HomeMy WebLinkAbout1968-R-09RESOLUTION NO. ~'-/'1~ OF THE GOVERNING BODY OF THE CITY OF JEFFERSONVILLE, INDIANA APPROVING AN AMENDMENT TO THE URBAN RENEWAL PLAN, PROJECT NO. IND. R-43, RIVERSIDE CENTRAL URBAN RENEWAL AREA, JEFFERSONVILLE, INDIANA WHEREAS, under the Provisions of Title I of the Housing Act of 1949, as amended, the Department of Housing & Urban Development Administrator is authorized to provide financial assistance to Local Public Agencies for undertaking and carrying out Urban Renewal Projects; and, WHEREAS, it is provided in such Act that contracts for financial assistance thereunder shall require that the Urban Renewal Plan for their respective Project Area be approved by the Governing Body of the locality in which the project is sit- uated and that such approval include findings by the Governing Body that: (1) The financial aid to be provided in the contract is necessary to enable the project to be undertaken in accordance with the Urban Renewal Plan; (2) The Urban Renewal Plan will afford maximum opportunity, consistent with the sound needs of the locality as a whole, for the rehabilitation or the redevelopment of the Urban Renewal Area by private enterprise; (3) The Urban Renewal Plan conforms to a general plan for the development of the locality as a whole; and (4) the Urban Renewal Plan g~ves due consideration to the provision of adequate park and recreational areas and facilities, as may be desirable for neighborhood improvement, with special consideration for the health, safety, and welfare of children residing in the general vicinity of the site covered by the plan; and, WHEREAS, there has been prepared and referred to the Governing Body of the locality (herein called the ~'Governing Body") for review and approval an Urban Renewal Plan for said project area, known and designated as the Riverside Central Urban Renewal Project Area, IND. R-43, Jeffersonville, Indiana; and, WHEREAS, such Urban Renewal Plan has heretofore been approved by the Governing Body of the Local Public Agency; and, WHEREAS, the Local Public Agency has prepared and submitted a program for the relocation of families that may be displaced as a result of carrying out the project in accordance with said Urban Renewal Plan; and, WHEREAS, the members of the Governing Body have general knowledge of the -2- conditions prevailing in the Project Area and have heretofore approved the Urban Renewal Plan as a whole in the light of such knowledge and have carefully considered and reviewed the proposals for relocation; and, WH£REAS, it has been called to the attention of the Governing Body of the local- ity that certain amendments to the Urban Renewal Ptan, as approved, are necessary in order to further protect the safety, health, and welfare of the inhabitants and users of the Urban Renewal Plan and of the locality at large; and, WHEREAS, it is necessary that the Governing Body of the locality take appropriate official action respecting the amendment to the Urban Renewal Plan; and, WHEREAS, the Governing Body of the locality did, on the 4th day of April, 1966, adopt a Resolution approving the aforesaid Urban Renewal Plan and the feasibility of relocation for the Riverside Central Urban Renewal Area in the City of Jeffersonville, Indiana; and, WHEREAS, the Governing Body is cognizant of the ~onditlons that are imposed in the undertaking and carrying out of Urban Renewal Projects with Federal assistance under Title I, including those prohibiting discrimination because of race, color, creed or national orig~n with respect to housing, facilities related to residential use, and all public facilities within a Project Area; public facilities proposed as non-cash local grants-in-aid, and employment; and, WHEREAS, the amendments to the Urban Renewal Plan and to the Resolution of the Governing Body of the locality dated April 4, ~966, are found by the Governing Body of the locality to be necessary in order to effectuate the Urban Renewal Plan as a whole, NOW, TNEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE LOCALITY that the Urban Renewal Plan heretofore approved by the Governing Body and the Resolution of the Governing Body heretofore adopted on the 4th day of April, 1966, be, and the same hereby are, amended as follows: Said Urban Renewal Plan is hereby amended by deleting therefrom Part C. Paragraph 2 b, Sub-Paragraph 1 b, ':Area and Density Requirements", Page 7 and by substituting therefor the follow- provisions: Housin9 Type Single Family Two Family Multi-Family (Walk Up) Multi-Family (High Density) -3- Minimum Lot Area 5000 Square Feet 5000 Square Feet 6000 Square Feet 6000 Square Feet Minimum Area Per Dwellin9 Unlt 5000 Square Feet 2500 Square Feet 5000 Square Feet for the first two dwelling units; 750 Square Feet for each addi- tional dwelling unit over two 500 Square Feet per dwelllng unit BE IT FURTHER RESOLVED BY THE GOVERNING BODY OF THE LOCALITY that the amend- ment to the Urban Renewal Plan, Numbered One (1) hereinbefore set forth is hereby in all respects APPROVED and AFFIRMED~ BE IT FURTHER RESOLVED THAT said Resolution dated April 4, 1966, as amended, and the said Urban Renewal Plan, as amended, be, and the same hereby are, confirmed, ratified and approved in all respects, and it is hereby found by the Governing Body of the locality that the Urban Renewal Plan, as amended, will further promote the public welfare and proper development of the Community; that the same is consistent with the sound needs of the locality as a whole, for the Urban Renewal of such areas by private enterprise; that said Urban Renewal Plan, as amended, continues to conform to said General Plan of the locality as a whole and continues to give due considera- tion to the provision of adequate park and recreation areas and facilities with special consideration for the health, safety and welfare of children residing in the general vicinity of the site covered by said Plan and that this Body hereby (a) pledges its cooperation in helping to carry out such Urban Renewal Plan and the Amended Urban Renewal Plan; (b) requests the various officials, departments, boards and agencies of the locality having administrative responsibilities in the premises likewise to coop- erate to such end and to exercise their respective functions and powers in a manner consistent with said Urban Renewal Plan and said Urban Renewal Plan as Amended; and (c) stands ready to consider and take appropriate action upon proposals and measures designed to effectuate said Urban Renewal Plan and said Urban Renewal Plan as Amended. IT IS FURTHER HEREBY FOUND AND DETERMINED that the financlal assistance under the provisions of Title I of the Housing Act of 1949, as Amended, is necessary to enable -4- the land in this Project Area to be renewed in accordance with the Urban Renewal Plan and the Amended Urban Renewal Plan for the Project Area, and, accordingly, the filing by the Local public Agency of an application or applications to amend such Urban Renewal Plan is hereby approved.
