RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE,
INDIANA, APPROVING THE REVISED URBAN RENEWAL PLAN FOR THE
CLAYSBURG NEIGHBORHOOD DEVELOPMENT PROGRAM, AND REVISED URBAN
RENEWAL AREA
WHEREAS, in connection with an application of the City of Jeffer-
sonville Department of Redevelopment's continuing efforts to redevelop
the Urban Renewal Area; and,
WHEREAS, under the provision of the Redevelopment of Cities and
Towns Act of 1953, as amended and supplemented, that the revised Urban
Renewal Plan for the respective revised urban renewal area comprising
the Neighborhood Development Program be approved by the governing body
of the locality in which the area is situated and that such approval
include findings by the governing body that: (1) the financial aid
to be provided in the contract is necessary to enable the Program to
be undertaken in accordance with the revised Urban Renewal Plan; (2)
the revised Urban Renewal Plan will afford maximum opportunity, con-
sistent with the sound needs of the locality as a whole, for the
rehabilitation or redevelopment of the revised urban renewal area by
private enterprise; (3) the Jeffersonville Plan Commission has
determined that the revised Urban Renewal Plan conforms to the Master
Plan of development for~the City and the Plan Commission has approved
the Redevelopment Commissioners' Declaratory Resolution and revised
Redevelopment Plan; and (4) the revised Urban Renewal Plan gives
due consideration to the provision of adequate park and recreational
areas and facilities, as may be desirable for neighborhood improvement,
with special consideration for the health, safety, and welfare of
children residing in the general vicinity of the site covered by the
revised Plan; and,
WHEREAS, it is desirable and in the public interest that the City
of Jeffersonville Department of Redevelopment (herein called the "Local
Public Agency") undertake and carry out the Neighborhood Development
Program (herein called the "Program") identified as the Claysburg
Neighborhood Development Program, located within the corporate limits
of the City of Jeffersonville, County of Clark, State of Indiana
(herein called the "Locality"), and described as follows:

Beginning at the northeast corner of the intersection of Eighth
Street and Spring Street; thence in a northerly direction along
the east side of Spring Street to the southeast corner of the
intersection of Ninth Street and Spring Street; thence in a
westerly direction along the north side of Ninth Street to its
intersection with the west side of Broadway; thence northwardly
along the west side of Broadway to its intersection with the
south side of Sparks Avenue; thence westerly along the south
line of Sparks Avenue to the City Limits; thence following the
line of said City Limits to a point where said City Limits inter-
sect the Pennsylvania Railroad right-fo-way track; thence following
the easterly line of said right-of-way track approximately 1,O00
feet to a point; thence eastwardly to the City Limits; thence
northwardly along said City Limits to Nineteenth Street; thence
northeastwardly along said City Limits to a point where said City
Limits changes direction to a southeastwardly course; thence along
said City Limits in a southeastwardly direction to a point where
said City Limits would intersect the north side of Pennsylvania
Avenue, if extended; thence in a southeastwardly direction along
said extension and thence along the easterly side of Pennsylvania
Avenue to its intersection with the north side of Twelfth Street;
thence in an easterly direction along the north side of Twelfth
Street to its intersection with the east side of Penn Street; thence
in a southeastwardly direction along the east side of Penn Street
to its intersection with the south sdie of Eighth Street; thence in
a westerly direction along the south side of Eighth Street to its
intersection with the east side of Walnut Street; thence at right
angles in a northerly direction to a point where said line inter-
sects the north side of Eighth Street; thence in a westerly direction
along the north side of Eighth Street to the place of beginning; and,
WHEREAS, it is desirable and in the public interest that the City
of Jeffersonville, Department of Redevelopment, (herein called the "Local
Public Agency") undertake and carry out the redevelopment of the revised
urban renewal area, located within the boundaries of the Claysburg Neighbor-
hood Development Program; and,
WHEREAS, the Local Public Agency has made studies of the location,
physical conditions of structures, land use, environmental influences,
and social, cultural, and economic conditions of the revised urban
renewal area comprising the Program and has determined that the revised
area is a blighted area and that it is detrimental and a menace to the
safety, health, and welfare of the inhabitants and users hereof and of
the Locality at large, because of the presence of blighted structures
and the lack of adequate community improvements, and the members of
this Governing Body have been fully apprised by the Local Public Agency
and are aware of the facts and conditions; and,
WHEREAS, there has been prepared and referred to the Common Council
of the Locality (herein called the "Governing Body") for review and
approval a revised Urban Renewal Plan for the revised urban renewal
area, dated December 1971 and,revised September 1983, and consisting of
ninety pages more or less and one Exhibit, which Plan is entitled
"Neiqhborhood Development Proqram~ Claysburg Areas Department of
Redevelopment, City of Jeffersonville~ Jeffersonville~ Indiana~ Revised
Urban Renewal Plan"; and,
WHEREAS, the revised Urban Renewal Plan has been approved by the
Governing Body of the Local Public Agency, as evidenced by the copy of
said Body's duly certified resolution approving the revised Urban
Renewal Plan which is attached thereto; and,
WHEREAS, a general plan has been prepared and is recognized and
used as a guide for the general development of the Locality as a whole;
and,
WHEREAS, the Plan Commission of the City of Jeffersonville, Indiana,
which is the duly designated and acting official planning body for the
Locality, has submitted to the Governing Body its report and recommenda-
tions respecting the revised Urban Renewal Plan comprising the Program
and has certified that the revised Urban Renewal Plan conforms to the
general plan for the Locality as a whole, and the Governing Body has
duly considered the report, recommendations, and certifications of the
planning body; and,
WHEREAS, the revised Urban Renewal Plan for the revised. Program
area prescribes certain land uses for the revised Program area and will
require, among other things, changes in zoning, the vacating and removal
of streets, alleys and other public ways, the establishment of new street
patterns, the location and relocation of sewer and water mains and other
public facilitieS, and other public action; and,
WHEREAS, Title VI of the Civil Rights Act of 1964, as amended,
and the regulations of any Federal agency effectuating that title,
provide that no person shall, on the grounds of race, age, sex, color
or national origin, be excluded from participation in, be denied the
benefits of, or be subject to discrimination in the undertaking and
carrying out of any federally assisted projects;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF
JEFFERSONVILLE, INDIANA:
1. That it is hereby found and determined that the revised urban
renewal area comprising the Program is a blighted area and qualifies as
an eligible area under the Redevelopment of Cities and Towns Act of 1953,
as amended and supplemented.
2. That the revised Urban Renewal Plan for the Program, having been
duly reviewed and considered, is hereby approved, and the City Clerk-
Treasurer be and is hereby directed to file said copy of the revised
Urban Renewal Plan with the minutes of this meeting.
3. That it is hereby found and determined that where clearance is
proposed that the objectives of the revised Urban Renewal Plan cannot be
achieved through more extensive rehabilitation of portions of the revised
urban renewal area comprising the Program.
4. That it is hereby found and determined that the revised Urban
Renewal Plan for the Program conforms to the general plan of the Locality.
5. That is hereby found and determined that the financial aid to be
provided pursuant to the contract for Federal financial assistance per-
taining to the Program is necessary to enable the Program to be undertaken
in accordance with the revised Urban Renewal Plan for the area comprising
the Program.
6. That it is hereby found and determined that the revised Urban
Renewal Plan for the revised urban renewal area compriS~g~the Program
will afford maximum opportunity, consistent with the sound needs of the
Locality as a whole, for the renewal of the area by private enterprise.
7. That it is hereby found and determined that the revised Urban
Renewal Plan for the revised urban renewal area gives due consideration
to the provision of adequate park and recreational areas and facilities,
as may be desirable for neighborhood improvement, with special considera-
tion for the health, safety, and welfare of children residing in the
general vicinity of the site covered by the Plan.
8. That, in order to implement and facilitate the effectuation of
the revised Urban Renewal Plan hereby approved, it is found and determined
that certain official action must be taken by this Body with reference,
among other things, to changes in zoning, the vacating and removal of
streets, alleys, and other public ways, the establishment of new street
patterns, the location and relocation of sewer and water mains and other
public facilities, and other public action, and accordingly, this Body
hereby (a) pledges its cooperation in helping to carry out the revised
Urban Renewal Plan, ~b) requests various officials, departments, boards,
and agencies of the Locality having administrative responsibilities in
the premises likewise to cooperate to such end and to exercise their
respective functions and powers in a manner consistent with the revised
Urban Renewal Plan, and (c) stands ready to consider to take appropriate
action upon proposals and measures designed to effectuate the revised
Urban Renewal Plan.
BE IT FURTHER RESOLVED that the Clerk Treasurer of said City of
Jeffersonville, Indiana, is hereby ordered and directed to give notice
as provided by law.
Adopted by the Common Council of the City of Jeffersonville, Indiana,

THE UNDERSIGNED HEREBY CERTIFIES AS FOLLOWS:
1. That he is the duly qualified and acting City-Clerk Treasurer of
the City of jeffersonville, Indiana, (hereinafter called the "Locality"),
and the custodian of the records of the Locality, including the minutes
of the proceedings of the Common Council of the City of Jeffersonville,
Indiana (hereinafter called the "Governing Body").
2. That the attached Resolution is a true and correct copy of a
Resolution, including the WHEREAS clauses, as adopted at a meeting of
the Governing Body held on the / day of December , 1983, (here-
~nafter called the "Resolution of the Governing Body").
3. Also attached hereto is a true and correct copy of the revised
Urban Renewal Plan, which has been previously approved by the City of
Jeffersonville Department of Redevelopment Commission, as evidenced by
a duly certified Resolution of that body attached to the Plan, presented
at the meeting, and approved by the Resolution of the Governing Body.
4. That the Resolution of the Governing Body has been duly recorded
in the minutes of the meeting and is now in full force and effect.
5. That said meeting was duly convened and held in all respects in
accordance with Law and By-Laws of the Locality. To the extent required
by Law or By-Laws, due and proper notice of said meeting was given. A
legal quorum of members of the Governing Body was present throughout the
meeting, and a legally sufficient number of members of the Governing Body.
All other requirements and proceedings under Law, the By-Laws, or other-
wise, incident to the proper adoption of the Resolution of the Governing
Body, including any publication, if required by Law, have been duly
fulfilled, carried out, and otherwise observed.
6. If an impression of the seal has been affixed below, it con-
stitutes the official seal of the Locality and this certificate is
hereby executed under such official seal and was duly affixed by the
undersigned at the time this certificate was signed. If no seal has
been affixed below, the Locality does not have and is not legally re-
quired to have an official seal.
7. That the undersigned is duly authorized to execute this certificate.
