HomeMy WebLinkAbout11-19-01NOVEMBER 19, 2001 1 COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA NOVEMBER 19, 2001 The Common Council of the City of Jeffersonville, Indiana met in regular session in Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana at 7:00 t on the 19t~ day of November, 2001. The meeting was called to order by Council President Les Merkley, with Clerk Treasurer Peggy Wilder at the desk. Also present was Deputy Clerk Barbara Hollis. Cou President Merkley welcomed all in attendance, asking all those present to stand as Councilper Ron Ellis gave the invocation. Council President Merkley then asked all those present to him in the pledge of allegiance to the flag. The roll was called and those present were; Councilpersons Les Merkley, Ron Denny Frantz, Rob Waiz, Barbara Wilson, and Ron Grooms. Absent: Conncilperson Vicki Conlin. Councilperson Grooms made the motion to amend the agenda to add as Items 17 A Danielle Cummins, Falls of the Ohio - Lewis & Clark Commission, seconded by Councilp~ Wilson, passing on a vote of 5-0. Council President Merkley did not vote. Councilperson t then made the motion to approve the agenda as amended, seconded by Councilperson Wil~ passing on a vote of 5-0. Council President Merkley did not vote. Council President Merkley presented the minutes of the meeting of October 30, 2001 consideration by the Council. Councilperson Wilson made the motion to approve the minute presented, seconded by Councilperson Ellis, passing on a vote of 4-0-1. Council Presi~ Merkley did not vote and Councilperson Waiz abstained as he did not attend the meeting. Clerk Treasurer Wilder presented the claim list, explaining one additional claim, consideration by the Council. Councilperson Ellis made the motion to approve the claims ~ the additional as presented, seconded by Councilperson Waiz, passing on a vote of 5-0. Cou President Merkley did not vote. PUBLIC COMMENT: There was no public comment. Mr. McCauley said both si acted in good faith. Hr explained the differences between the two contracts. The salary incre~ are the same on both contracts. Following all explanations, Councilperson Ellis made the mo to pass Resolution No. 2001-R-29, A Resolution Adopting The 2002 FOP Contract, seconder Councilperson Wilson, passing on a vote of 5-0. Council President Merkley did not vote. Councilperson Grooms then made the motion to pass Resolution No. 2001-R-30 Resolution Adopting The 2002 Firefighter's Union Contract, seconded by Councilperson W passing on a vote of 5-0. Council President Merkley did not vote. Firefighter's Union Presk Tony Decker gave a thank you to Mayor Galligan, City Attorney Galligan, and Phil McCm for their help. Council President Merkley introduced and explained the history of Ordinance No. 2( OR-32, An Ordinance Amending The Zoning Ordinance Of Jeffersonville, Indi, Councilperson Ellis made the motion to table Ordinance No. 2001-OR-32, as Attorney Kraft not in attendance, seconded by Councilperson Grooms, passing on a vote of 5-0. Cou President Merkley did not vote. A discussion regarding Robert's Rules followed with C Treasurer reading t}om a revised version of Robert's Rules. Clerk Treasurer Wilder will see Attorney Kraft is notified the Ordinance will be on the agenda for the next meeting. Councilperson Waiz made the motion to pass Ordinance No. 2001-OR-35, An Ordin~ Transferring Certain Funds Within Same Department (City Attorney) on the third read seconded by Councilperson Grooms, passing on a vote of 5-0. Council President Merkle not vote. Ordinance No. 2001-OR-37, An Ordinance of Additional Appropriation (General F1 Health Insurance) was introduced for second and third readings. Clerk Treasurer Wi reviewed the recent check releases charged to the Health Insurance Fund. Following discuss Councilperson Grooms made the motion to amend the amount to $150,000, seconded Councilperson Frantz, passing on a vote of 5-0. Clerk Treasurer Wi noted the Ordinance reflects a 3.5% increase. Councilperson Ellis made the motion to l Ordinance No. 201-OR-38 on the first reading, seconded by Councilperson Fra Councilperson Frantz said he believes everyone that works deserves a raise. Follo~ additional discussion, Councilperson Frantz made the motion to amend the Ordinance to indi, no raise for the Council, seconded by Councilperson Waiz, passing on the following roll vote: Ayes: Councilpersons Frantz, Waiz, Wilson, and Grooms. Nays: Councilperson Ellis. Councilperson Grooms asked if the Mayor, Clerk Treasurer, and Judge received additional compensation in 2001. Clerk Treasurer Wilder said the Mayor and Clerk Treas received Sanitary Sewer Board compensation new in 2001. The following roll call vote on first reading of Ordinance No. 2001-OR-38 was recorded: Ayes: Councilpersons Frantz and Waiz. Nays: Councilpersons Ellis, Wilson, and Grooms. Council President Merkley introduced Ordinance No. 2001-OR-39, An Ordin~ Transferring Surplus Funds From The Cumulative Capital Improvement Fund To The Get Fund, explaining this was a decision made during budget sessions. Councilperson Grooms n the motion to pass Ordinance No. 2001-OR-39 on the first reading, seconded by Councilpe Waiz, passing on a vote of 5-0. Council President Merkley did not vote. Council President Merkley introduced and explained Ordinance No. 2001-OR-40, Ordinance Establishing A Non-Reverting Fund For The Jeffersonville Bi-Centennial Commi Councilperson Waiz made the motion to pass Ordinance No. 2001-OR-40 on the first rear seconded by Councilperson Ellis, passing on a vote of 5-0. Council President Merkley di~ vote. Ms. Dani Cummins appeared before the Council representing the Indiana Lewis Clark Falls of the Ohio Bi-Centennial Committee. Ms. Cummins asked for continued suppo~ this National Signature Event. She reviewed the planned activities and the grants and donal received. Ms. Cummins requests a donation of $1,000 from the Council. Council President Merkley did not vote. Ordinance No. 2001-OR-41, An Ordinance Transferring Certain Funds Within Si Department (Probation User Fund) was presented for consideration. Councilperson Waiz m the motion to pass Ordinance No. 2001-OR-41 on the first reading, seconded by Councilpe~ Wilson, passing on a vote of 5-0. Council President Merkley did not vote. COUNCIL AND MAYOR COMMENTS: Councilperson Grooms noted two elected officials had received raises in 2001, and it general feeling they perform a community service. He does feel they receive adec compensation. Councilperson Wilson reminds all to attend "Light Up Jeffersonville". Councilperson Frantz stated the elected officials that received additional compens also were given additional responsibilities demanding more time. Councilperson Frantz does improvements, noting Jeffersonville did receive the "City of the Year" award. He does feel Mayor and Clerk Treasurer deserve a raise. Councilperson Frantz said as far as wasting m( he feels it is the Council that is wasting money by creating the sewer board. There is a pro~ and it is not in the Mayor's Office. Councilperson Ellis said sometimes the best thing to say is nothing. Council President Merkley hopes all will show up at Warder Park on November "Light Up Jeffersonville". Council President Merkley has distributed copies of the s~ financial report done by Robert Miller. The Sewer Board sanctioned this report. M Galligan voted in favor of having the report done. Council President Merkley personally tl~ an independent analysis is good. Clerk Treasurer Wilder noted Mr. Miller only requester State Board of Accounts audit report and reviewed the bond documents. He did not request other documents. Council President Merkley feels money for the Sewer Board is money spent. He does not understand the expense in moving the City garage outside the City limits paying rent as well as the added gas necessary to travel to the garage. He said it makes no s to sell property that the City owns to pay rent.
