PLAN AND APPROVING SAID PLAN, PROJECT NO. R'43, RIVERSIDE
CENTRAL URBAN RENEWAL PROJECT AREA, JEFFERSONVILLE, INDIANA

WHEREAS, under the Provisions of Tit!e I of the H?using Act of 1949, as amended
the Secretary of Housing & Urban Development is authorized to provide financial
assistance to Local Public Agnecies for undertaking and carrying out Urban Renewal
Projects; and,
WHEREAS, it is provided in such Act that contracts for financial aid there-
under shall require that the Urban Renewal Plan for their respective Project Area
be approved by the governing body of the locality in which the project is situated
and that such approval include findings by the Governing Body that: (1) The
financial aid provided in the contract is n~cessary to enable the project to be
undertaken in accordance with the Urban Renewal Plan; (2) The Urban Renewal Plan
will afford maximum opportunity, consistent with the sound needs of the locality
as a whole, for the rehabilitation or the redevelopment of the Urban Renewal Area
by private enterprise; (3) The Urban Renewal Plan conforms to a general plan for
the development of the locality as a whole, and (4) The Urban Renewal Plan gives
due consideration to the provisions of adequate park and recreational areas and
facilities', as may be desirable for neighborhood improvement with special consideration
for the health, safety, and welfare of children residing in the general vicinity of
the site covered by the Plan; and,
WHEREAS, there has been heretofore prepared and referred to the Common Council
of the City of Jeffersonville, Indiana ~(herein call the "Governing Body") for
rewiew and approval an Urban Renewal Plan for siad Project, known and designated as the
Riverside Central Urban Renewal Project Area, IND. R-43, Jeffersonville, Indiana; and,
WHEREAS, the Local Public Agency has heretofore prepared and submitted a program
for the relocation of individuals and families that may be displaced as a result of
carrying out the Project in accordance with the Urban Renewal Plan; and,
WHEREAS, the members of the Governing Body have general knowledge of the
conditions previaling in the Project Area and of the availability of proper housing
in the locality for the relocation of individuals and families that may be displaced
from the Project Area Rnd, in the light of such knowledge of local housing conditions
have carefully considered and reviewed such proposlas for relocation; and,
WHBRBAS, the Governing Body of the Lqcality, did, heretofore adopt a
Resolution approving the aforesaid Urban Renewal Plan and the Feasibility of
Relocation for the Riverside Central Urban Renewal in the City of Jeffersonville,
Indiana; and,
WHEREAS, it has been called to the attention of the Governing Body of the
Locality that certain amendments to the Urban Renewal Plan, as amended, and
approved, are necessary in order to further protect the safety, health and
welfare of the inhabitants and users of the Urban Renewal Plan and of the locality
at large; and,
WHEREAS, the amendments to the Urban Renewal Plan and the Urban Renewal Plan,
as amended, has been approved by the Governing Body of the Local Public Agency,
as evidenced by the copy of said Body's duly certified Resolution approving the
amendments to the Urban Renewal Plan and the Urban Renewal Plan, a~ amended, which
is attached thereto, and;
WHEREAS, the Plan CoJm~dssion of the City of Jeffersonville, which is the duly
designated and acting official planning body for the locality, has submitted to the
Governing Body its report and recommendations respecting the amendments to the
Urban Renewal Plan and the Urban Renewal Plan, as amended, for the Project Area
and has certified that the amendments to the Urban Renewal Plan and the Urban
Renewal Plan, as mmended, conforms to the general plan for the locality as a whole
and the governing Body h~s duly considered the report, rec~mnendations and certification
of the planning body; and,
WHHREAS, it is necessary that the Governing Body of the Locality take
appropriate official action respecting the amendments to the Urban Renewal Plan and
the Urban Renewal Plan, as amended; and,
WHBREAS, the amendments to the Urban Renewal Plan, as amended, are found by
the Governing Body of the locality to be necessary in order to effectuate the
Urban Renewal Plan as a whole.
W~tBRBAS, the Governing Body is cognizant of the conditions that are imposed
in the undertaking and carrying out of urban renewal projects with Federal financial
assistance under Title I, including those prohibiting discrimination because of
race, color, creed, or national origin.
NOW, THEREFORE, BE IT RESOLVED BY THE CO~4~ON COUNCIL OF THE CITY OF JEFFERSON-
VILLE, INDIANA:
1. That the Urban ReneWal Plan, as amended, heretofore approved by the
Governing BOdy, be, and the same hereby is, amended as follows:
Change Number 1
Said Urbgn ReneWal Plan is hereby amended in the Land Use Map, Page 12
of said Plan changing the following B-2 and R-2 to B-3 General Business:
Beginning at the intersection of the West line of Indiana Avenue with the
south line of Seventh Street; thence in a Westerly direction with the south
line of Seventh Street to the east line of Broadway; thence in a southerly
direction with the east line of Broadway to its intersection with the north
line of Fifth Street; Thence in an easterly direction with the north line of
Fifth Street to the West line of Indiana Avenue; thence in a northerly direction
with the West line of Indiana Avenue to the place of beginning, excluding all
dedicated public right-of-ways therein.
Change Number 2
Said Urban Renewal Plan is hereby ~mended in the Land Use Map, Page 12
of said Plan changing the following from R-2 and 1-2 to B-3 General Business:
Beginning at the intersection of the east right-of-way tine of the Clark
Memorial Bridge with the low-water mark of the Ohio River; thence in a
Northerly direction with the east right-of-way line of said Bridge ~o the
South line of Market Street; Thence in an Easterly direction with the South
line of Market Street to the West line of Illinois Avenue; Thence in a Southerly
direction with the west line of Illinois Avenue to the South line of Riverside
Drive; Thence in an Easterly direction with the South line of Riverside Drive
to the East line of Indiana Avenue; Thence in a Northerly direction with the
East line of Indiana Rvenue to the South line of Market Street; Thence in an
Easterly direction with the South line of Market Street to the West ~ight-
of-way line of Interstate 1-65; Thence in a Southerly direction with the West
right-of-way line of Interstate 1-65; to the low-water mark of the Ohio River;
Thence in a Westerly direction with the low-water mark of the Ohio River to
the place of beginning, excluding all dedicated public right-of-ways therein.
2. ~hat the amendments to the Urban 'Renewal Plan, N~nbered One and Two
hereinbefore set forth are hereby in all respects approved and affirmed.
3. That the Urban Renewal Plan, as amended, for the Project having been
duly revieWed and considered is hereby confirmed, ratified and approved and the
City Clerk Treasurer, be and is hereby directed to file said copy of the Urban
Renewal Plan, as amended, with the Minu~es of this Meeting.
4. That it is hereby foumd and determined that the Urban Renewal Plan, as
amended, continues to conform to the General Plan of the locality.
5. That it is hereby found and determined that the Urban Renewal Plan, as
amended, for the Urban Renewal Area, will further promote the public welfare and
proper development of the cormnunity and will afford maximum opportunity consistent
with the sound needs of the locality as a whole for the Urban Renewal of the Area
by private enterprise.

6. That is is hereby found and determined that"the Urban Renewal Plap, as
amended, for the Urban Renewal Area continues to give due consideration to the
provision of adequate park and recreational areas and facilities, as may be
desirable for neighborhood improvement, with special consideration for the health,
safety and welfare of children r~s~ng in the general vicinity of the site covered
by said Plan.
7. That, in order to implement and facilitate the effectuation of the Urban
Renewal Plan, as amended, hereby approved it is found and determined that certain
official action must be taken by this body with reference, among other things to
changes in zoning, the vacation and removal of streets, alleys, and other public
ways, the establishment of new street ~atterns, the location and relocation of sewer
and water mains and other public facilities and other public action, and, accordingly,
this Body hereby (a) pledges its cooperation in trying to carry out the Urban Renewal
Plan, as amended; (b) requests the varous officials, fiepartments, boards, and
agencies of the Locality having administrative responsibilities in the premises
likewise to cooperate to such end and to exercise their respective functions and
powers in a manner consistent with the Urban Renewal Plan, as amended; and (c) stands
ready to consider and take appropriate action upon proposals and measures designed to
effectuate said Urban Renewal Plan, as amended.
8. That the financial assistance under the provisions of Title I of the
Housing Act of 1949, as amended, is necessary to enable the land in the Project Area
to be renewed in accordance with the Urban Renewal Plan, as amended, for the Project
Area Rnd, according, the filing by the Local Public Agency of an application or
applications to amend such Urban Renewla Plan is hereby approved-
So enacted and adopted in the City of Jeffersonvi!le, Clark County, Indiana,
on this 4th day of ]!December , 1972
This ordinance shall be in full force and effect from and after its passage and
