HomeMy WebLinkAbout06-04-01COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA JUNE 4, 2001 The Common Council of the City of Jeffersonville, Indiana met in regular session in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana, at 7:00 P.M. on the 4th day of June 2001. The meeting was called to order by Mayor Thomas R. Galligan, with Clerk and Treasurer Peggy Wilder at the desk. Also present were City Attorney Anne Made Galligan, and Deputy Clerk Barbara Hollis. Mayor Galligan welcomed all in attendance, asking all those present to stand as Councilperson Run Grooms gave the invocation. Mayor Galligan then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were; Councilpersons Ron Ellis, Les Merkley, Denny Frantz, Rob Waiz, Barbara Wilson, Ron Grooms, and Vicki Conlin. Absent: None Mayor Galligan presented the minutes of the meeting of May 21, 2001 for consideration by the Council. Councilperson Wilson made the motion to approve the minutes as presented, seconded by Council President Merkley, passing unanimously. Councilperson Frantz asked to add a Resolution in support of Firefighter Gary Kinnaird attending the World Police and Fire Games in Indianapolis first on the agenda. Council President Merkley then made the motion to approve the agenda as amended, seconded by Councilperson Conlin, passing unanimously. Clerk and Treasurer Wilder presented the claim list of May 21, 2001 for consideration by the Council. Council President Merkley made the motion to approve the claims as presented, seconded by Councilperson Waiz. Councilperson Ellis commented he objects to the use of the promotion fund for sympathy flowers. The motion to approve the claims of May 21, 2001 passed on a vote of 6-1. Councilperson Ellis voted against passage. Clerk and Treasurer Wilder presented the claim list for June 4, 2001 for consideration by the Council. Council President Merkley made the motion to approve the claims as presented, seconded by Councilperson Grooms. Councilperson Ellis stated his June 4, 2001 2 objection to the use of the promotion fund to sponsor a golf tournament hole. The motion to approve the June 4, 2001 claims passed on a vote of 6-1. Councilperson Ellis voted against passage. PUBLIC COMMENT: Ms. Joanne Robbins appeared before the Council in support of the zoning change request made by Kenneth and Summer Kimmel. AGENDA ITEMS: Councilperson Frantz introduced Sgt. Gary Kinnaird of the Jeffersonville Fire Department. Councilperson Frantz explained Sgt Kinnaird will be competing in the Police and Fire Games in Indianapolis this weekend and suggests the Council help financially with the expenses. Fire Chief Mike Smith explained that Sgt. Kinnaird would be representing the City of Jeffersonville. Councilperson Frantz then made the motion to donate $500 from the Council Promotion Fund to Sgt. Kinnaird, seconded by Councilperson Conlin, passing unanimously. Councilperson Conlin stated her appreciation for Sgt. Kinnaird's time and effort in representing Jeffersonville. Councilperson Grooms offered the assistance of his sister-in-law who works for the Indianapolis Parks Department. City Attorney Anne Made Galligan presented Ordinance No. 2001-OR-12, An Ordinance Vacating Part Of Public Way Hopkins Place (Plat Book 9, Page 29) reviewing the explanations from the last meeting. Councilperson Conlin made the motion to pass Ordinance No. 2001-OR-12 on the second and third readings, seconded by Councilperson Grooms, passing unanimously. Attorney Galligan next presented Ordinance No. 2001-OR-13, An Ordinance Amending SS93.01 Through 93.32 Of The City Of Jeffersonville Municipal code Concerning City Garbage Collections. Councilperson Conlin made the motion to pass Ordinance No. 2001-OR-13 on the second reading, seconded by Councilperson Grooms. Ms. Nellie Knowland said she had observed garbage cans being thrown down following dumping. Mayor Galligan said they should be laid down and he will work with the department. Ms. LaVerne Dooley feels the 90-gallon containers are too big and asked what alternatives there are. Mayor Galligan explained the goal is to reduce manual labor. Ms. Stephanie Redd Nelson asked that there be a notice in the newspaper. Mayor June 4, 2001 3 Galligan plans to do a press release following passage of the Ordinance. Mr. Ken Ogden feels the use of the containers will reduce workman's compensation claims and expenses.. Councilperson Ellis feels this is another unfunded mandate for the citizens to buy cans and he will not support the Ordinance. Councilperson Grooms questioned the need for 93.15, B, 4, and 93.31. Mayor Galligan is not saying he will force enfomement '~tomo~row". Mr. Sylvester Tutt feels residents should have been notified prior to the introduction of this Ordinance. Attorney Galligan stated this Ordinance does not require anyone to buy anything. Ordinance No. 2001-OR-13 passed on the second reading on a vote of 5-2. Councilpersons Ellis and Frantz voted no. Attorney Galligan reviewed the need for Ordinance No. 2001-OR-14, An Ordinance Amending Ordinance No. 90-OR-60, Known As The Jeffersonville Sewer Rate Ordinance. Council President Merkley made the motion to pass Ordinance No. 2001-OR-14 on the second and third readings, seconded by Councilperson Grooms. Councilperson Elhs made the motion to amend the Ordinance replacing "must" with "may". Attorney Galligan explained the language is due to bond obligations. Councilperson Grooms has researched the language and agrees with the use of "must". Councilperson Grooms did second the motion to bring the amendment to a vote. The motion to amend said Ordinance failed on a vote of 1-6. Councilpersons Merkley, Frantz, Waiz, Wilson, Grooms and Conlin voted no. The motion to pass said Ordinance passed on a vote of 6-1 w/th Councilperson Ellis voting no. Ordinance No. 2001-OR-15, An Ordinance Transferring Certain Funds Within Same Department (Common Council) was presented and explained. Councilperson Frantz made the motion to pass Ordinance No. 2001-OR~15 on the first reading, seconded by Councilperson Waiz. As this was the recommendation of the Finance Committee, Councilperson Ellis questioned the effectiveness of the committee and suggests the Council go back to having workshops so all can hear the same thing at the same time. Council President Merkley explained this subject has been on the agenda several times. Councilperson Wilson feels with something this large the full Council should be briefed. Following all discussion, Ordinance No. 2001-OR-15 passed on the first reading on a vote of 6-1. Councilperson Ellis voted no. June 4, 2001 4 Councilperson Grooms introduced Mr. Henry Sanders, a resident of 418 West Riverside Drive in Jeffersonville. Mr. Sanders presented and explained materials regarding the Court Avenue Extension project. He related his observations of the traffic flow, making suggestions for improvements in the plan, and making sign suggestions. At the conclusion of Mr. Sanders' presentation, Councilperson Grooms stated his appreciation for the sharing of information and comments for alternatives. Attorney Galligan presented Ordinance No. 2001-OR-16, An Ordinance Amending SS35.10 © Of The Jeffersonville Municipal Code Concerning Sick Leave. This has been revised due to a request from Department Heads. Council President Merkley made the motion to pass Ordinance No. 2001-OR-16 on the first reading, seconded by Councilperson Grooms. Following discussion, Ordinance No. 2001-OR-16 passed on the first reading on a vote of 6-1. Councilperson Ellis voted against passage. Attorney Galligan presented Ordinance No. 2001-OR-17, An Ordinance Changing The Zoning Map Designation Of A Certain Tract Of Property Being Part Of Lot No. Ten (10) Block No. 74 In The City Of Jeffersonville, County Of Clark, explaining the Plan Commission has recommended passage. Councilperson Conlin made the motion to pass Ordinance No. 2001-OR-17, seconded by Councilperson Wilson, passing unanimously. COMMITTEE REPORTS: There were no committee reports. COUNCIL AND MAYOR COMMENTS: Councilperson Conlin thanked Sgt. Kinnaird for his efforts and wished him well. Councilperson Grooms thanked Clerk Treasurer Wilder for the budget calendar. He has looked into an employee picnic in Warder Park and suggests July 15 or August 19. He would like to fund this from the Council Promotion Fund and he does prefer August 19. Councilperson Grooms suggests a joint meeting with the Town Board of Clarksville. He would like to look into the possibility of using the funds set aside this year for the aquatic center. Councilperson Wilson reminds and invites all to the Concerts In The Park. Councilperson Frantz wishes Sgt Kirmaird good luck. He is sure he will do well. June 4, 2001 5 Councilperson Ellis is upset that Mayor Galligan made comments to the Courier Journal reporter that he had requested the City pave private property. He would not ask to have private property paved and suggests Mayor Galligan's comments border on slander. Councilperson Ellis is also upset that Mayor Galligan said he would put Councilperson Ellis' son on the Fire Department if he would "kill the sewer board". Councilperson Ellis suggests this is close to bribery. Councilperson Frantz said he made the suggestion, and that the Mayor did not bring this up. Council President Merkley reminds and invites all to Jeff Fest this weekend. He has distributed a budget process memo. Mayor Galligan noted that 8th Street will be paved this fall. Mayor Galligan will talk with Park Superintendent Elliot about his requests. There being no further business to come before the Council, Council President Merkley made the motion to adjourn at 8:25 P.M., seconded by Councilperson Conlin, passing unanimously. THOMAS R. Augus~ 1994 Alternative Parallel Routes The following discussion describes existing conditions and suggested improvements at four locations within the project limits that may improve the movement of traffic into and out of the downtown area, and thus encourage traffic to by-pass the Kennedy Interchange. The four locations evaluated are: · 1-64 & Story Avenue/Mellwood Avenue Interchange lark Memorial Bridge % · 1-64 R~mp at Ninth Street · 1-65 Ramp at E. Liberty Street 1-64 & Story Avenue/Mellwood Avenue Interchange - The 1-64 interchange with Story Avenue and Mellwood Avenue is a split diamond interchange, located east of downtown. The westbound exit and eastbound entrance ramp terminals are located on Mellwood Avenue and the 1-64 eastbound exit and westbound entrance ramp terminals are located on Story Avenue. Mellwood Avenue and Story Avenue are parallel one way streets, divided by the South Forlc Of Beargrass Creek, with Mellwood being eastbound and Story being westbound. Presently, westbound traffic exiting 'I-64 at Mellwood Avenue must turn right on Mellwood, then left on Frankfort Avenue, then left on Story Avenue which provides a straight access route to the downtown area via Main Street. Because the intersections of Mellwood Avenue at Frankfort Avenue and Frankfort Avenue at Story Avenue are highly congested during peak traffic periods, additional traffic will nor use this route to access the downtown area, without furore improvements. A suggested nnprovemem to facilitate the ease of access to the downtown area would be the installation of connectors between the 1-64 westbound exit ramp terminal at Mellwood and the westbound entrance terminal at Story and between the eastbound exit ramp terminal at Story and eastbound entrance ramp at Mellwood. The installation of the northbound connector would allow the exiting traffic at Mellwood to have direct access to inbound Story while bypassing the congestion on Frankfort Avenue in the a.m. peak traffic period. During the p.m. peak traffic period the connectors would provide for less congestion and relieve the traffic on the local streets west of the eastbound entrance ramp ar Mellwood. The connectors would have a two-lane pavement section to allow for separate turn lanes and storage capacity. The northern most lane of Mellwood Avenue could be converted to a westbound lane from Frankfort Avenue to the · northbound connector. This would relieve the congestion ar the Frankfort Avenue and Story Avenue intersection and increase the flow of traffic on the city streets. ~:,~C~lark Memorial ~'~ The Clark Memorial Bridge, also known as the Second Street Bridge ' ~-~as four l~nes w~th t-'-'~-~) designated lanes in each direction. I~r~d street capacity f~Lf~9_f of the bridge will be/neell the three d~rectmnal bridge lane~ to be~ru_ lly utihzed~ .... - 1-64 Rainy at Ninth Street - The present routing of traffic from westbound Main Street westbound entrance ramp at the end of Roy Wilkin~ Boulevard requires traffic t~ turns and go three blocks out of the way. Main Street traffic proceeds to Tenth ~ and proceeds southward to Market Street, turns left and proceeds to Ro3 turns left onto the 1-64 ramp. Exhibit 7 shows the layout of the 1-64/Ninth Street and the local street systems. Easier access to the westbound 1-64 ramp would increase the use of this ramp and decrease the traffic on the section of 1-64 through the Kennedy Interchange. Access to the westbound 1-64 ramp can be provided through a modification of the local street network and reconfiguration of the ramp terminal. Ninth Street. which is presently one way northbound between Market and Main Streets, must be converted to a two way street. A right turn only entrance m the westbound 1-64 ramp would be installed from southbound Ninth Street. north of Market Street. Traffic from Main Street would then turn left Ohm Ninth Street. then right onto the 1-64 westbound ramp, before Market Street. Exhibit 7 shows these proposed modifications. t-65 Ramp at Liberty Street - Presently traffic on southbound 1-65 which wants to access the complex of hospitals east of 1-65 and south of E. Liberty must exit onto northbound Brook Street, 'proceed to eastbound Market Street. then follow Market Street until reaching an intersection with a southbound street that passes through the hospital complex. Another route is via the Third Street exit from westbound 1-64 and then southbound on Third Street to access an eastbound street that leads into the hospital complex. Presently the exit ramp from southbound 1-65 to Brook and Jefferson streets has a backup of traffic in the a.m..peak traffic period. A suggested improvement to allow for an easier access to the hospital complex and relieve th~ Brook/Jefferson Street ramp congestion is the construction of a southbound 1-65 exit ramp to eastbound E. Liberty Street as shown on Exhibit 8. The ramp would allow direct access to E. Liberty Street which is on.the north fringe of the hospital complex. The new E. Liberty exk r~rnp lane would be a continuation of the inside lane, of the dual lane exit ramp onto Brook and Jefferson Streets. The existing bridge over E. Liber. ty Street will .require widening; and a new V-4 VI. OVERVIEW OF IMPACTS A. Summary of Observations One primary objective of this work task is to identify a broad range of alternative concepts for the KIC which can improve safety and efficiency of traffic operations. Another objective is to reach agreement within the study team as to what design criteria and ·design LOS can best satisfy the needs of this specific situation.
