,
repair, servicing, and replacement of parking meters when-
ever necessary to carry out the intent of this Ordimance.
SECTION 5
The Board is authorized to enter into such written
contracts as may be necessary to carry out the provisions
of this Ordinance and provide payment therefor, exclusively
from the funds received and revenues obtained from the
operation and use of said parking meters, without in any
way obligating the City of Jeffersonville, Indiana, to pay
for the same from funds derived from any other source.
In purchasing parking meters, the City Clerk-Treasurer
shall advertise for bids as now provided by statute for other
purchases by the City, and the purchases shall be made from
the lowest and best bidder.
SECTION 6
The coin or coins required to be deposited as provided
herein are levied for the payment of the purchase price,
rental fees, and cost of installation of such parking meters
or parking mechanical devices; for the payment of the cost of
maintenance, operation, repair, and all other incidental costs
and expenses in the operation of this Ordinance; and for the
payment of the cost of traffic signal devices used in the City
of Jeffersonville, Indiana, and also in the repair and main-
tenance of any of the public streets and highways where said
mechanical parking devices are in use and all streets connected
therewith in said City, and for the painting and marking of
all public streets where said mechanical parking devices are
in use and all streets connected therewith in said City.
SECTION 7
When any vehicle shall be parked in any space alongside
or next to which there is located a parking meter, as provided
for in this Ordinance, the owner, operator, manager or driver
of such vehicle shall immediately deposit in said parking meter
the appropriate coin of the United States of America and set in
operation the parking meter for that parking zone. The parking
meter zone may then be lawfully occupied by such vehicle dur-
ing the time paid for. If said vehicle shall remain parked in
any such parking zone beyond the appropriate limit, the park-
ing meter shall display a sign showing unlawful parking and in
~hat event such vehicle shall be considered and deemed to be
parked overtime. It shall be unlawful for any person to cause,
allow, permit or suffer any such vehicle, whether he be the
operator or registered owner, to be parked overtime.
SECTION 8
No vehicle shall be double parked on any street or
alley within the corporate limits of the City of Jefferson-
vilie, Indiana. In the event any vehicle is found double
parked on a street or alley within the City of Jeffersonville,
Indiana, said vehicle may be towed to the City Police Depart-
ment by a towing service called by the parking meter officer
or any member of the Jeffersonville Police Department. The
expense of said towing is to be paid by the owner of the vehicle.
SECTION 9
It shall be the duty of each traffic patrolman and any
or all other officers that are so instructed by the Chief of
Police to take the number of each vehicle which is over-parked
and report the same to the office of the Police Department and
the Traffic Division of the City of Jeffersonville.
In the event any vehicle is found parked at any parking
meter, said vehicle having three (3) or more violations of this
Ordinance which have not been paid, then in that event said
vehicle may be towed to the City Police Department by a towing
service to be called by the parking meter officer or other officer
of the Jeffersonville Police Department, the expense of towing
to be paid by the owner of the vehicle.
SECTION 10
Any vehicle parking in any parking space in any parking
meter zone established under this Ordinance shall be parked with
the ~eod of such vehicle along side of or next to the parking
meter adjacent to said parking zone. In the event the parking
meter zone is marked for diagonal parking, then the vehicle shall
be directed toward the parking meter. It shall be unlawful for
any vehicle to be parked across any parking zone lines, or~not
to be parked within the zone so designated by appropriate markings.
SECTION 11
It shall be unlawful to deposit or cause to be deposited
in any parking meter a slug, device or metallic substitute for
a coin of the United States of America.
SECTION 12
It shall be unlawful for any person to deface, injure,
tamper with, open or wilfully break, destroy or impair the use-
fulness of any parking meter installed under the provisions
of this Ordinance.
SECTION 13
The City Clerk-Treasurer shall be charged with the duty
of collecting the money derived from the operatzon of such park-
ing meters. He may deputize some person or persons to perform
these duties and if such person or persons are appointed, they
shall take an oath to faithfully perform these duties as such
deputy and they shall each give bond in the sum of Five Thousand
($ 5,000.00) Dollars, payable to the City of Jeffersonville,
Indiana, to guarantee the faithful performance of their duties
and give a full acco~uting of all monies they receive from the
use of the parking meters. The bond or bonds shall be approved
by the City Clerk-Treasurer and filed in his office. The premium
on each bond shall be paid out of the Traffic Fund.
SECTION 14
The Board is authorized to create loading zones within
the parking meter zones established by Section T,o(2) of this
Ordinance. These loading zones may be established only where a
retail or wholesale business has no access to back street or
alley parking. The owner of the business so affected may make
written application to the Board for the establishment of a load-
ing zone. If the Board, in its discretion, creates a loading zone,
it shall be for a period not to exceed One (1) year. The suc-
cessful applicant shall pay to the City of Jeffersonville a fee,
the amount to be determined by the Board, for the use of the load-
ing zone. The Board shall have authority to renew such permit or
permits upon written application or to~ revokethe same at any
time for cause deemed sufficient to it in the exercise of its
discretion.
SECTION 15 ~
The Board shall have the authority to pro~ide for load-
_ing zones in areas cover by this Ordinance from.~.OO A.M. to
/~A.M. in order for retail and.wholesale businesses to rec-
zu~ eive deliveries by commercial vehicles.
The owner of any vehicle which is parked in one of these
temporary loading zones, for any purpose other than making a
delivery as defined above, shall be deemed in violation of this
Ordinance and punishable as hereinafter provided.
SECTION 16
The Board is authorized, in its discretion, to ~uspend
the operation of any meter or meters to fttrther a general planned
business promotion within the City of Jeffersonville.
SECTION 17
The Board is authorized to issue windshield stickers
to vehicle owners living in the areas in which parking meters
are installed pursuant to this Ordinance. These stickers shall
entitle the vehicle owner to park, free from charge, on either
side of the Street within the block in which he or she resides.
SECTION 18
~uy person, firm or corporation who shall obtain a park-
ing meter violation ticket shall, if such ticket is turned in
to the Clerk-Treasurer of the City of Jeffersonville, Indiana,
within Twenty-Four (24) hours after the violation, be allowed
to pay the sum of Twenty-Five Cents ($ 0.25) in satisfaction
of said violation.
Any person, firm or corporation who shall obtain a park-
ing meter violation ticket, and who mere than Twenty Four (24)
hours after the violation charged in said ticket, presents the
same to the Clerk-Treasurer of the City of Jeffersonville,
Indiana, will be allowed to pay the sum of One ($ 1.O0) Dollar
in satisfaction of said violation°
Any person, firm or corporation who shall violate or
cause to be violated any of the provisions of this Ordinance,
and who shall be brought into Court, shall upon conviction
thereof be punished by a fine of not less than Five ($ 5°00)
Dollars nor more than One Hundred ($ lO0.O0) Dollars, or
~mprisoned in the County jail for not more than One Hundred
(100) days, or by both such fine and imprisonment, for each
violation resulting in conviction.
SECTION 19
The following Ordinances of the City of Jeffersonville,
Indiana, are hereby repealed as of the date thisOrdinance
becomes effective: Ordinances N~mbers 1249, 1261, 1295, 1341
and 1433. Any other Ordinances or parts of Ordinances in con-
flict herewith are hereby repealed.
SECTION 20
If any provision of this Ordinance or the application
thereof to any person, firm or corporation is declared invalid
by a Court of competent jurisdiction, such invalidity shall
not affect the other provisions or applications of this Ordin-
ance which can be given effect without the invalid provisions
or applications, and to this end the provisions of this Ordin-
ance are declared to be severable.
SECTION 21
This Ordinance shall be in full force and effect from
and after its passage and due publication ac¢,rding to law.
Passed by the Common Council of the City of Jeffer-
sonville, Indiana, this 6th day of August, 1962.
