HomeMy WebLinkAbout1983-OR-17 An Ordinance to Control the Growth of Weeds or Noxious Plants Within the City. BE IT ORDAINED BY THE COM~ON COUNCIL OF THE CITY OF JEFFERSONVILLE, CLARK COUNTY, INDIANA~ THAT: Section On~ The growth of weeds or noxious plants is deemed injurious to public health and is hereby declared a nuisance. Section Two No owner of any lot or parcel of real estate witCh, the City shall allow the same, or any alley or sidewalk abutting such lot, to become overgrown with weeks or noxious plants to such an extent that such ©vergrowth, within the opinion of the Department of Building Commissioner is detrimental to the Public Health. Section Three.. It shall be the duty of the Building Commissioner to make careful inspection of all land situated within the City to determine whether or not any weeds or noxious plants have been permitted to grow thereon. Whenever such weeds or noxious plants have been permitted to grow in such manner as to become injurious to public health, safety or welfare, the Building Commlsslone shall cause notice to be sent to the owners of such lands, by registered mail, ordering them to abate or destroy such weeds or noxious plants. In case such owner is unknown, the Department may cause such notice to be published by one insertion in a daily newspaper of general circulation. If the property owner fails to remove or cut the weeds or noxious plants within 10 days after receiving notice to do so, the Building Commissioner may cause same to be removed or cut and the expense thereof shall be billed to such property owner. If such property owne~ fails to pay such bill within 60 days from the date of mailing then the Commissioners shall cause to be filed with the County Recorder a lien against such property, which lien shall be fore- closed as are other similar liens. the necessity of the City having to noxious plants and foreclose such lien shall be for which the property owner was billed. Section Four Any additional cost created by cut or remove such weeds or added to the amount This Ordinance shall be in full force and effect from and after its passage and approval.
